i just received a summons with LVNV as the plaintif.this is about a sears account i had been paying off to NAFS until they stopped sending my monthly statement.is it too late to request a DV?should i go ahead and file a response and then try to work out a payment arrangement? i cant afford a lawyer.i could sure use some good advice.

Paralegal here. I can't give legal advice, but I can point you in a direction. Couple of questions: How much is the debt? Is this a small claims matter? Do you have any records of your payments to NAFS? When is the court date?

the debt amount is 1250 dollars.the only records i have of payments to NAFS are money order stubs.no court date has been set to my knowledge.

i work there and your account must have been with the pre legal dept. we only have the account for so long thn they go to the attys office for suit sorry but unless you work something out with them there is nothing that can be done because the balance is still oweing
