Just when I started thinking that CTC is been unusually silent this month, here they come with a bang!!
I was assuming that the legal authorities have started investigating on them. Irish, you were lucky that your HR director contacted you before he would have sent money. Did you write a letter to revoke their wage authorization?

Actually I sent one to ctc, that they ignored, but my HR director said she gets things like this all the time and always ask before doing any thing. Also - they won't garnish here without a valid court order.

CTC more often tries for a wage assignment rather than garnishment. They know it very well that court orders is necessary before garnishing anyone's wages. If they have already ignored the previous letter, send one more letter, this time through certified mail and return receipt requested. You'll have proof of the date when your letter was received by them. Send a copy to your payroll also.

I am calling my bk attorney. He will handle it for me. My company does nothing without a signature, and they only count hand written and matching what is in payroll as a signature. I am also going to e-mail these fools - I have been telling them for 2 months that they will not get anything from me. I knew that it got awfully quiet!

Pay off the outstanding balance. This way you'll remain safe and you can't be sued if they take you to the court. However, there is least possibility of taking you to the court because they have violated the laws so many times.

I also am filing bk but these people keep harassing me. My HR/manager is great about handling these people and won't give them a red cent. I hope more people read this forum and stay away from pdl/ipdl. They are trouble.

With the help of God, I am going to pay off my attorney this week and I will be filing soon, so this matter will be taken care of. Then I will never again do this to myself or my family! These ipdls/pdls are the arm pit of the universe!

irish,
That is an interesting way to put it, but true in fact. It seems they are getting pushier about getting their money back. I would let your attorney handle them. It's what you hired him for since you are filing bk.

I've never heard of a Demand letter, did your HR lady let you read it. If it's not court ordered then how is she able to follow through with it, especially if you revoked any wage assignment. If that's the case, I should go to my brothers job and demand his Payroll dept. to give me his check because he didn't hand over his half of the rent. It just doesn't make sense to me.

You are right Pink Lady - this is nonsense! That is why my hr person called me and I in turn called my attorney. He said "show me a judgement". I also re -emailed the c/d letter and wage revocation. They sent me am e-mail back wanting me to negotiate! I had an attachment on the e-mail regarding my attorney's info and to call them.

My mother works in HR for a company in Illinois so I asked her if she has ever seen a Demand letter. She said that is what a company gets before a garnish is supposed to happen. If the employee agreed to it and the HR department has something with the employee's signature then it doesn't have to be court orderd. She also said prior to receving the demand letter the employer and employee should have received a letter of intent that gives them 20 days. Also the employee has to be so far behind on the payments before the garnish is honored, also there are rules on how much can be taken from each paycheck. So I would ask your employer if they have something in writing showing that you agreed to this since it was not court ordered.

thanks pinklady i would not have even known that they had sent the demand if i had notread the thread before s o i just call to see if they had sent a letter for me she said yes, as your mom what i shoul d do i have gotten nothing i have not areed to any thing can this lady in hr just let them take the money and can all the payday loans do this, if so what about the ones that has ben null invoid they may try this too. so i need to know what to do short of filing bk i will do that next.

Ask your HR person if this was the only thing that she has received from this company. Ask her where the letter of intent was prior to receiving this demand letter. Tell her you need for her to explain how all this is legally possible without you knowing about anything.

Pink Lady - in my case they just threatened to go to the next step. No letter, no e-mail , no phone call. I explained that I was in the first stages of filing for bk, as my attorney instructed me to do and I gave them the number he gave me for my creditors (both in writing and over the phone) but they choose to ignore everything. My C/D letter, my wage revocation etc.
CTC
You know i was once garnished $683.00 by Sonic Payday loans. I had been a customer for 7 months, i missed once finance fee payment and they started calling threating, it wasnt even a month into it that they garnished the entire amount without letting me know first or allowing me to do something about it. This was after setting some payment arrangment date to repay my loan. Anyway, my HR manager never let me know, she just did it. When i received my paycheck i question her about the amount, she then from a file pulled out the request for garnishment....since i didnt know the laws back then i just let it go.

Laverne - first take a deep breath and try to relax. You can't think straight when you are upset. I know just how you feel I am so ashamed too! But that won't take care of the situation will it? Now first you have to tackle your HR dept. get a copy of the laws regarding pdls in Ill. and take them to your hr dept. Explain that you beleive that you are a victim of fraud and until you get things straightend out and they have a SIGNED contract from you they are to to please hold off on the wage assignment. Also - find out what the laws are for garnishment in your state and if you need a judgement before that can happen. I am sorry I don't know where to look for these laws, but maybe someone else here does.

Ok Laverne - that buys us a little time to get you some answers and maybe a solution. Just relax (I know that is hard to do) How does Ill. handle garnishments? Do you need to have a judgement? We need to find this out.

Refer your HR person to the last link. If she is still unwilling to cooperate & you did not SIGN (this is very important & why I asked you to double check your contract/agreement) a wage assignment agreement with these people; let me know.

Get a list made up for every pay day loan company you've dealt with; after that you can send each one of them a cease & desist letter. Time consuming? Yes; but much better than you being stressed out & the HR people having fun at your expense.

The federal law states, that once YOU revoke your voluntary wage assignment the company CAN NOT pursue it any further. You MUST be DEMANDING with this company and send your letter REPEATEDLY, MULTIPLE TIMES A DAY to this company. And your employer must also follow your revokation.

Steelers is absolutely right. Even though assignments are legal, it is YOUR RIGHT to revoke them. I don't know why your payroll person doesn't know this, these are quite common lately in companies of any size..It's not even usually PDLS that use them. It's usually rental centers, buy-here-pay-here car dealers, and high interest rate credit cards.
ALL that you need to do is come up with a letter that says as of this date you do not authorize any and all wage assignments. Make sure you include your account number. Also, you need to give a copy to your payroll dept. This is called a letter of defense. If your payroll doesn't understand the situation, then they need to be doing some serious research here. If you have any questions on the letters, feel free to pm me.

Finsfan, do you know of a site where she can print off this federal law and present it to her payroll department? I know it's out there somewhere, I just don't remember where.
