I informed Route66 that I did not believe that they could not email me in reference to my account and that if they actually cannot, then they can correspond with me through the mail, that I needed to make sure I have documentation of all communication between both parties, them and us. Heck, they can sure email me for a payment reminder!!! Several I have not heard from at all, so not sure what is going on with them, so we will see. Been in contact with my bank, so we are watching my account for tomorrow and if someone does try to take something out, we will need to get right down to the bank and get it reversed.
Also printed off the agreement that was sent to me..funny, in bold letters is this statement:

OK, here is what is happening so far. For Whistler Holding, refund was suppose to be sent out today.

Unfortunately this form letter is filled with misleading and incorrect information. The use of this form letter leads us to believe that there is not a specific complaint connected with the handling of your account. Please be reminded that the terms and conditions of the agreement you entered into with our company was presented to you at the time of your application and you were given a 48 hour window in which to cancel the agreement. In addition before each debit processed (within the guidelines of the agreement) you were given an account summary stating your options of fulfilling the agreement including instructions for repayment of the entire amount of the advance, in order not to incur additional fees. Since there is no mention of a specific problem with the way your account has been handled we must conclude your account was handled as agreed therefore your account will continue to be handled as agreed. Your persistence in this matter with us or any other agency that does not include an account of how your account was handled out of the guidelines of the signed agreement will merit the same response as the one you are now reading. If any debits return on your account they will be sent to collections for further action.

We would very much like to get this matter resolved as quickly and with as little problems and complications as possible. Per you reply, this is not nor has ever been a form letter, much like yours is. We are well aware of all that you will "try to do" to get more money from us, and it is not going to happen! You will notice all the bold and underlined information from previous letters.
If you will look at the account, you will see how much we have paid. Our loan was only for $200 and as you can see by how much we have paid, it is well over the amount of the loan. The state of North Carolina allows 36% per year on small loans. Also in the state of North Carolina, payday loans are prohibited. Now, that being said, yes I did borrow the money, debits have been taken out of my account for quite a while and as of my last payday, I have paid you company a total of $445.
What needs to be done to resolve this is to have the account marked paid in full, the debits stopped and a refund sent for over payment.We are not trying to be difficult, but we are not going to pay any more money on this. Our bank has been notified in reference to this matter and have a watch on our account for any debits from your company and it affiliates. As stated we have contacted the AG's office in reference to this and we are entitled to a refund. A refund would need to be sent in the form of a cashiers check to our physical address.
As stated, we would like the communication to be done in writing so that we have documentation as to what was agreed upon by both parties, (you and ourselves).
We are willing to review how you propose we settle this matter. We look forward to your email or letter in my mail box and thank you for your quick response.

In discussing this, I was informed that it did not matter where the lender was, the transaction took place in the state of NC, (meaning the deposit and withdrawals on my personal checking account), and that is against the law. At this time, I am asking that you please mark my account PAID IN FULL, due to the amount I have paid, which ismore than double and then some, of what I borrowed. I am also requesting a refund of $250 due to overpayment. Per the AG office, I have paid back the loan plus fees and since these types of loans are prohibited in the state of North Carolina interest cannot legally be charged, so I'm requesting at this time that my loans be marked paid in full, that no further collection activities will commence against me for this debt, that no derogatory remarks be left about this debt at any reporting agency, and that proof of this is sent to me in writing, along with the amount due for refund. We have had another one say they were deactivating our account and that was Electronic Payment Processing. That is 2 down and 4 to go. I have not heard back from Midland Marketing and Route66 keeps sending me payment reminders and I keep emailing them telling them that payment is not authorized, and United Cash Loans keeps telling me I am sending form letters when I even write a 3 or 4 sentence note and MagnumZ LLC, has not responded back to 2 of my emails yet. They did the first one with a form letter, but nothing since then. My emails to them are going to Dennis Best. REfund check should be here this week. Can't wait....that is one house payment!!!!
Also wanted to note that I did some checking and for those that are receiving calls from "Collection" agencies and they are threatening you with jail or whatever, it is against the law for them to do that. They cannot threaten you in anyway, shape, or form. If they do, make sure you get the name of the company, the name of the person you are talking to, and address or phone number or both of the campany, and report them. You do not have to take their abuse. It is against the law. Someone I know had gotten a job with one of those companies, but she did not know it was going to be that way and they kept telling her she was not aggressive enough and that they didn't care if they took the person's whole paycheck and they didn't have any money....they were there to collect money and not care about what some dumbass, dead beat, person had to eat of if they had power or anything" She only worked the job 3 days and quit. You do not have to take these people's abuse what so ever. Hang up on them and if nothing else, turn your ringer on your phone off and tell those that might call to leave a message and you will call them right back and the collectors, save the message for the police. No one deserves to be talked that way to or treated that way.

The problem is, how do I get their actual mailing addresses? I haven't been able to find most of them online. If I call, I don't want them pestering me about how much I owe and fighting them just to get an address.

Also, I just had SGQ Processing's legal department (I think) threaten to have me arrested and taken to Florida to get this all cleared up. Over $325. I could barely understand the woman who called first and then the man she transfered me to. I really think I had a call center in India! I literally kept asking them to repeat themselves so I could understand what they were saying.

urban, Welcome to the forums. Your first course of action should be to contact the Attorney General in your state. Payday Loans are PROHIBITED in your state. NC was one of the first states to start busting these people. Give them a call the consumer division they will talk to you. They are your best defense trust me these companies dont like to mess with them especially since they are already ILLEGAL there. KYSIDE38

I did email them back and basically told them the same things that I have told everyone else in emails. I was not afraid of them sending my account to collections, that I had paid $300 on a $200 loan, was not asking for a refund, just PIF and that they were not licensed in our state, etc and that was I was not afraid of any threats they may make, such as being arrested, or whatever. I told them that it would benefit both parties if they would mark the account PIF. I tried to call them, but could not get anyone to answer my call.

