I would send another one and let them know that you are aware of the first one being received, but to date have had no response from them and would like a response as soon as possible due to you wanting to clear this up as quickly as possible.

If they had everything in order it shouldn't be a problem to validate the debt. Like the above poster said I would send another one. I think that all collection agencies should have all paperwork and validating proof in order before calling people and sending out debt letters.

I would not waste my time and money on another letter. If they don't validate, they cannot collect.

That's true, but if they ever take you to court, the more efforts you show, the better. I have sent LVNV probably 10 DV letters, and follow ups-and no response, but if they ever decide to do anything, I have a folder full fo stuff!!..KAren
But then what?
Bossy4455,
You may have a folder of evidence you made every effort to contact LVNV, but what would the judge do when he/she sees it? Does anyone know if the judge will then mediate the matter? Throw the hearing out? Find in favor of your settlement offer?
I've been sending letters to a couple of collection law firms and CAs but haven't received a response.
My worry is, the longer they wait, the higher the the charges are and the more you'll have to pay, even if you can settle for 50%. Thoughts?
They also then may simply pass the account on to another collect
They also then may simply pass the account on to another collection agency/junk debt buyer-because they are unable to validate the debt...

Bossy's folder is useful in three ways that come to mind right away. If you are taken to court by them,it can be presented to judge showing the lack of evidence of claim. As Morningstar said,if they do sue you without validating,it is evidence for filing counterclaims under fdcpa. Lastly if they are reporting on your credit report, evidence can be sent to the bureaus to show it is a invalid account since collector is unable to prove it.
