That is so not true. Nobody ever went to jail for having a little debt. They say they will come to your workplace and arrest you just to scare you into paying the money whether you have it readily available or not.
Look all over this forum, almost everyone here has had that exact same threat thrown at them and they're not in jail. I used to collect, now, don't write any checks you can't cover just because you are scared. When you have enough to make a payment, do so with a money order. You can't trust people like this with your bank account numbers!

Payday loans are NOT check fraud and they don't have any affidavits. They're lying, plain and simple. Don't be suckered by it, do what everyone else in this forum is doing. Pay no mind to them, pay your debts as you can without taking food out of your stomach, and turn to consolidator. As for the harassing bs phone calls, turn them over to the Attorney General of their state. The only ones breaking any laws in this case are them.

I have even been told they are discussing me with the District Attorney. The are full of it and everything they are saying to you is illegal. Like Jedi said, people all over this forum have had the same threats. What number are these people calling you from? Did they tell you what loan company they are collecting for?

If you find them out to be a collection agency, send a cease and desist letter and stop them from calling you again. The collectors will have to abide by the federal laws.

US National Bank huh...that's a new one. I had an account with Platinum B and their collection agency also threatened me with arrest but it wasn't US National Bank. Call Platinum B at 1-866-722-2770 and if nobody answeres hit 0 and that should get you to somebody. Tell them you need to know what collection agency is dealing with your account. They will probably give you the name and number to a place called I-Collect (this is what they gave me). Make sure they tell you when your account was sent over. When you call I-Collect they will be able to verify who has your account.
Was there a number that showed up when this US National Bank called or did they give you a number to call them back on. If not try to get a number out of them next time they call.

You can not be arrested. It's the PDL's way of parting you with your money. By threatening arrest they hope that you do something irational and send
them money you do not have.

And above all,keep your wits about you! By them threatening you,you can now use that to your advantage!

Look at it this way. The person that is calling you with these threats probably has,maybe at most,a high school education,probably less. He/she is making 7.00-$10.00 an hr.They are under huge ammounts of pressure to get the money back from each borrower,or they are gone! The kicker is...most likely that person is also in a PDL cycle!
So what they do to get there measley $300.00 is "desperate intimidation!"
If you really think about it,it will cost them far more to bring you to court,send a "lawyer" to your house or job,or any other lame threat, for the $330.00 owed.
Get in touch with them. Set up a payment arrangement. Pay them on your terms!

This is way out of hand.
They will tell you anything just to get you to pay them their money. First of all there is no such thing as a debtors prison in America. It is not an arrestable offense to break a civil contract. The Pay Day Loan operations are barely legal themselves. I have never heard of anyone getting charged with check fraud for closing a bank account. You cannot go to jail for a civil suit, if anything the worst thing you have done is broken their contract. You have not broken any laws. In most states writing hot checks is a $50 fine for first offense.
I would go to radio shack and get a $10.00 phone call recorder and a tape recorder and tell them next time they call that you are recording the conversation and if they do not like it to hang up. From there ask them point blank if you have broken any laws and if so what laws specifically did you break. Ask them which DA they filed charges with etc. etc.. Just call them on thier bluff, because they are bluffing you. I have been told the same thing before also. Nothing has ever happened. The worst case scenario is a garnishment from your paycheck. If you go to an attorney you are just going to be out more money to an attorney.
Good luck, there are much better alternatives to bankruptcy. I would never ever file bankruptcy as it is the worse thing you can ever do to your credit.
