Is this a proper response to my DV letter?
Date: Tue, 02/06/2007 - 17:08
I received a Validation of Debt letter today from Resurgent Capital Services, LP. It states that the previous creditor was HSBC Bank, and the current creditor lvnv funding llc. I have not heard of or had any accounts with any of these three institutions. The balance the state does not match any balances to the accounts I am trying to clear up.
This past week I’ve sent out several DV letters, although not to Resurgent or LVNV. Regardless, this is what I received back:
Quote:
Page 1 This account has been placed with Resurgent Capital Services, LP. Enclosed please find an original validation of debt that verifies the debt. If you have any questions, please call Customer Service……… NYC Consumer Affairs license number_____________ Page 2 The account of ____________ acquired from HSBC Bank is now owned by LVNV Funding LLC. At the time the account was acquired from HSBC Bank, HSBC Bank advised that the balance owing was $692.39. Since that time, additional interest, fees, payments, credits and offsets, if applicable, have been allowed, for a current balance of $719.93. Please note that any additional interest, fees, payments, credits and offsets made within the past 30 days may not be reflected in the above mentioned current balance. Page 3 Privacy Notice |
As I stated above, none of the DV letters I sent out was sent to any of these three companies this “Validation of Debt†letter states. In my DV letter I stated:
Quote:
Please provide me with the following: • The agreement which authorizes the creditor to collect debt on the alleged debt. • The signed agreement from the debtor conforming to pay the creditor • The documents regarding the payments made on this account validating the amount. • What the money you say I owe is for; • Explain and show me how you calculated what you say I owe; • Provide me with copies of any papers that show I agreed to pay what you say I owe; • Provide a verification or copy of any judgment if applicable; • Identify the original creditor; • Provide me with current transactions and list the last 5 payments made on that account • Prove the Statute of Limitations has not expired on this account • Show me that you are licensed to collect in my state • Provide me with your license numbers and Registered Agent |
Now what do I do? Is this a proper response to a DV letter? I’m not even sure if a DV letter was sent on this, not sure what account this is! I’m confused, please help!
Thanks!

I sent a few DV requests to other companies, then got the above "DV" from a CA I never head of, or an amount I never heard of. I first thought this letter was in response to my DV request, however after some research on these boards I found out that is probaly not the case.
Resurgent Capital Services, LP/LVNV Funding LLC is another CA, who typically sends this letter when they first contact you. From what the boards say, they usually handle old accounts that are over SOL, so hubby thinks this may be a credit card he had many moons ago when he was 18.
What I am going to do is send a DV request to them, and put they ball back in their court.
Have you checked to see what the SOL is in your state?

Yes, Mishele. SOL in NY on open accounts/CC is 6 years. So if this is the account hubby is thinking of, it is over 10 years old.
I believe it was just coincidence that this letter came after I sent out DV requests on other accounts, so this one caught me by surprise. After what I read on these boards about Resurgent Capital Services, LP "AKA" LVNV Funding, LLC "AKA" Sherman Financial Group and how crooked they can be I'm going to watch my step with these guys and take it slow. First step will be to send a DV request.
Ok.....since no one's *memory* is functioning correctly.......he
Ok.....since no one's *memory* is functioning correctly.......here are the know alias's of * sherman companies* et al........sherman aquisition, LP & II Lp, resurgent, sherman aquisition llc, fnbm, llc, sherman aquistion TA,LP, ascent cards serives, llc, ascent card services II, llc, lvnv funding,llc......additional alias probably in use, approach tese companies with caution, & send all of them *dv* letters not, one because they play the shell game & shuffle your account around to their various, nefarious companies!

also........I have posted a boatload of information on these op's over in teh credit agencies & collections databases. Mod's should try to research these more before replying.............this sherman operation is nothing to mess around and take your time with.
Sorry for the sharpness of my replies. Again don't take it slow with these poeple, have your information gathered, it's what they do,no matter if their incoorect & then proceed to hit every one of their companies with the DV letter, naming each so that you neutralize any response from them to the contrary.
I'l only say this once, your in for one hell of a battle with them. Go in, knock them back on their bgutts, then go for the final cleanup. Don't horse around. Thats my best intel & assessment....
also, add anything *alegis* to the *sherman* et al list........I
