I sent Nelson, Watson & Assoc. the first validation letter. As to my suprise (sarcasm) they did not validate my debt.

What do I need to do now. I have the signed certified confirmation that they received it on Feb 15.

If they had everything in order it shouldn't be a problem to validate the debt. Like the above poster said I would send another one. I think that all collection agencies should have all paperwork and validating proof in order before calling people and sending out debt letters.

Bossy4455,
You may have a folder of evidence you made every effort to contact LVNV, but what would the judge do when he/she sees it? Does anyone know if the judge will then mediate the matter? Throw the hearing out? Find in favor of your settlement offer?
I've been sending letters to a couple of collection law firms and CAs but haven't received a response.
My worry is, the longer they wait, the higher the the charges are and the more you'll have to pay, even if you can settle for 50%. Thoughts?

Bossy's folder is useful in three ways that come to mind right away. If you are taken to court by them,it can be presented to judge showing the lack of evidence of claim. As Morningstar said,if they do sue you without validating,it is evidence for filing counterclaims under fdcpa. Lastly if they are reporting on your credit report, evidence can be sent to the bureaus to show it is a invalid account since collector is unable to prove it.
