Internet payroll company garnishment

Can a payday loan company located in a state other than one in which I reside garnish my wages? This company is not licensed to do business in my state. They told me they were going to call my Payroll Dept. charging that I wrote a bad check across State lines.


Garnishment is different from wage assignment. Online lenders must be licensed in your state before garnishing your wages. If "wage assignment" is mentioned in the contract, signed by you, send a revocation letter because it is completely voluntary. Send the letter CMRRR to be sure that the company has received your revocation letter.

Report the loan company to your state AG for doing business without a valid license. However, this rule is not applicable in PA

As long as the company is NOT licensed in your state to lend, no judge in the world will let them obtain a judgement to garnish, trust me!

They love to use those wage assignments, though, so definitely get a wage assignment revocation letter out now. First, though, get a letter of defense to your payroll dept. This is the same thing as a revocation letter, only directed to your payroll dept.
