I recieved an email from a "Ryan" from the company Westbury Ventures. 1-800-859-6439. This is affiliated with another payday loan company? Anyone know which one?

He wants me to fax back a paper he with my payment arrangements along with my banking info. Is this a good idea?

Please give advice.

If you want them to have access to your bank account whenever they want, then it would be a great idea.

That was sarcasm. Have Ryan verify who the creditor is, and if it is something you owe, setup payment arrangements but ONLY on your terms, which should be check or money order (in my opinion).

I never give any bank info to a creditor. I have the right to pay my debts my way, and my way is via snail mail money order.

Westbury Ventures is affliated with several PDLS...ExpressCash and The Loan Shop to name a couple. Platinum B is not one of them, Platinum B is the same as SJM Marketing.

Here is a couple of links talking about Westbury Ventures.

If you have been paying that much, then I would send this Ryan person a letter or reply email stating the Indiana laws...which says rollovers and extension are not allowed, so you have paid back more than what your state allows. Let him know you will be filing a comlaint with the attorney general.

I doubt they are even licesed anywhere, I'm trying to see if I can find a link for that..

OK. I have been doing some reading on these links and I havent a single name of the payday loans I have on either lists I have looked at. So with that being said. I assume the loans are NOT legal and I need to know how to go about doing that. I feel kinda wierd because I got those loans not knowing they werent legal and am I so called "stealing" the money? I dont like that fact but I dont know what else to do?

Please help. Thanks again for all the great info.....

Well I know Westbury is usually associated with Xpress Cash or The Loan Shop...did either of those names appear on any bank statements. I know they have a lot of DBA's, which I'm pretty sure none of them are licesned. What are all the PDL's that you have and maybe we can narrow it down.

I have the following loans

Route 66
Platium B Services
National Money Store
M1y Direct
Bahama Marketing

I emailed this Ryan back today and told him that I would send him money orders ONLY but, after finding out that either of these are on the list for Indiana lending laws- Should I email him back and tell him I am filing complaints do to them not being licensed?

Not only are they not licensed but according to your state laws they have over charged you.

Here is a template for a letter that you can use.
http://pollyandsay.yesdebtfree.org/template-letter/

Send this letter to Wesbury Ventures and tell him you have filed complaints with your AG's office because they are not licsened and you have been over charged. You can request a refund or just try to get the account status as paid in full.

You are only obligated to payback the principal and legal interest rate for your state. If you have paid well over the principal and legal interest rate in those roll-over/"refinancing" fees, then you should demand they mark your account(s) paid in full and request a refund. Also get your complaints into your Attorney General's office and the AG's office in the state which these companies are located. Most typed the letters and e-mailed, faxed, and mailed the letters to the companies.

That letter came from the blog of another user, that letter has been helpful for many people, you can probably just copy it and paste it to a word document. You will need to modify it for your state laws.

It's not that you are not going to pay them back, you are just going to pay them back according to your state laws.

http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html

According to Indiana they can only charge you $15 per $100. So for instance if you had a company charge you $30 per $100 and you had a $300 loan. Say you renewed it 5 times. That would have cost you $450 in renewal fees. You should have only been charged
$225 for 5 renewals. But Indiana does not allow renewals either. So if you have renewed any of your loans and they have charged you more than $15 per $100 than according to your state laws you account should be considered paid in full.

Does this make sense... :?

These are from last year. I honestly dont know how much I paid back. I do know that I have ( I think) OVER paid Route 66. That was a 150.00 loan and I paid back the 59.00 fee for a couple of months. I got the loan I believe in late OCT 2006. I stopped paying the 59.00 fee last week.

National Money Store- I was paying down on it. That was a 400.00 loan. I paid 25.00 towards the principal and the balance was 325.00. Tuesday they said I could send a money order to San Jose, Costa Rica for 250.00 and thats the total balance as long as its paid by the 9th of Feb.

Platium B Services- 300.00 with a 90.00 finance charge with Westbury Ventures emailed me today ( and I found out they are not licensed in IN) I dont have a balance for that one. M1y direct and Bahama Marketing are the ones I have NO idea on. I filed a complaint with Jacoby and Meyers last spring because they threatened arrest if I didnt pay that day. That was unresolved. The BBB said Jacoby and Meyers didnt respond to my complaint.

This is a nightmare.....

Most of these loans are with T&C-

After finding out they are not licensed NOW what?

I will be filing the complaints next week for sure.

Once they are filed and the letters are sent- IF and when they continue to call any suggestion on what to tell them?
