I have loans with Pay Day Ok, Pay Day Select and Rio Resources. I owe approx. 1300 but I have paid hundreds in fees. I live in Tennesee. I'm behind on the rest of my bills b/c of them. Someone please give me advise to pay them off?


kstrayhron28, welcome to the boards and boy am I glad to here you are from TN. I am sorry you are caught up in this mess. First off you need to close your bank account and open a new one and DON'T give out your new account information. You might have to get your phone # changed as they will start to harass you, first off their threats are empty so do not let them intimidate you. You can pay them back with money orders as that is what I am doing. I am currently dealin with Payday ok myself and here is the address I am sending money orders to

Do you have copies of the agreements you signed with each of these companies. The reason I ask is I am trying to rally tennesseans to file complaints , will you please check this thread out I started in regards to Tennessee PDl and my quest

I am having the same problem with payday loans that just keep taking out more and more money but never seem to get paid off.I was told to close my checking account and open a new one but then I was told that they would just start taking it out of my new account,that they find the account by your social security number.What is the truth here? My husbands paycheck is direct deposit so I cant close the account to ach transfers.

shownaspeck welcome to the boards, are you in TN also? neverless, once you open a new account NO ONE can debit that account without you all's permission. as for direct deposit, just have your husband fill out a new DD form with the new acct information at his employer, again welcome and keep postng as mnay can offer great advice here

Not sure where your hubby heard that, but it is impossible. They cannot find your bank info that way. Not to mention if there was a procedure, if they started to debit from it without your authorization, they would be breaking many federal laws.

My thoughts - get out as much as possible, leaving pennies it in to keep it open. Go and setup a new bank account. Then have your husband update his DD info. The moment it starts going to the new account, close the old one.

I already called our bank and hubby and I are going to close our account on Monday and change his direct deposit. This site has been so very awesome-I was extremely stressed until I found this and now feel we can get out of this hell

i just got into this mees, i'm dealing with 4 places i don't know if i'm going to jail behing this or that it will go on my credit report i don't have the money to pay it back at least not right now anyways,it's only been a moth so far what am i going to do?

I logged onto Payday OK's website and copied my loan transaction history that showed exactly how much I had paid in fees and towards the principal. I pasted this into an email along with my state's payday loan laws and told them that I wanted my acct. marked "paid in full", or I was going to file complaints with the BBB, Attorney General, etc.

I got an email back saying that they have been informed that I no longer wish to do business with them, and they consider my account paid in full. It is worth a try. A few people on here have had success with getting Payday OK to mark their accts. as paid in full if they've overpaid according to their state laws.

I modified the letters you sent me and emailed them to the pdls I am dealing with. Except, Arrowhead Investment, I cant find an email address on them.
I sent the emails LATE last night and have already recieved a response from CashDoctors accepting my terms for settling this nightmare.

Hello! I have been reading and reading on this website over the last several days... if nothing else, it's good to know others out there are dealing with some of the same issues I am... I have online payday loans with checkcity.com & usacashservices.com that never seem to go away... and then to make matters worse, my own bank has a checking acct advance option that I have been using every 2 weeks to pay the payday loans and bills. What a horror. I have opened a new checking account with another bank, & have submitted w/my employer to change my direct deposit to the new account. One of these pay day loan co's even debited my acct one day early (oversight on my part) and caused me a small fortune in nsf charges. They are ruthless, & I don't know what else to do.

They call my and my wife.telling her they are nicd fraud check division,tell i will have to go to court if i don't pay back the money or a warrenty will go out for me and go to jail. Is this true. And i have 5 payday loans,with a total of 1548.50 and i live in houston tx. Thanks guys

No that is not true. That is just a scare tactic. A post dated check in not considered a Hot Check in the state of Texas. I would file a complaint with the State AG and make sure the PDL knows you have done that. They are in violation of Federal law with threatening you with criminal prosecution in order to collect on debt. If this is an internet PDL, chances are they are not even licensed in Texas (very few are) and would have no recourse. Make sure you change your bank account and revoke any voluntary wage assignments or ACH authorizations. Texas has a maximum liability of $10.00 + 48% maximum apr, so you are not liable for any more than that. If you have been paying the renewal fee, chances are you have already paid them for more than you are liable for. There is a template letter on this site you can send them to demand that your account be paid in full.

i'm in the same mess with 4 payday loans 2 on the internet and 2 20 minutes from where i live .i did change my phone # and put a stop payment on 3 of them .how do you truley get out of a mess like this when the money isn't there?

You will definately need to work out a payment arranement with the storefronts. They are licensed and will take people to court. It will be hard to face them, but you will eventually need to deal with the storefronts. Which state are you in, which internet pdls are you dealing with, and how long have you been paying on them? It is possible if you have been "rolling" these over for quite some time you have already paid back the principal and legal interest rate for your state.

You need to be careful when blocking debits from these internet pdls. They go by many different dbas and if you block only the dba you know them by, they will go in under another dba and take the money out. My credit union actually felt better about closing my account and opening a new one because of this. And stopping the withdrawal has to be renewed every six months.

Do you have to close your account and open with an entirely different bank or can you stay with the same bank? I've been with my bank for over six years and really don't want to switch if I don't have to.

Welcome Guest, You can stay with the same bank but under a new account. These companies are hard to block because they can pull the paper check routine. They will issue a check saying check number 1 or something and bleed you dry this way. Also file a complaint with your state AG office. Best Wishes KYSIDE38

I had a payday loan with Purpose Money which is new to state of Texas. The intrest and roll over fees got too much so i let it return in which I made arrangements on the balance$804.00. They claim they could only do 3 installments which was too much per pahcheck. I paid them 205.00 the 1st installment and then and has a hard time coming up with the second installemnt. They are now claiming that they will take mw to jail if I do not pay them the other 604 in one installemnt. Can they take you to jail ot come and harrass you on the job if the 604.00 is not paid . I

Is this a storefront pdl or internet pdl? And are they licensed in your state? TX has a sticky law when it comes to collecting on pdls, they can press charges against you if you default due to stop payment on a check or closed account and you default on the arrangement to payback the loan. You may want to clarify that with your AGs office, I'm not sure how it would apply to an unlicensed internet pdl, I would think it wouldn't since they are violating the law.

Monique You will have to set up an arrangement that you can afford. Please register and have a debt counselor call you . They are tarined proffesionals with good sound LEGAL advice. It never hurts to be informed and there are companies that work consolidating payday loans. Bes Wishes KYSIDE38
