I've been reading some of your information and wanted to see if you all could help me out of my payday loan nightmare!
I have 2 loans that I have had trouble paying back. They are as follows:
Ace America (storefront) $562
CheckNGo Online $662
The one with ACE was higher, but I let them intimidate me into paying $450 last payday and they expect me to pay the balance of $562 tomorrow. I just do not have the money to pay them and I don't know what to do! The person that called me was so rude, nasty and threatening.
Check&Go has tried to debit from my account unsuccessfully, but they are not bothering me too much at this point. I hate I ever got myself into this mess. It's too stressful and I'm tired of being late on everything else in order to try to keep these people happy.
Could you all please give me some suggestions as to what to do or how to talk with this people without being intimidated?
Also could you inform me on the rules in Texas.

You need to see if these companies are following the laws . . . . If they aren't, file complaints! These companies will probably both be licensed, so they will be fined if they aren't sticking to the law!

Your checkngo online loan - Is it an installement loan or a payday loan? Meaning, do you have set "payments" for a ceratin time frame or are you supposed to pay it off each payday?

Checkngo debited my account 3 times on the same day. I called the bank to stop payment, but from reading thru the forum it looks like I need to close ACH debits completely or close out my account.
The people from Ace are rude and kept saying they would "move forward" if I didn't pay them off. Of course they said I could pay them and then reapply, but I'm not going to fall for that. I just want to be done with all of this!!!

Most places will tell you they won't accept payment plans, but they will. And usually. once you default, the fees stop.
You need to close the account. When you do that, ask your bank what their policy is on ach transactions going through on closed accounts. Some banks will force open the closed account and allow the transactions to go through. Then you end up owing the bank $1000's. If your bank does do this, tell them the whole situation, and ask them to put an ach block, deposit only, or a hard hold on the account before they close it. That will stop the pdl's from force opening the account.
You need to start taking care of the important things first. These are just loans. You can't go to jail, the worst that can happen is they take you to court and get a judgement. As long as they are recieving payments regularly, odds are against them doing so.
Just call them up and be honest. Things got out of control, and you can't handle it. You want to pay what you owe, but you need to set up more affordable payment plans.

Each of these companies are nation wide and are reputible companies. I would recommend contacting the local centers that you established your loans with and work out a payment plan over your next 4 to 8 pay periods dependant upon what you can afford. I am assuming that these loans are in a returned status or written off status which means that you should not be accruing any additional fees beyond the return check fee that is allowed under state law. Take your current balance and figure out a payment you can and will make each pay period over the next 2 to 3 months and let them know what you can afford to pay and most importantly stick to the payments to get the items taken care of before they escalate this to a small claims action or garnishment. If the local centers are unwilling to work with you then I would contact their customer comment lines which each of these companies will have posted within their lobbies. This would put you in contact with their District Managers who will assist you in getting this resolved if the local centers will not. You can also get this contact (comment line) info off their company web sites.

Once you get them to agree to your payment plan, get it in writing so they can't come back and say you aren't following the agreement. Also, be sure not to promise more then you can realistically afford. You don't want to default on the payment plan.

I just wanted to tell the latest information on my saga...
ACE is not willing to work with me at all. The lady is very rude and really won't let me get a word in edgewise. I told her I'd like to work with her and suggested paying $100 per pay day until it was paid. She said "no deal" and I needed to seek legal counsel. I sent ACE an email and certified letter on Friday. They are calling everyone they can think of to try and get a hold of my supervisor. I work on a military installation (I'm a civilian) and they are calling people in other parts of the base looking for my supervisor. They are relentless. Not sure what to do about them at this point. Any suggestions?
Checkngo debited my account on Friday for $229. I spoke with my bank this morning and they said they would reverse the debit and bank fees back to me and I could send in affidavits stating that I did not allow them to take out this debit. They also said I could close my account and they would reopen another for me. I sent CheckNGo and email, but does anyone have a physical address that I could send a letter certified to them to work out payment arrangements.
I had two other PDL's to paydayok and apple fast cash that are with this account. I was paying them okay, but I want to be done with them also. Does anyone have a physcial address for them so I could make arrangements with them?
What a nightmare!!! I could just kick myself for getting into this predicament.

i can promise you that no one is going to call you and tell you they are going to take you to jail because you are late on a loan. for one thing this is not theft bye check because you never wrote them a check. for 2 legally they are not allowed to treaten you in any way in the state of texas that is considered a threat and this state takes those very seriously. you need to get a recorder and let it record you conversation with him next time and tell him that you are going to take this to the ag's office and have them arrest him for threatening you. they are not legally allowed to call you at work or to threaten you in any way or they can go to jail. plus all they can do is file with the credit bureau and put it on your credit so other companies wont loan you money. there is no such thing as a loan inforcer in texas.

I am having the issue with the payday loan people calling my job. I tried to ask the lady why they needed to speak to somebody in HR and she just said that if I wouldnt transfer her, she would call back and ask for herself. I need to know what if anything they can do with my job. I am completely new to this. I never got a payday loan before this past year, and now i am up to my ears in mess! I know i need to try to work things out with them, but they are not very nice at all.

I got a $150.00 loan from them my account was frozen and it returned one payment. I got a call from a company call Litigation and theft arbitration and they are threatening to charge me with fraud and hot checks. They now say I owe them $545.00 Can they prosecute me? I took a $300 PDL from Loanshop Online back in October 2007. We made several payments on this loan (about 5 payments of $90/each), then we ran into a serious financial setback and had to default on the loan payments in order to keep our electricity on, food on the table, gas in vehicles. We are now back on our feet and I am willing to repay the loan. I contacted them today, June 2, and explained that I am willing to repay $100 every 2 weeks beginning Friday June 6. I was told that this was not acceptable. The agent said I had several broken promises and they did not believe me, and could no longer speak to me about my debt, only my representative or attorney. She also told me that I needed to "check my resources" and if I did not have $300 in their office by 4 PM today, they would proceed against me with a judgment. I again explained that I am willing to pay this and needed an arrangement, and was told it was too late and that their hands were tied and they could not hold the account for 4 more days. I was also told that the total amount was $890 (I previously requested validation of the charges, but never received it), and that I would also have to pay their attorney and court costs which would be "well over $1000."
HELP!!! Can they do this? I am WILLING to pay this, but they won't accept my arrangements. I am in Texas. What happens if they take me to court? Will they garnish my wages or take my property?

The first charge is for the act of writing a bad check, just a class c misdemeanor (usually a fine) and the other charge is for the "theft" of what you got out of writing the bad check, a Class B misdemeanor. I gotten a call at work for a payday loan I think I did online. They said it was in 2005. I don't remember they had my information. If I did I'm quite sure I've paid it back. The thing is they inform me today that they are filing 3 criminal charges again me. I don't need anything like that on my record. Can they do that. The loan amount was for $470 now they said because of interest it's now $1584 and I have to pay now no later then 5p. I don't have $529. I can want to my debt but don't have that kind of money. I asked can I have a address and mail it in via money order she said not it have to be debit from a credit card or checking account. The won't give me any documentation to verify. What can I do. It sounds like a illegal collector bought up some old junk debt and is trying to harrass and intimidate you in to paying.
Did they say who the orignal lender was?
It is also almost very hard to garnish wages in TX. They are blowing smoke.
I would ignore them unless you think you can get an address to send a cease and desist letter to.

It is on them to prove the debt is truely yours. Legal debt collectors usually do not threaten things like criminal charges as that is illegal for them to do that.
