hi--ditto on a lot of things:
my status: separated mom with 5 kids (husband sold house and me and kids had to move) meanwhile before separation husband through out bills --allegely judgement filed 1/98 against me. an attorney made contact with me in 2003 (1)by letter and once in 8/06 -left message with kids --didn't get it. Had no other communications until 12/06,before Christmas, froze my account with $955. needless to say had no Christmas. I called attorney to settle with what they took and refuses to listen or settle. I then called Rcs Corp. for further info--found out today that LVNV funding is the actual debt holder and she gave me the account #. I had no paperwork nor absolutely no money other than what they froze. how can they take my money without sending me any paperwork and why did they wait til now when a judgement was filed in 1/98. It appears they sat on their butts as much as I did. I did make one payment but can't find receipt and now they added on over $1000 for whatever. how can I get them to settle??


Well, magoose, you've taken an important step by registering on here as a member. Registering will put you in contact with a debt counselor who can give you some good advice as to what your next step should be. They will contact you by phone and it is free.

Some advice from me----sounds like you need a system to keep track of phone messages, receipts, etc. I know with kids it can get kind of crazy. Make your kids part of your system for taking messages and keeping important papers, etc. Have a certain box or file that is just for things like messages, permission slips, receipts, etc. That way you and the kids will always know where something important goes and where it is. Check with the local county where this judgment was filed. You need to know if it's been renewed or not. The clerk will give you details of the company whom you need to pay. Judgments stay in the credit report for seven years. After you have all the info, call the actual company and propose your settlement in writing.

Welcome to the Community :D I'm not sure if they will settle if there is already a judgement in place. If LVNV has it, try to do communications by certified letters, they aren't too nice on the phone to deal with, I know, because I am. They probably have been adding interest all this time. LVNV told me they were adding over a hundred a month for interest!! Try to talk with someone to see what they are willing to do for payments toward the judgement, if that doesn't work, try writing. If you don't make payments on a judgement, they can come back, file again that you haven't been making payments, if I am not mistaken. Keep us posted on what happens, and good luck..KAren
