I've got 8 payday loans and want to consolidate them. 1 company is calling my work, can I stop them from calling? I don't know where to begin. My bank isn't allowing them to withdraw today, but what about tomorrow? I'm scared at home and I'm scared at work. Any advice?

Which company is calling you? Send them a cease and desist letter but there is no surety that they will stop calling you. I will handle the situation by calling the company and explain the factors because of which the payments are getting delayed. They might understand your point and offer you extensions. You won't get the repeated the phone calls if you keep yourself in front of them.

Welcome to the forums :D Are these store front or internet loans? Find out if they are operating legally in your state,many internet ones are not. Since you are registered,someone will contact you about your options,such as consolidation,settlement,etc. If you have any questions,feel free to ask. Also,send them a cease and desist that they only contact you by mail,if you want,and also,state they are not to contact you at work,that you are not allowed phone calls.Good Luck...KAren

Collections Manager:

This letter is regarding the account referenced above, which you claim I owe. This is a notice that your claim is disputed. I am requesting validation, made pursuant to the Fair Debt Collection Practices Act Section 809 [15 USC 1692g]. Please note that I am requesting "validation"; that is competent evidence bearing my signature, showing that I have some contractual obligation to pay you.

Please also be aware that any negative mark found on my credit reports from your company or any company that you represent for a debt that I don't owe is a violation of the Fair Credit Reporting Act; therefore if you cannot validate the debt, you must request that all credit reporting agencies delete the entry.

Pending the outcome of my investigation of any evidence that you submit, you are instructed to take no action that could be detrimental to any of my credit reports.
If you do not own this debt, you must remove the derogatory marks from my credit report per the Fair Credit Reporting Act.

This letter is also a formal request, citing Section 805 [15 USC 1692c] of the Fair Debt Collection Practices Act, to cease any further communication with me unless it is:
(1) to advise that your collection efforts have been terminated;
(2) to notify me of any specified remedies
(3) to notify me that you have invoked a specified remedy

Please note that any failure on your behalf to comply with the laws of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act will result in legal action.

Best Regards,

thanks for the help. If a pdl's name is not on my states (WI) Dept. of Financial Institutions, does that mean its not legal for it to do business in my state? Can I use that argument with them to settle? Globel Finance is calling me on behalf of Cashnet 500, so far I haven't spoke to them.

not sure how to find out what the pdls can and cant do in WI. Wi has no caps for pdls. Does that mean they can keep charging me interest. How do I settle with them?

Make your defense strong if the payday loan company is not licensed in your state. Verify this info with your state Dept. of Finance. The list of licensed companies in WI is here http://www.wdfi.org/fi/lfs/licensee_lists/

If you are planning some legal things on this, take the advice of an attorney who deals with fdcpa and FCRA laws. He will be a better help.

Katranel, One Click Cash is affiliated with Rio Resources and they will not stop. I would try to see about closing bank account and getting another one or they will drain you. Good Luck Kyside38
