I'm trying to help out my sister with a CA and the first place I thought about to find help was here. So here goes and hoping I remember to ask everything I'm hoping to get help on. Like myself she had taken out an IPDL which went into default. She's going through paperwork to find out how much she has paid them thus far and admits to still owing something on the loan, but they have turned it over to a CA. My first question is this, if the CA is located in one state and she resides in another can they sue her in her home state? (I have done a look-up to see if they are lic. in our state and they are not) Now in the event they cannot sue in the state of residence and decide to pursue it through the courts where they are located what would be her options there. It's not as if she can just go to court in another state. I'm hoping someone can help me out. I for one have dealt with the IPDL companies and it wasn't easy, but have no clue as to tell her what she should do when it comes to a CA. One more question, I had mentioned to her that a dept settlement program might would be of some help, could she include a debt that had already been turned over to a CA? Thanks for any answers someone may have, I received so much help with my IPDL from everyone so I just know someone can help me find some answers with this.


If your friend hasn't moved from the place from where she originally took the loan, the pdl company and the CA must have a valid license in your friend's state before any legal actions are possible. By laws, all disputes have to be settled in the court of the borrower's state.

Yes, debt settlement companies can work with pdls that are sent to collections. If you know any settlement company, talk to them about your friend's situation so that they can start negotiating on her file, before anything legal shapes up.

before you even do that, you said that the PDL company is not licensed to do business in your state, is that right? If that's the case, then they have no chance. They broke the law to solicit business where they dont have the legal right to do so. So many consumers dont think about checking these companies out before they do business with them--thanks to my experiences, I check out everyone now, but I didnt used to. Check with your state--in my state there is a 'secretary of state' office that handles licensing for businesses. Check to see what it is called in your state and contact them. You should be able to find out the penalty they face for doing business without proper licensing. Then, apply the same to the CA. Once you can prove what fines they will face, I would then turn it back against them. Send them a letter, detailling the laws they broke, and the penalties for those violations.....and then, inform them that they can proceed with harassing you if they wish, but if they do, you will then file charges in your state against both of them, and you will also sue them for repeated violations of the fdcpa, which is federal law. At the end of the day, they can owe you up to $1000 for the FDCPA violation, plus the fines and penalties for breaking state laws. Ask them if the amount they claim you still owe is worth over $1000 that it will cost them....

please let us know what they say in response.

EDIT--if this does not get them off your case, if they still try to collect, then just sue them. At that point, they will have demonstrated flagrant disregard for the federal and state laws governing their own business--so make them pay you for their ignorance. No one deserves to be treated like that....

United Legal changed its name to Account Receivable Management a few months ago. Here's the info:

They mostly collect for MTE (same as Rio Resources) and National Title Loans. Both companies use a LOT of different names so you may not recognize these.

Thanks for the info guy, my sister said the IPDL was from Cash Advance Network. Now I've been reading a few posts and I can't get it quite clear in my thick skull, is Cash Advance Network the same as MTE Financial? And if so, is this the same business that is no longer supposed to be lending money and any debts are null and void? I think I read a post somewhere on here about that. Just would like to get that clear so I know if I'm comprehending what I'm reading right?
