No collection agency appearing on credit report

Ok gang, I pulled all three credit reports for me and my husband and there is absolutly no collection agency's reporting. All of our credit cards are showing with the original creditor. In the inquires part, it is showing a report being pulled by Encore, United Legal Corporation, cbe group. These are the collection agencies that called and demanded payment and stated that they had the original account, funny thing is, they never validated the debt and only had excuses of why they don't validate. Thanks to this website, I know now what to watch for and how to handle the jerks that call and give their fancy lectures and stupid comments. United Legal went as far as to contact our mortgage company and ask them if we had an equity in our home so they could collect on a past due account. Thank goodness the mortgage company refused all information. Come on now, think about it, if we had equity in our home, don't they think we our have gotten the money and had our cards paid off? Now isn't it illegal for a ca to pull a credit report and just start collecting without prior knowledge of the creditor they are supposedly representing? And isn't it illegal for them to call your mortgage company and ask about equity in your home to payoff the balance owed? Isn't it amazing the tricks these ca's try to pull?

Third party collection agencies cannot start collection unless they are authorized to do so. Either original creditor assigns collection job to them or they buy the account form the original creditor. Moreover, the collection agency should provide all these documentations when it validates the debt.

It does not seem from your post that any of the above happened. Then how can they validate the debt they are intending to collect?

You have mentioned that your report is not showing any account under collection. However, you can contact your original creditors just to confirm if they have assigned the debt to any agency.

Meanwhile, if the collection agencies continue contacting you, inform them that you want to see something in writing. Send your request through certified mail with return receipt requested.

Their approach is not professional. Pulling your credit report, contacting mortgage company indicate they don't want to move legally. You can file your complaint with BBB, FTC or DA's Office.

Hi Mom of twins.

As you can now easily distinguish an illegitimate collection agency from the rest, you can expect that they will do all sorts of illegal activities hurting your credit file.

As per the fdcpa laws, creditors and CAs are restricted from pulling your file without genuine purpose. They don't need to have your permission but they need to have a legitimate reason for viewing your file.

It thus becomes very important for you to keep a check on your credit file. Any type of activity by an agency will immediately catch your attention. Therefore, you will have the rights to place their activities on dispute, if found suspicious.

Yes, the CAs use unfair methods to collect the money from the consumers. But we can be able to stop them from doing such illegal activities only when people know their legal consumer rights. Visit the attorney general office and get a copy of your consumer rights. It always helps when we are talk about our legal rights!
