What is the worst that can happen if you do not pay right away? :?

Most companies are willing to work according to the plan you propose. They may offer some extensions if you have every intentions to pay the debts. Partial payments are better than paying nothing at all. You need to show some activity on your account.

Legit companies can take legal actions for recovering their money if the amount is too big and they can recover the court costs and attorney fees from filing that case. If not, they will send the account to collections or sell it off. Then, you will have to deal with third party collection agencies only.

What companies do you have your pdl's with? How much did you borrow/pay back? What state are you in?

To answer the specifc question, you could be sued, your wages can be garnished, judgements can be entered against you, etc. But it depends on the situation. Most people's situation will never get that far. But it all depends on what state you are in and what companies you borrowed from.

Do a search on this site for Bass and Assoc. They are a collection agency that breaks every law in the book.

In NJ pdl's are PROHIBITED!!! You only owe for the principle.

http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html

The worst that could happen is they sue you, take you to court, you tell the judge that the pdl is illegal, and charging you illegal interest. Oh, and they will report you to teletrack, a credit reporting agency that only sub prime lenders use.

Since pdl's are illegal in your state, you need to start writing letters and trying to get your loans marked paid in full (assuming you've already paid the principle amount). I'm assuming you've already defaulted, since at least one loan is at Bass and Assoc. Is this correct?

Yes, that is what the state law says.

I would start writing letters to your pdl's telling citing the laws on NJ, and asking that your loans be marked paid in full.

If you do a search on this site you can find some example and get a good idea of what the letter should be like.

PS - I deleted the duplicate posts . . . .

If they are pdls and they are coming directly out of your bank account, look at your bank account and see what it says as far as who is taking out the money each time. This will give you a start. You can look at back statements and see how much you actually borrowed and how much you have paid each company by looking at each month's statements. You may have already paid more than you needed to, but check to make sure. I would start there to see who you are paying and then you can post it here and people may be able to help you find out who you are paying, also the bank may actually have some information in regards to the transactions. This is a start.

They could try to assign your wages. Some pdl's put this in the contract. It is completly voluntary. All you need to do is send them a certified letter stating that you revoke any and all wage assignments you may have signed.

Yes, you can fight them. You should only pay what is legally allowed for your state. Since NJ prohibits pdl's, you are only responsible for the principle amount borrowed.

No, don't try and scare them. First off, it probably won't work. They don't care if you have a lawyer. Plus they know lawyers cost a lot of money and if you had a lot of money you wouldn't have taken out a pdl. Second, it could be considered extortion. That could make a bad situation much worse for you. You can tell them the NJ laws, they are located at paydayloaninfo.org. You really should write them letters with this info, as that can be tracked if you ever need proof of what was said.

Yes, they can be typed. They should be typed.

They just need to state your case. Cite they laws of NJ and say that since they are breaking these laws your loan should be marked paid in full. I would also contact the NJ attorney general's office and see what they suggest, since pdl's are prohibited in your state.

Do not send Bass and Associates money. They are crooks. They are already under investigation for utilizing illegal tactics on consumers. Get informed.
