I found this at the Cornell Law School Library. This could be useful when dealing with original creditors that are being completely inhuman on phone. Please note the restrictions of the code. It states in the District of Columbia,Interstate, and foreign calls. So that means if your creditor is in your home state,it will not apply.Enjoy and I will be looking for the state statutes on this in the near future.

Yes, there is a Federal Obscenity Communication Law. As of January 2009, it is illegal to use any communication device in the USA to make any comment, request, suggestion, proposal, send an image, or other communication which is obscene (including 4 letter words) or child pornography, with intent to annoy, abuse, threaten, or harass another person... Even if it is not obscene but is considered harrassment and you are an adult or as an adult you knowinly allow a minor to use any communication device you control or own you can be fined up to $50,000.00 and/or sentenced to 2 years in prison.

i signed for my son's student loan ten years ago. I'm on social security and get very little. A collection agency calls me every two hours even though I told them how much I can pay. The loan is a little over a thousand dollars. They want three times the amount I can send and constantly harrass me saying they are going to garnishee my Social security. They want me so send fifty a month but I only get seven hundred social security a month. I can send thirty five but the refuse to accept it they say. What can I do?

Send them a cease communication letter. They are in violation of the FDCPA for calling you that frequently. You could sue them if they are a third party collector. They can file for garnishment with the court if that is a federally backed student loan. Our member Soaplady has a lot of expertise regarding this and she should be along soon to answer.
