credit card lien on property

Three years ago I received a judgment on a credit card debt, most recently I found out that a lien had been placed on my property (land), how in the world could something like this be legal? also, what can I do to clear this and is there a statute of limitations? This is in Florida. Thank you..


Florida has a homestead exemption in the state's constitution. If a debtor owns real property in Florida and that real property is the debtor's principal residence, it is immune from the claims of creditors.

If your property (land) is not your primary residence, the credit card company had a legal right to place a lien against it when they received the judgment for your debt. In a lot of cases, the lien will remain until you pay off the debt. I would check with a credit counseling company or an attorney to discuss your situation and see if anything can be done, and to discuss the statute of limitations in Florida. Evidently, liens remain on a credit report for 7 years after the release date.

my paycheck. if they can is it just better to just file bankruptcy.
