Can I make Cash Transfer Center pymts

I have a PDL with Cash Transfer centers and I live in NC. They are demanding pymt in full and I am unable to pay in full but I am willing to do arrange I was told if I donot pay in full on 11/13/06 they will contact my employer what do I do. Are they legal b/c NC has banned Payday loans. Please Help Kia


How much did you have the loan from Cash Transfer Centers? And how much have you paid this far?

Payday loans are illegal in NC and CTC is into many illegal activities. Their threats on you to pay the full amount also don't sound legal. You need to review your bank statement and find out how much has been paid. Since payday loans are illegal in NC, you are supposed to pay only the principal amount. Because, your state doesn't specify the interest charges and fees, you must put your complaints to the AG for investigating on this company.

Kia - The first thing you want to do is type up a letter to Cash Transfer Centers revoking your Voluntary Wage Assignment and also revoking your authorization for CTC/Northway Financial to make ACH debits to your checking account. Fax it to the following and then send the signed letter via certified mail/return receipt requested so you have proof of delivery:

Next, type a letter (Letter of Defense) to your payroll dept. and tell them that you have revoked your Voluntary Wage Assignment to Cash Transfer Centers, so any presentation made by them for garnishment should not be honored.

They are not licensed in any states and operate out of two locations in Canada (Vancouver, BC & Winnipeg), and their "parent company" Northway Financial is supposedly in Malta. Cash Transfer Centers always list a PO Box address located in Pennsylvania, but this is just a means of routing their mail to Canada.

They are notorious for making illegal threats and engaging in illegal practices. At the moment, they are wasting no time in mailing letters with a Declaration of Wage Assignment to the payroll depts. of customers who have defaulted on their loans. They inform your employer that you have taken a loan with them and have not paid it back according to the loan terms. They ask for full payment of the loan and the fees due to be deducted from your next paycheck and mailed to them. The copy of the Wage Assignment that the customers have supposedly authorized are not legal and most payroll depts. should know not to honor them, but I think some have dropped the ball and garnished the employee's wages.

After you've taken care of sending the letters, you may want to contact them and advise that you are again requesting some form of payment arrangements to satisfy your loan. If they are unwilling, send payments to them via money order until you have paid off the amount borrowed. Also, as mcranberra suggested, file complaints with the North Carolina Attorney General and the Dept. of Finance for your state. They will hopefully look into the matter.

I may be wrong, someone please tell me - will it be good to send the wage revocation letter before the loan gets paid in full. I know Sonic is into a lot of federal and state violations, but are we doing anything wrong by revoking it before the loan is paid in full. I knew this action to be taken only when the loan is paid in full and the company wants to make more money, illegally.

Thus, my question is should I revoke the wage assignment BEFORE or AFTER the loan gets paid? The loan company is accountable for their wrong activities. Aren't we inviting problems by revoking it before paying the debt?

Revoke it right away, send all letters revoking wage aggisnment, ACH's etc. Also in the letter tell them to stop calling work. Finally, it might not hurt for you to firmly offer a plan you can live with.

I did all of this and haven't had a problem since. They did attempt 3 wage assingments, all were rebuffed by my payroll dept. It is important to send your HR/payroll dept. a copy of the DATED letter you send.

p.s. as always, fax and email each letter several times a day until you get a response.

Kia, Contact the Attorney General as soon as you can. Payday loans are ILLEGAL!!!! in NC. The Attorney General wants these complaints because they are breaking the law plain and simple. Also please take Chargins advice and do the wage assignment revoke. Good Luck to You. KYSIDE38

I had a loan with Northway. I also live in NC. They sent my employer a letter and they honored the wage garnishment without notifying me. When I called payroll, the lady in charge of garnishments stated that they could garnish my wages without a court orfer and that I couldn't revoke until they received a letter that it was paid in full. Well, I went over her head and talked to head of payroll. He said that I could either have it deducted from my paycheck or handle the payment myself. He also said that he would be calling the company and letting them know that they would no longer be honoring volunteer wage assignments. That was scary knowing that anyone can just send a copy of an agreement with a digital signature and get your money.
