no they can't do this.first file a police report for the call as debts are civil matters.whoever this is broke the law in threatening jail.next use either the number you have,or name of the place to file AG,and FTC complaints.do not fax them anything.do not pay these idiots a dime.

since it is most likely an internet.no they can't have you arrested at all.in fact if you could name the pdl i can tell you how much they can do if anything.another thing, how much was debited by said pdl before default.if it met or exceeded 200.00 then you actually owe nothing.please answer thos two questions, and we can determine whether this is a bottomfeeder.

We live in TX, I am not sure what states the loan companies are licensed or placed in. My husband recently got laid off, and to pay the bills, he went out and got 3 payday loans, each over $1000, with his last paycheck stubs, and actually wrote checks (2), or put his bank account information online (1) as an electronic check, for the repayment. He then closed his bank account, and opened another at a different bank. He has no intentions of paying these loans back in the near future. He says once we are both back on our feet he will consider it. He only just told me about this a month after he's got the loans, and I am so worried about how this is going to be handled. I understand debts are civil and they can not arrest you for that, but what about the hot checks? I've looked up some information that show that anything over $1500 is a state jail felony & punishable with up to 180 days & $10,000 fine. Would his bank prosecute for that, or would it fall on the payday loan companies? Where is the line between "hot checks" and "payday loans" to where it becomes criminal and not civil? Any help would be greatly appreciated. |
If the PDL companies can prove that your husband had no intention of repaying these loans, he could be charged with fraud.

I have two payday loan places calling my husbands work. and told me that I am being charged with Violation of Federal Banking regulations, Collaterateral Check Fraud and Theft by Deception? We tried to pay on these internet loans through a cccs program and they refused the payments , they said that they had to have my bank account information and now my family is worried that I am going to prison. They were upfrontcash and instantloansnow. So what do I do?

I also have taken a pay day loan out .I recently started getting phone calls from a man claiming to be an officer of the court telling me that I am going to be arressted and I am being charged with several federal, criminal, and fraudulent crimes.I don't even know who this company is I had never heard of the company he was calling about before now.At first I was really afraid that I was going to be arressted for this but I did some calling around and spoke to a few attorneys and they said that a collection agency can not arresst you for default on a pdl.I offered to pay the debt they claimed I owed but they would not talke the payment from me They wanted me to fax them a photo ID, my SS#,my bank account and atm #, my address, and a paper saying that I would authorize a debit for the funds owed.I also aked them to fax me the loan paper work and they told me that they were not able to do that until I pay the balance in full.It all seemed a little shady to me so I did not fax them any info, now I am being harrassed at home and at work, they have even called my parents about this. The way I figured is that even if I didn't pay it they did get there money I have paid them more money back than I even borrowed..Such a scam and would never do it again not worth the harrassement...Would not recommend getting a pdl ever....

I live in maryland, I received an internet payday loan about 3 months ago but can't pay. I spoke with someone today claiming they were an officer representing the company I borrowed from. He told me if I didn't pay he is sending my charges to my county office and I will be arrested tomorrow. I'm not too worried but he didn't provide any information for repayment by installment. He just said if I don't pay that day they are sending police to my residence. I asked since they can send police to my residence then why not written documentation, apparantly that is a refusal of payment and he hung up on me. Do I have anything to worry about?

Payday loans are prohibited in your state. You CAN'T be arrested for owing a debt, nor can they press criminal charges as owing a debt is a civil matter, not a criminal one. Besides, pdl's are illegal in your state. CLICK HERE to find out how to deal with illegal lenders.
i dont know if yall know this but i just figured it out myself.
i dont know if yall know this but i just figured it out myself. You can file a FTC compliant on the payday loan place because its illegal to threaten you with any type of arrest or take you to court.

Payday loans are prohibited in your state. You can't be arrested for owing a debt, this is a SCAM! File a complaint against these people with your state attorney general and the FTC.

