Dealing with AmSher - Need advise on this

To make a long story short: ex-husband bounced crap load of checks, now the acct has gone to a CA. They called back in January and the woman that I spoke with could not speak a lick of English so I couldn't understand who the debt was for. I asked them to send verification. 2-3 weeks went by, they were calling and finally I told them that I still haven't received anything. Today both verifications came in the mail. I called them to set up a payment plan, debt is $1300 and i don't have that kind of money laying around. I asked if $200 a month for 5 months then the 6th month pay the balance. He said that they have had the acct for 2 months and stretching it out that far was pushing it. I told him that the first payment could be done on Friday, payday, and he said that it had to be done by the 28th or they are closing the acct out and moving forward. I told him that if the payment goes through before Fri. it will bounce so I'm not doing that. Also stated that I had to do a post dated check.

Can they refuse the payment if I send it to them on Friday? I mean I tried to make it right but he refused the payment plan. It wasn't like I was saying I would send $5 a month or something like that. And now the best thing, as I'm typing this they call to collect with the automated call. I called back and she said they are sending it to the attorney because I refused to cooperate.


Any collector will sound pushy as long as they can collect larger payments from the consumers. Their commissions are attached with the amount collected. Send them what you can afford when you have the paycheck and wait for them to post it towards your file. They can't hold your money by not posting it towards your account.

In case your account is sent to their attorney, it should show up all the payments done on your account and then move from there.

While your payment can be refused, it is not likely, especially in your case. You proposed a very reasonable arrangement. Like cajunbulldog said, give no banking info!!

Not only that, but in at least a few of the CA's out there, individual collectors may only work an account for a short period of time. After that, the commission recieved from a payment either goes to the house, or the next collector that contacts you (or attempts to do so). I believe it is industry practice to pay collectors practically nil for wages, but entice them with potentially huge bonus checks.
