Well I was turned over by Chase to these people after a job loss in my family. They sent me one letter and then actually called my mother in law (Who's 85) and my parents to try and get information on us. So as you can imagine our family now knows about our situation and are concerned (I think this was a ploy by NES). Then the day after this lady from NES had spoke with my dad, she calls me demanding that we settle that day at that time and she would get my dad on the phone for a conference call so he could help me with the money! I refused and said that I would not blackmail my dad like that and if he was going to help that I would speak to him on my own terms. The rep then said - so your refusing to settle? I said no I am not refusing to settle and kept trying to say then lets call your dad. I again refused and hung up on her. She then called back left a message giving me some lawyers name who I would now need to deal with because I "refused to settle". So my dad is willing to help mostly because he thinks these people are evil at this point. So I call back and say I want to settle and she wants my dads direct number so she can call him herself to take a check by phone. I then demanded that we see a settlement letter first, which she agreed. They got their money and I will never deal with these people again. They are like no other collection company I have ever encountered!! BEWARE!!


Next time if you face such a collection agency, record the conversation. Make them aware that you will use it for legal purpose. I see NES was violating the federal laws by involving your father and giving no privacy to your account. You could have easily got a case against them and get compensated for the damages.

Just because a person owes something doesn't make them a deadbeat. Anyone you make monthly payments to be it credit, utility, cell phone etc. makes you indebted to that person, therefore making that person a debtor. Now that said if you wish to post anything constructive/intelligent then feel free to do so but please read the terms of service for this site as name calling is not only immature/childish but it also violates those TOS and will not be tolerated.

omg.... here is my story

call me a dead beat if you wanna.

back about 9 years ago i lost my son in a drowning accident, at my ex father in law's house during his big fouth of july parties.

well to make a long story short.... i have been fighting clinical depression for years now... as a end result i lost my marriage too.... adding insult to injury.(marriages don't usually last after something like that.... sometimes it does, but most of the time it does not)

well ever since then... i have been struggling to keep my head above water....working two jobs at times just to pay on ultilities... (you should see my windows....E-GADS)

well as dave ramsey says.... you need to take care of you first.

welp my gas bill is 800.00 behind, (bad winter, bad windows, renting, bad landlord) and my electric is 600.00 behind... cause i had to run a space heater to keep myself warm... while my gas was shut off... so finally i was able to scrape up enough money to get the gas turned back on.

now nes is contacting me, my work, about a debt that i had before i was married, (oh and believe you me i have other debts too)... i am at risk of getting into big trouble with work, if these calls continue.

so i finally contacted them today... asking what is it i owe... they told me 4300.00.... but were willing to settle for 2150.00... and wanted it TODAY! Not tomorrow, not the next day.... TODAY!... they were going to file suit against me.... now i know i am not up on all that technicial jargon... but i know that's not good.

now remember, i am behind on my electric, and gas here.... in which the gas i could probally go without since it is getting warmer... but i still need to pay them....


you know what it's like

it's like.... there you are standing in a dark alley, and all of a sudden... 7-8 vicious dogs showing their teeth, foaming at the mouth... lunging at you... surround you... no escape....

AND YOU ONLY HAVE SO MUCH MEAT!


sometimes i see the only way out of it... is on the bisnuess side of a gun, but i know that would not be fair to my other son. plus i got myself into this mess... if there is a way in.... there is a way out.(with a forced grin)

just don't ever try to buy back your "happiness", because you lose a loved one,(it's a facade) and don't buy anything of major purchase, to try to save your marriage.... cause it won't work.

i am hoping to try to employ dave ramsey's theories.


lord knows.... if i had the money... i would gladly pay them... with a great big ole grin on my face.

i know i owe the money.... that's a no brainer

just how to do it..... with limited meat... that's the problem!

First off, you are NOT a deadbeat. You've just fallen on hard times, really hard at that. I'm really sorry to hear about your son. About the calls at work, you can tell them that calls to your workplace are not permitted and for them to stop calling you there. You may also wish to send them a written request to not call you at all, to keep everything in writing. It's best sent certified mail, return receipt requested.

While we are at it we'll send them something else along with it, a debt validation letter:

The letter includes the do not call request, just send it all out certified mail, return receipt requested. You may know you owe it but I would suggest sending the letter, NES has a very shady reputation and I would suggest getting proof before you pay any of your hard earned money toward it.

Lastly if you could answer the following questions I can further assist you.
1. What type of debt(s) would this include (which they are trying to collect on)
2. When was the last time payment(s) were made? Just need an estimate, if you could tell me the year that would be great.
3. What state do you live in?

To further help you, I am quite familiar with this particular collection agency, as I am currently involved in a lawsuit against them for violating my rights and federal law, which is exactly what they have done here with you. For starters, tell them NOT to call you at work. The fdcpa clearly states that they must cease communications if they know you are not permitted work calls. Do it in writing if you have to, although most agencies will abide by a verbal cease on work calls.

How old is this debt? And what state are you in? If you have not paid on it in years, there is a good chance that the SOL has expired and the only letter required then would be a FOAD letter!
