Can Asset Acceptance take my home?
Date: Fri, 11/10/2006 - 14:47
They're taking me to Court.
Because of the illness I was diagnosed with-(that's how I got behind on the payments), I'm unable to work.
I don't own anything other then my 21 year old mobile home.. Can they take it from me?
Thank you for any information.

Asset Acceptance is famous for presenting the consumers accounts in the wrong way. Most of the information provided is disputed because they add illegal charges and fees on it.
Have you received the debt validation from them? You have to get the debt in writing so that you review it and then make your payment arrangements. If the debt is not sold off, try to work out something with Citibank if that helps.
Thanks
Thank you for replying. I've already been to the first Court session, where I admitted owing the money.... I offered to make payments on the debt, but they wouldn't accept the amount I could pay. I signed a paper saying that I did indeed owe the money, so I'm assuming that they will take me to Court once again..... The only thing I'm worried about is them being able to take my home away....Can they do that?? It's not worth much really.... I don't own a car, am not employed, (due to illness), etc. The house is about all I have!
Thanks.

When the case is argued in front of the judge, he is supposed to make the final decisions. Before he orders anything against you, your financial situation will be evaluated and you will be asked how you can afford to pay the debt. Tell them that you proposed your payment plan to the CA but they were not willing to work with you. Let the judge understand how much you can afford every month. The CA has to follow the court orders. Since you are unemployed, a garnishment isn't possible now. Explain the judge that your home is the only asset you have. He will be careful on making his decisions.

Thank you..... If I could turn back time, I sure would be more careful! Life tends to change in the blink of a moment sometimes!

Don't let the collector get a case against you. If they win the case at the court, they will try to take the property that isn't exempted. They will try to garnish wages if you are employed or sometimes your bank account.
Your payment plan not accepted by the collector is your strong defense. Convince the judge keeping this point focused.

Nova- check with the court or court clerks office to see if you can file a hardship before you go to court. In many states you can file hardship papers, but they have to be done before your court appearance. Take Care...Karen
