My father passed away in Oct. He had purchased a 2002 blazer and a new motorcyle for me. Unfortunately, they were not paid off. His widow decided not to pay them off. The bank served me a summons to court and charged that I did not fullfill my obligation to repay the loans. I never signed any loan papers. My father signed them. I was not a cosigner---the only connection is that there was a transfer on death title for the blazer. The bank says I am responsible for the amount that they do not receive from the sell and that I must sign a paper verifying that they can sell the vehicles. I have spent hundreds of dollars in attorney fees and he has not served any useful purpose. I am sure they can apply for a repossed title and I have never signed any financial aggreement with the bank, I should not be harassed. The vehciles were returned to the bank. Is there a reason why they would not just apply for a reposed title? Would that be judgement against his estate? I am not understanding why my attorney would even consider having me sign something that leads anyone to believe that I am at fault. They have threatened my credit history and since I am only 22, that is something that I do not want to even think should happen. Do you think I need a different attorney?