I am in the same boat as all of the rest of you...I have been getting the same phone calls from these people in India and then one day it struck me to google the numbers...NO LISTING! This was a major relief to me in and of itself :)

I've also been dealing with these calls. I've lost sleep over them, and I've actually paid two of these loans off after being threatened with jail. $1100 for one, $1095.37 for another, and I'm in the process of making payments that will total about $1500 for a third one, and I just got another call 3 days ago with a voicemail saying i'm being investigated, but I haven't called back. I cant remember the name s of the companys, but they were all online cash advance/pay day loans. I live in new york state, what should I do at this point? I would really appreciate any help or advice.

Hello everyone, I enjoy reading this forum. Everybody seems to be a great deal of help to a lot of questions I have.
The question I have is kinda relates to some in this thread. Some guy with a thick indian accent called a few days ago, claiming he was an "attorney", from "american legal system"...kept rambling on about "court" and "check fraud" or calling my work to have me fired. I finally snapped and called him out and said he can't threaten me over the phone, cussed him out and he hung up. I remember I asked him what company is he representing, and he said "cash advance"...never even heard of them.
Sorry if this is in the wrong thread, but here is my story. I live in Nevada. Have 7 store front PDLs. In default with all of them but am working out payment plans with them. I have 2 online loans that are in default now, from cashnetusa and loanshack. The loanshack people seem friendly and are willing to work out a payment arrangement (doing a money order with them because thats the only way i can and appreciate they are doing that). But I have a real issue with cashnetusa. They keep debiting my account even though its overdrawn, I told my bank to stop it, Chase, but they told me they cant close my account because its negative, and will allow any ach if it is presented. Chase said they can do a stop payment but will charge 32.00 for each, but i dont know why i'd do that since cashnetusa tries to debit 4 or 5 times every two weeks. Please help, I've asked them that i have to do a money order or western union, anything other than debiting my account (it is overdrawn 1,300!), but the email response i got from them was a manager is looking over my account. sheesh! I have every intention of paying the 85.00 a month for about 5 months in their extended payment plan, but can't do it if they continue to insist on debiting my account. please help, how should i deal with cashnetusa...oh yeah, im a little skeptical that the guy that harassed me, saying he was from "cash advance", really from cashnetusa, because i only got that call after defaulting. but anyways, God Bless everyone, thanks for your help!

It's a scam, all of your lenders are legal but Cashnetusa has been known to sell off a customer's information to bottomfeeder collection agencies (after default), and once your information gets into the wrong hands, the whole world has access to it, unfortunately.

Thanks for the response, Shazzers. So my question is, did cashnetusa sell of my defaulted loan to someone else and i owe that company money too now. I mean, i probably don't owe cashnetusa AND the collection agency. do i? and if this is a stupid question i apologize in advance. LoL...but if i go with the extended repayment plan with cashnetusa and pay those rat bastards off finally, does cashnetusa have a history of "pretending" you never paying them off and still contacting you or one of their collection agency they sold your info to? and still wanting to collect? thanks again...

I took out a pdl over 2 hrs ago and paid some back but defaulted on the balance. I sent letters to the company as well as complaints to the bbb...they disappeared for a while however today they called both references that I had listed and told both that they are coming to my job to serve me with papers for committing fraud and that I will be arrested. I called the number back 1 866 615 8613 and spoke to a man to find out what this fraud was and he basically told me I was sol, and that the fraud charge would be held up in court an I would go to jail because I signed the promissory note via my email using my first and last name. They have been constantly calling my job, but now they are threatening to come there to get me. Is this even legal? How were they even able to give out information to the people they called...one being my now husband who was upset and confused asking me what kind of fraud I'd committed...I just don't know where to go at this point, I asked for the mans fax number or address for written correspondence but he refused and said there was nothing I needed to fax him and that I better call him back before the officers get to me.... I can not lose my job because of being arrested at work...what do I do?
Please help

If a collection firm is telling you they will have you arrested they are obviously a bottom feeder, try and get as much info from them as you can, then file a complaint against them for non compliance of the FDCPA, you can file a complaint with the FTC online.