I had 8 payday loans when I came onto this site, I let all of them go to default, that is the only way they would deal with me with one set amount and stop debiting my account. I still have a negative balance on my checking that they deal with. But I went to another bank opened an account and pay my mortgage, electric, phone & etc. out of there. My bank that the payday loans debit kept telling me that they could not close the account until it went to a zero balance. I have to eat and pay my mortgage, have gas money to go to work, that is why I opened the other account and had my check direct deposited into it. I put funding into the other and will have it caught up here in about two weeks, but in the meantime they have returned everything to these lenders, probably 3 times each. I revoked the ACH and now that they are all in default, I am getting a little cooperation from them. Oh yeah and the best part, they tell me that I can borrow from them ever again. BooHoo! I am on the payday loan blacklist, like I care! Hang in there, it may take a few months but you will be ok!

I've checked into these companies, and they all appear to be licensed in Ohio. Your best bet is to either attempt to settle the debts with them or work out a payment arrangement. Storefront lenders are very quick to take you to court if you avoid their calls or don't make an effort to pay.
Have you tried making payment arrangements with them since you defaulted? Are they staying within the legal limits on the interest for the state of Ohio? ($10 per $100 plus 5% per month)

AS for the interest I am not sure. I have done these loans so many times that I can't even keep track of the contracts. yes I have tried with Advance America but to no avail, they wanted the payment in full and suggested that I go to another loan company to pay them off. I thought I would just have a cashiers check mailed to them via certified mail for a bit of the amount. what do you think?

If Advance America told you to go to another loan company and obtain another payday loan to pay them off, I would report them to your state's Attorney General, or the Department of Finance - whichever one governs payday lenders. Your state law shows that you are only allowed to have one payday loan out at a time, and for a payday lender to suggest you should take out another to pay them off is, at the least, unethical. They are suggesting you break the law. I don't know how much weight a complaint on that basis will carry, but it can't hurt.
Have you paid only renewal fees on these loans, or have you paid them off and then taken out another new loan each time? Your state does not allow rollovers.

We had to send them a payment by this past Friday and we were hoping that our refund would have been in earlier than it was so we could send them a MO, but ended up having to send a check and hoping they will send it though, (money for this payment is in bank...pdls made a check bounce), but anyway, before they got there (and am hoping they will send it through), we are still 2 payments behind. According to them, we do not qualify for "reduced" payments because of our income, of course that is gross! They are wanting $2500 before the 13th of March or foreclosure will start. Of course, we can't get a loan, our folks are retired and we already are paying back loans from where we borrowed from our 401K. I have no idea where we are going to bet the money. My husbands hours have been cut by almost 10 hours per week due to work being slow. He has been trying to get more hours at his second job, but no luck yet. With everything that is going on with the kids at school and everything, he says he does not want me to go get a second job because someone needs to be here for the kids, other wise they would not see either one of us. We are hoping that paychecks will be enough to send another payment in 2 weeks, plus pay our utilities, car gas, groceries and phone. Did get another bank account opened with another bank, but it does not have overdraft protection, in case something happens, so we have to be real careful. We just figured for right now that if we have a totally different bank for checking that it would be a little harder to get anything from an account. We are thinking about once things get straightened out, that we might open a savings account at the bank we are going to close the account out. It will just be a savings account, but we decided even if we put $10 per each of our paychecks, for now, it will be a little something to fall back on. Right now, I just have to try to find the money. I have been ill since last night when I saw the letter. Like I said before, we take a couple of steps forward and twice as many backward. Both my husband and I are stressed pretty good. In fact we got into an argument really over nothing before he left to go to work. It was pretty heated, but hopefully by the time he gets home from work at 11:30, we both will be calmer.

I am sure UnitedCash Loans will try again too and will try to get extra fees and such. Just not sure what these companies will really try to do. I know Midland Marketing said they were turning my account right over to collections, Route66 threatened the same thing and have not heard back from United Cash loans, yet. They all 3 have received numerous emails (which I save in a folder not only on the computer, but I print them off too), so we will see.
Just say a little prayer now and then that we can get everything back ok. This has been putting a pretty big stain on us physically, emotionally and on our marriage. :cry:

I have always paid the loan in full every two weeks. Both Cashland and Advance America have suggested that I go else where. I was not aware that it was illegal until I got a hold of the laws on here. My first priority is stopping Legal Mediation from calling me at work. I am writing letters to the other store fronts proposing a payment arrangements. It will take a long time but I will get them paid off. I just need to know what to look out for. Are they going to reject the payment plan? Or will they just rather go to court? what tactics should I look out for? And has anyone else had dealings with these companies? So, far Advance and Cashland seem willing to help me, but the Legal Mediation is the bigest problem. also, with paying all these back I am afraid of not being able to pay everything else. My husband is in Iraq at this time and does not know about all of this and would rather he didn't. he has enough to worry about and he did not make these loans, I did. He does send money home but he wants 90% of it in savings. So, I am just worried about paying for gas, food, heat, and childcare. I do not want to get over my head again so I am at a loss.

They are very hard-nosed about payment arrangements, and your state law does not make any provision for payment arrangements. It simply says nothing at all about them.
I think you need to push these storefronts a little, and take a payment to them in person. I have yet to see a payday lender flat out refuse payment from a client. If they do, I think you should have every right to file a complaint against them with your state authorities.

In this instance you will need to be persistent with what you can afford to pay back in the plan. Some will eventually come around and accept payments, but be prepared for some to say no.
