I really need help!! I just got a call from Bass & Associates stating that I owe them $611.00 when my PDL was only $325.00.

She said that they were going to send it to the courts and have someone come to my work if I didn't pay the whole amount today. What should I do?

Sharon Langland

Take a deep breath and relax. You will not go to jail and they won't be sending anyone to your work. This is a lime ball of a collection agency and they use scare tactics to get people to pay. Do not give tem you banking info under any circumstances! Who do you have you pdl out with? What state do you live in? How long have you been paying on your pdl?

Sharon, Welcome to the forums. First of all CALM DOWN!!! They are not going to send anybody to take you to court or to jail. You cant go to jail for a payday loan. What state are you in? Go to http://www.paydayloaninfo.org and look up your state laws on payday lending. Bass is a dirtbag collection agency. Best Wishes KYSIDE38

First of all, nobody will be coming to your job..that is a common threat they have used on several people just to get them to pay the money. Tell Bass that you will not be sending anything until they validate the debt. If you do a search on Bass on this site, you will see that several people have had to deal with them. Who is the original lender for this loan?

Thank you all for the great information. I live in Illinois. Is that good?

So when this lady calls back from Bass & Associates I should just ignore her?

No, don't make them feel all of a sudden that you are ignoring their calls. They are surely violating the laws but you need to make them aware that you are following the laws. Send the debt validation letter making your first legal move. They have no grounds until they prove about their authorization. If the calls are becoming aggravating, check your state laws and record them. You will find it useful when filing a legal case against the company.

You send any collection agency a debt validation letter when they have not mailed you the details of the debt they say you owe. The debt validation letter sent by you forces them to provide the info within the legal lines as mentioned in the fdcpa. It also proves your part of taking care of the matter. Make sure that you send it CMRRR to have a proof of your actions.

See this link for the sample debt validation letter.

I just received another call from the lady from Bass & Associates stating that I now need to call my litigator and I don't know the seriousness of this. Do I call her back and ask for a debt validation letter? I'm really nervous about this whole situation.

Don't be nervous, they are really just trying to scare you into paying them money. They are required by law to validate the debt. This company is violating so many laws and that is why we are telling everybody to file complaints with the AG's office in your state and the state the company is in...(Florida) I know how you feel, I had to deal with this company last year and I will admit they had me scared in the beginning as well.

Slangland- Welcome to the forums. I love this site. Listen to what these good people on here are saying. When I first starting getting calls from these jerks they said basically the same thing. They use to scare the crap out of me so much that it would make me physically sick and I couldnt sleep at night. I have taken everyone's advice/suggestions and I have learned ALOT especaily knowing that these idiots will/are charging illegal interest fees on these loans. If it wasnt for this site I would be paying them EXACTLY what they are demanding and then they would win. As my boss has told me over and over "FIGHT BACK!" I'm doing that now. As everyone has told me recently ( I am trying :) ) get tough and dont take any crap from them. Bass and Associates as of today has 35 and counting complaints against them as of today's date! Keep coming back to this site TRUST ME! Don't worry! We are all here for each other and I personally think it's great support! :)

They started on me yesterday for VC Funding. I am in Ohio that states they do not allow extensions on loans. They send me a statement saying I owe 720.00 on a 300.00 loan when I have already paid them 1200.00
I couldn't stop them from taking the extensions out.
Even the secretary was nasty telling me how I was going to be arrested for check fraud. I don't want to pay anymore but what if nothing else works? I was thinking of calling VC to ask them for a settlement amount. My husband is just about ready to kill me. I had 5 loans from the internet and paid all of them off except the VC since I couldnt get a hold of them. I asked the bank to put a hold on any transactions and it actually worked. They think I closed my account out. This is awful and with it being the weekend I have to have this on my mind for two days.

Jodi

Hi Bipolargm2, welcome to the forum. At the beginning of this thread you will see a post by Kyside that has a link to payday loan info. Go there and you will see the laws in Ohio. I also live in Ohio and I know just how you feel. Make sure that you register a complaint with the AG's office here and also with the FTC. You have paid way too much. If you go to the google search bar at in the corner of this page you and google VC Funding, you will find more info on them. Just relax for the weekend - and take a deep breath, you have come to the right place. There are many here who have been were you are and you are not alone.

Hi Jodi,

Welcome to the forums :-) I live in Ohio as well and I was in the payday loan trap last winter. You have paid enough on this loan. First of all, send Bass & Associates a debt validation letter. There is a sample in the DIY section of the forum. Also, send it certified mail with return receipt requested. This way you will have proof that they received it. Keep everything documented when dealing with both companies. Bass & Associates is located out of Florida and they like to threaten people. Follow irish's advice and file the complaints. Also file complaints against VC Funding in Ohio with the Ohio Division of Financial Institutions. If they are not licensed in Ohio, then they should not be doing business here. Since you have overpaid them, this should come out in your favor :-) Also file a complaint with the Florida AG's office against Bass & Associates as well as Ohio. Feel free to pm me if you have any further questions.

Don't be afraid of them. Get those complaints in, if you need help, please let me know. I'm about two hours from Columbus but we have a lot of family there. I was there a lot in December when my mom was at the OSU hospital. Brownsugar, thanks for the info. I guess I'll be getting something in the mail soon. I'm going to file complaints against mycashnow in Nevada this week as well. This is what their DBA called me about back in December.

It is Illegal for debt collectors to:

Imply that failure to pay the debt could result in arrest, imprisonment, or garnishment of wages;

Call consumers at work when they knew the consumers' employers prohibited such calls;

Talk with third parties, including neighbors, children, and employers, for purposes other than acquiring location information about consumers, without consumers' consent;

Cause the telephone to ring, or engage a person in telephone conversations, repeatedly or continuously, with the intent to annoy, abuse, or harass a consumer;

Threaten to take action -- such as filing a lawsuit -- when they did not intend to do so;

Call consumers at times or places that they knew or should have known were inconvenient;

Fail to notify consumers of their right to dispute and obtain verification of their debts, and to obtain the name of the original creditor

Continue to try to collect debts after consumers disputed them in writing, and before verifying the debts.

Use obscene or profane language

Bass and Associates, you are crooks and con-artists. Do not come here and pretend to be helpful, when most members have heard your threats on the phone. You are liars and criminals. Go sell your lies to the Florida Attorney Generals Office, we have heard enough from you.

I looked at your post that says "QUOTE" and I have sent $150 to that same LTS management in henderson, nevada and the original creditor for the loan is paragon who supposedly bass & associates are collecting money for. Now I am wondering if LTS management is already collecting for Paragon, who is bass & associates and why are they making me pay close $700 and i don't even know who they are. please help.

Do not pay Bass and Crooks...er...Associates a dime without first sending them this letter via certified mail:

Re: Acct# 00000000

To whom it may concern:

This letter is being sent to you in response to a notice sent to me on March 8th, 2050. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:

1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with third parties, it will be considered harassment and I will have no choice but to file suit.

It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records; any information obtained shall be used for that purpose.

Thank you,

they are calling me from 1-800-281-2220. And I always talk to DW Griffey and Kim Johnson. DW sounds like a man and I got into an argument with Kim Johnson. I told her that I wanted to talk to the man that called me and Kim Johnson said that it was DW Griffey. I said no that it wasn't. They are pulling a scam over there.
