Anyone ever heard of Westbury Ventures?

Sharon Williams, Account Manager/Reconciliation Consultant, Westbury Ventures sent me an ugly email yesterday. I have asked for a statement of my account and needless to say haven't heard from her. I quickly informed her that payday loans are illegal in the State of NC.


I have filled out a complaint and I am sending it today! It is a $300 loan taken in September 2006 and now they say I owe $480!!!!!! I don't think so.

Westbury has several PDL Companies. DSM, MY1, E Payday, and Appolo Funding come to mind. There might be more. Any of these sound familiar?

This is what she told me regarding my request for activity in my account. "This can be done with your banking institution. Thanks." JERKS

Of course she wants you to contact her by telephone. She does not want your communications to be documented (as they are using illegal tactics) I would respond that you insist all communications be in writing ,as is your right under the Fair Debt Collection Practices Act, and that you are forwarding all matters in regards to this alleged debt to your State Attorney Generals Office.
Also, have you changed your bank account?

She emailed me back and told me that there was nothing the AG office could do... I forward her all the law! This is actually turning into a really interesting battle! I refuse to call her.. no way... if she wants to communicate with me.. she can email. They had no problem giving me money and taking my money via: internet!

Because I have dealt with Westbury many many times. Fortunately, I don't have to anymore because "You know who" got my account with DMS (a Westbury PDL)marked Paid in full. Now I know this will be difficult, but try and restrain yourself from hijacking yet another thread with an anti-Langhorne rant. Let's stay on topic which is supporting Dixie in her dealings with Westbury.

I received the same email. I had a long over 4 years ago in Louisiana and apparently when I moved and changed banks I did not finish paying. I requested copies of my bank statements and added up I paid over $810 for it over a period of time. I have also asked for a breakdown and have received nothing. I receive at least 4 emails a day and can't get any information about the company to even see if they are legit to make a payment arrangement. Any suggestions?

I live in NC also and I spoke with someone on Friday about this same company. I am filing a complaint with the AG's office today. I got an email from John Hernandez, and I explained to him I had already paid more that my share and would not be paying another dime. It seems like they read from the same book. I told him that I would be contacting the AG's office. His reponse was "the AG's office did not take out the loan" Okay but the AG's office will be contacting him this week, since I provided them with a copy of all correspondence with this company

Most PDL places try to scare client's into paying by threatening to turn them over to the local prosecuting atty.in order to collect on the post dated check you gave them. HOWEVER,in the state of Missouri I know they do not have this recourse,(and there may be other state''s as well)because the way the law read's is that a NSF check is that you knowingly and willingly wrote the check knowing that it would not clear the bank,therefor defrauding them of their money.A post dated check to a PDL place is not covered by this law because THEY,the PDL placee knew that the check was no good when you wrote it.Therefor they can't cry foul.All they can do is harrass you until you tell them you are filing a complaint for harrassment and they cease and desist.')

bdouble... Apparently this is a common response.. I know the state of NC and the AG office didn't take out the loan! Here is her reply "Do what you have to but please provide the information requested to resolve this matter. Also, before you waste your time getting other parties involved you need to make sure you don't owe us funds. We are sure you owe a debt to this company and the state of North Carolina didn't loan you this money; we did. You jumped online and applied for this loan. Thanks."

she is still bugging me... so to prove my point I gaver her the break down, with the account number from SJM, since she couldn't do the same for me. However, I will not give her copies of my bankstatement... that is none of her business! What do you think?

Dixie, I would not let her bug me. Let the AG handle it. I always responded to them to call the AG office. That stops them dead in their tracks. You have got NC law on your side. KYSIDE38

Dixie, I just thought about something. Since this is SJM call the vice president Josh Mitchem. Look at the threads his number is there somewhere. Either under SJM or Platinum B he was on the forums for a while. Call him and tell him you've overpaid. KYSIDE38
