I guess the first question would be why your company continues to operate illegally by lending into the United States when you are not licensed to do so.
Second would be why your company allows its' employees to call customers every 5-10 minutes at their workplace when they have been asked not to call them at work, but only at home.

LawStudent - trust me, you don't WANT to know. They're pretty nasty to deal with, aren't legal in our country, and aren't even LOCATED in our country. And they don't follow the laws of their OWN country, either.

Truth is most people who work in the collection industry are flakes themselves. They are not necessarily "bad" people. The collection industry takes a certain type. Not "cruel," "mean," "uncaring" etc. They are people who can do the job and be thick skinned about it.
I spent many years in the collection industry, banking, commercial credit etc. While my time in the 3rd party collection business changed me, It also made me smarter about credit in general.
As for the questions..let me give it a whack OK?

Prove it. Some of these companies are buried under so many other corporate entitites you'd go bankrupt paying an attorney to research it. But what is the point? You either owe them money or you don't.

You are incorrectly assuming that either these people or the original creditor of your collection account actually care about you. 3rd party collection agencies are bound by FTC practices, but in America, the original creditor can threaten to break your legs when they call you at 2AM. They are NOT restricted from enforcing their right to collect money by the FTC.

Define harrassment. Remember if they are an Original Creditor, the FTC rules go out the window.

See above. Note that I don;t know who these people actually are, yo might know more than me but if they are an original creditor, then review the above.

There is no law that I am aware of that restricts the number of names a business can have. I have a business (a recording studio). I can call it whatever I want and change the name as often as I please - it's my business. Get it?

Becsuse if they were to use their real names, you for sure would never be able to pronouce them. What difference does it make what a person calls themself?

Um, yes, fdcpa doesn't apply to original creditors, but state's have very similar laws that the original creditor must follow. If the OG calls you at 2am and threatens to break your legs, they are breaking laws in every single US state.

Thanks, goudah! I do believe that it's ILLEGAL to call someone at 2:00am and threaten to break someone's legs. :shock: Is Orville overseas by chance? And, gee, I'm so glad Orville can change his business name any time he choses to. I'm sure there is a reason for that!

Yes, if an original creditor calls at 2 am and makes threats, in some states it would be a criminal act and a violation of many states' deceptive trade practices acts. Harrassment? It depends on how the victim feels... Does he/she feel terrorized? etc. In some cases civil law is much stronger than criminal. We can shut down a collector for breaking the law rather easily. Yet if a woman has some psycho boyfriend/exhusband with no-contact orders issued, the cops will say "there's nothing we can do" if he shows up, until she's harmed or murdered. I've been helping a friend with this recently.
