My emlpoyer got a voluntary wage assignment from Sonic Payday with a digital signature which they are honoring, I tried to tell them I did not authorize or sign anything but she is saying the only way to release the assignment is to receive something from Sonic Payday. Is there anything I can do?

Read the page given below and know the legal procedure of wage assignment. Since you have not signed the wage assignment letter, you have the legal rights to revoke it. Send a letter of revocation to the agency and inform your payroll department about the actions taken from your side. This is termed as 'Notice of Defense' and it should be sent through certified mail. Your wages will not be deducted towards the lending company after they have received your letter.

I spoke with Jinky at Sonic Payday and she will not give me physical address. Said that I could only fax information to 888-395-0192. She would not send me a copy of the wage assignment that I "signed" either. I got my payroll department to send me a copy and this letter was not even on the loan agreement they basically type this up and typed my signature and ssn#. The letter has declaration of wage assignment and is dated 12/13/05 I have talked to them since November. When I spoke with them then they said that they were sending me to collections. These people are illegal as crap can anything be done to stop them from doing this to someone else?

Welcome back.

You must consult a trained counselor or a lawyer in this matter. Show your copy of loan agreement to him.

You must also report these illegal activities of Sonic to the local attorney general's office. File your complaints at the FTC and the BBB website. I hope the lawyer will be able take care of this matter properly.

Sonic Payday is one of the toughest companies to deal with that regularly threatens the consumers with wage assignments. Although most of time, they have not been able to take any legal actions. Do not tense yourself. Show your stronger side and always dispute with what is sent to you. If necessary, file a police complaint against them so that you have an affidavit. Hi SSW,

Sonic is one of the lenders on my debt consolidation program. I contacted my payroll department at work today to revoke any wage assignment from them or any other creditor. I found very useful information on this website regarding the same situation. I also sent them a certified letter revoking any voluntary wage assignment with them. This way I'll have the proof to back myself up. :D

I'm just upset because I was going to pay them off as soon as I got my tax returns and then they pull this stunt. I'm just going to let them take it out of my check because I don't want to send them money and they continue to garnish my wages also. I don't trust them for one sec.

Is there anything that can be done to stop the wage assignment before it is processed by my payroll department. I haven't received any written or verbal communications from Sonic regarding the potential wage assignment. CRD

Many people are complaining about Sonic and their illegal wage assignment procedures. Get in touch with your payroll department and make them aware about the situation that Sonic can create for you. You might have signed for a voluntary wage assignment with the company but it should be presented to you after covering the legal points mentioned in the thread below:

After Sonic has sent you the papers for wage assignment, simply revoke it and write a 'notice of defense' to your payroll dept. Send all your correspondences in writing and document it in a file. Later, you can contact Sonic and try to arrange a payment plan with them.

Sonic will try to get the defaulted amount through your employer. If your payroll dept. has experienced similar situations in the past, they will tackle it nicely keeping your interests protected. If they have never dealt with this situation, keep in touch with them so that you are able to make the necessary arrangements.


annmarie0205, you are mixing wage assignment with wage garnishment. In a wage garnishment, the court will send notice 20 days in advance before you are asked to appear at the court. You will present your defense at that time with all the proofs before judge finally decides anything.

oh..ok.. It just hit me like a ton of bricks. I remember appling to a payday loan company and it did say if you default on your loan, they had the right to call your employer to get the money back...I didn't like the sounds of that and decided against taking the money from them. Thank you for the clarification.

Basically all you need to say is that as of such and such a date you do not authorize wage assignments. Also, state that you revoke your digital signature authorizing them to use a wage assignment. Also make sure you send a letter to your payroll dept stating that you do not authorize voluntary deductions.

The Department "head" said that they need to receive the paperwork from the Loan company first, before they can determine if my letter of revocation, or letter "not authorizing..." iwll work.

Is this true?
I know it is a tired question for some of you, Thank you in advance :)

In conclusion,

I should be able to legally refuse any "authorized wage assignment" by a letter to my HR department, is that correct?

As I rote before, the comapny in questions will not give me a fax number, since they have multiple offices, I have no idea if any of them are appropriate, or will accept it.

I have offered to pay these people, in full, November 3rd - they won't accept it for some reason...go figure

Contract language -
it states...
You authorize us to effect this payment by ACH debit entries, you may revoke this authorization up to 3 days in advance. If you revoke the authorization, you authorize us to prepare and submit a check to your bank.


So, does this mean my letter of revocation is no good?

Please Help,
Are you dealing with a payday loan, if so who is the company.
If you signed a wage assignment all you have to do is send a certified letter with return receipt saying you revoke the wage assignmnet you signed on (DATE)
Depending on the type of company you are dealing with and if they are illegal or not, they may take further legal action.
Make sure you send it certified mail so you have proof it was received.
