Collection Agency Calling but gives no information messages?
Date: Mon, 12/05/2005 - 09:40
I have a situation which I am guessing is fairly common. TrueLogic has been calling and leaving automated messages on my voicemail, however, I only know it's TrueLogic by doing a reverse look-up. On top of that I have not received any kind of written letter from them or any information regarding what debt they are calling on. I think I know what they are calling about but I live with my girlfriend so for all I know they could be calling on something for her. This has been going on for well over a month and I am planning on sending a debt verification letter but I was wondering if this is the best move. Have they violated any regulations by not sending me anything? Also, I moved several years ago so could their argument be that they can't find a new address?
Thanks

Hi Kenpo1970
Welcome to the forums.
Have you ever picked up the phone while the collection agency calls you? As per the fdcpa law, both the callers have to identify themselves and know if they are contacting the right person.
Ask your girlfriend to send a debt validation letter to the company so that she comes to know the details of this debt.

So far, I don't see any violation of the federal law because collectors have the rights to call a person concerning a debt. But if they have ended up calling a wrong person, then all collection efforts should come to a stop after notifying them.
I suggest you not to update your address until it has been proven that they are actually holding a legitimate debt relating with your girlfriend. Once they have given the necessary details, you should accordingly give the necessary details.
If you do not have the address of TrueLogic, call them and ask for their mailing address. Send all your correspondence through certified mail with return receipt requested. You will have proof of all your actions taken.

Thanks for your reply. Actually I am fairly confident that this is probably my debt. I just mention that since they call and leave virtually no information, even where they are calling from or who for, it is possible it could be my girlfriend's debt. It just baffles me that they obviously were able to get my number but that they don't identify themselves and that they haven't sent me anything regarding this debt. If it is the debt I think it is I would like to resolve it so I will send them the verification letter to confirm this and then go from there. I have dealt with collection agencies over the phone before and they can be quite threatening and abusive. I think it would be better to just get the information and then resolve it all via correspondence.

Keep a check on your credit report also because you will come to know about any company that hits your file. At the same time, watch your girlfriend's CR also. You will come to know the latest standing of each account.
Do you have the address to contact TrueLogic? If I can help you in anyway, just let me know.

I have the address to contact them. I will definitely take a look at my CR to see what's up because I believe this thing with Truelogic is probably the last thing I have to deal with before I have clean bill of health. I guess it just makes no sense to me why these colletion agencies try to be so clandestine with their collection attempts. Is almost as if they don't want the matter resolved. Anyway, thanks again.

I have one suggestion to offer you while you deal with this collection agency. You need to be sure whether they are actually holding your account and the debt validation process will prove it.
One more thing that requires attention at this point will be something in writing that after you have paid the said debt, your report will be updated with the bureaus as 'paid collection'. If your report is not updated by them, the future lenders will not get a true picture of this debt being paid. Also, it might happen that some other CA will force you to make payment. Get receipt of all your payments that you will be making this time. Do written correspondence because you will have proof of everything. Send it through certified mail with return receipt requested. I have written everything whatever came up in my mind.
