collection company sent bill then said they werent handling

I got a bill from Capital Management and asked for them to prove it was my debt. They wrote back and said they weren't handling the account anymore. They said Resurgent had my account. I haven't heard from that company.

Why do collection companies bill you and then say they don't have your account?


What does Resurgent have a reputation of doing?

If Resurgent is "handing my account" as I was told, does that mean the other collector could not 100% prove that the debt was mine, or that I signed an agreement to pay....or maybe they have no ownership papers from the original creditor?

Who is the original creditor that they were trying to collect for?

In cases like these, the collection agency probably knew they weren't going to be able to verify the debt, and immediately sold it before the 30 days was up.

How did you ask for validation from Capital Management? If you sent it in the mail, and sent it certified, then find out when Resurgent bought it. If the first collection agency still owned it, then they should have sent you the validation request. You can use this evidence in trying to remove the item from your credit report.

Yeah, I sent a request, to Capital Management, for validation, several times. I got information stating the account balance and who original debt was with. Next, I get a letter that said they no longer were handling my account, and Resurgent was.

Are Capital Managament and Resurgent the same company with two names?

How did you send your validation request? Was it sent certified mail? This is very important when dealing with collection agencies, because they can say they never received your dispute letter.

As far as them being one complete company, I am not sure. However, Resurgent full name is Resurgent Capital Services.

Be sure to get names, ID numbers (when available, and stay on top of incoming mail/phone calls. When you let days go by, you waste valuable time on your side.

Before everyone starts looking for the gunman on the grassy knoll, can I ask who the original creditor was? Not all companies sell their debt and many maintain a lot of control over it even after it goes to a collection agency. Citibank, in particular, is notorious for sending an account to a collection agency for a few weeks then pulling it back.

Bea B stated that she doesn't know if the account is hers. Therefore, she needs information from the collector to determine if the debt is indeed hers. This information would also assist her in determining whether the account is still within SOL. I would not advise making ANY payments or payment arrangements until the collector provides detailed information regarding this account, as they are required by law.

It might be my ex husband's account. But if it is - the collector added a lot of fees or interest, because I am sure my ex husband didn't owe so much. The new collector needs to prove who the account belongs to and prove they have the right to calim they be paid.
