Hi I took out a loan with ELoan and could not pay it back, which I feel awful about:( I did pay the 90.00 on it from january-march I just could not pay it anymore.

My husband closed the account, and now some company who will not give us their name has called my family, friends, ec, and tolld all of them I was going to jail for fraud, if I did not pay this by 4:00 that was on wens. obviously we did not pay it,...

WE have offered payments until we could pay all the 750 and they refused, then they called back and said 300, and the rest monday, but they will not give me a sheet saying how much I owe a bill anything, so my husband does not want to pay them... but I do not want to go to Jail!! also any contact info for Eloans??

Is this legal?????


Welcome to the forums. I'm no pro on this but i'm sure someone will be around soon to answer your questions but i'm pretty sure they can't arrest you! Read and learn as much as you can on this site then put it to use! It is a very resourceful site! Good Luck and like i said, someone will be around soon to answer your questions

You will not go tojail for defaulting on a payday loan. They will threaten everything. You can go to http://www.paydayloaninfo.org and look up your state laws on payday lending. These internet companies do not follow state laws. In many states payday lending is ILLEGAL. I would also file complaints with the Attorney General Consumer Division. You will absolutely not go to jail - this is a scare tactic they use to get money out of you let try and intimidate you for more than what you probably do owe.

Tell them you want debt vertification. If they do not provide, do nothing as they will not being able to do anything to do - just harrass you on the phone which you can avoid.

I have read on these forums everything I can some of the info is excellent! and very reassuring to me who was freaked out and am now mad and my husband, we asked the collection company for proof of the debt, in writing, and she said they did not have to provide us with that until afte rwe paid the debt that they were being nice and working with us to let us pay 300 on friday, and 450 on monday, which we were going to do, that is alot of money for us, we have three children so that would be bill money, we tried to explain that and she told us the county I lived in could pick me up instead and then what would happen to my children, that she was thinking of my children and being nice and "helping me out" we have asked for the company name, and gotten nothing, the only thing we have is the info to pay them by western union, we once again asked for proof of the debt on friday and she said no, so we sent 30.00 instead of the 300.00 and she called back an hour later saying that was not enough to settle this charges would be filed with dorchester county at 1.00pm that day so I told her my husband would not allow me to pay the debt until I had it in writing from her company, she then screamed at me to tell my husband I would be going to jail, so I handed the phone to my husband, she hung up, we called back, she talked to me I asked her if she hung up and she said yes because I did not pay 300 dollars like I said, and I needed to explain to my husband so I handed him the phone, he told her again no money without the paper she started saying it was not the law I owed them today, and hung up again, so he was mad called back and she hung up again, no contact since.

I am scared I am going to jail, noone seems to think so since they took the 30.00 payment.

the only info I have on them is they are processing and investigations 904-725-0089 call the number get the same person every time. MS. stevens. also the place I paid western union was NAPC OUT of FL.

I am calling the attorney general on monday and I am out of SC, I live in Dorchester county I took a loan out for 300.00 from Easyloans via the internet, and I paid 90, every two weeks from january 6th until march 30th. and they never contacted me to pay the debt off, payments to them have been stopped and the account clossed.

I repeat....

WOW! They seemed to use every scare tactic in the book - threat of arrest, jail time, fraud charges, and taking your kids away. Nice people.

Please take a breath and relax. Considering all the threats this company has made, you can rest assured they ARE NOT GOING TO ARREST YOU. The fact that they wouldn't give you any debt verification until after you paid is proof positive that they are nothing but a fly-by-night payday lender that doesn't follow the laws of this country. They probably aren't even located in this country.

Do yourself and your husband a favor - report this company immediately to your State's Attorney General, or the governing body that deals with payday lenders in your state.

As you can see by the law above, criminal prosecution for defaulting on a payday loan is prohibited in your state, and they are limited to one NSF fee or $10, whichever is less, as a remedy for default.

and by the way...was it JACKSONVILLE, Florida - home of the infamous Bass & Associates? It sure sounds like them from your post.

Ms. Stevens...accepting payments only by Western Union (which is never advisable - it's difficult to prove payment if it's questioned)...and they're from Florida. Can only be Bass, I think.

Guest - Bass & Associates are a very unscrupulous, relentless collection agency that employs illegal tactics to attempt collect debts that are often invalid.

Do a search on this site of "Bass" and you'll see what I mean - there are numerous threads on them. There have also been many complaints filed against them.

I got a call from Bass. I told them that my husband could be reached at this number. I then proceeded to give the Attorney Generals number. LOL The loan that they are supposed to be collecting for was overpaid by thousands of dollars. Hope Mr. Jacobs liked that one. LOL KYSIDE38

thank you so much for the helpful info! you have really really calmed us down, on the going to jail, and opened our eyes,
we went through our bank records and we have paid the original company 540.00 on the loan which was 300.00 so why we would owe 752.00 now is not making sense to us. We had not realized we had paid quite that much but 90.00 every two weeks adds up.

I am reporting whoever these people are on Monday to the attorney general. I realize I made a mistake, but this week of heck, was uncalled for. and what they put family memebers through was uncalled for too.

I experienced the exact same thing as "mom201" the calls on my job, the threats of arrest for a felony
and it all started because of a defaulted payday loan - got a loan for 200/never received the funds cause my account was hacked into ...informed the loan people they were unsympathetic....i told them the account was closed cause i lost everything...long story short I am now receiveing calls from Ms Stevens, once a week and she gets nastier each time.....I went to paydayloaninfo.org...and according to my states info they can persue legal action if the bank account was closed....now I'm nervous...can anyone give me some reassurance that 200 hundred dollars (that i never received) will ruin my life.

was on vacation and just got back to the office this morning and had a couple of phone messages from 904-725-0089 saying i better call them back or else fraud charges will be filed against me in my county of residence. are you guys sure i am safe and won't be going to jail? my original loan was for $300 and i paid more than double that back in fees. i am in Collin County in Dallas, Texas. Anyone have the laws for my county or state?? thanks in advance for your help.

thanks for reposting the info. i just called that collector back and had it out with her on the phone. i just love confrontations. when she mentioned they would be filing orders with the court in my county for fraud, i went over the laws governing payday loans here in texas and she started to get irate with me. they she asked me if i thought because of those laws i was gonna get free money. free money?? i told her they deposited $300 into my account in february and i had been paying $90 in fees every two weeks up until october. if anyone got free money, it was the payday loan company. they got over $700 back on a $300 loan. she must be crazy. they i asked for the name of her company and she hung up on me. that was a fun little break in my morning.

Thank you so much for this information. I took borrowed 300.00 from easy loan. I mad an attempt to pay directly to easy loan but they wouldn't accept pre-paid debt. Tamara from easyloan said that she had to turn my account over to a collection agency. They will contact me in a week. Today I recieve a call at my job from this Sharon Jackson. She saisd that she was from the district attorney's office. She told me I had to pay 785.64 by 12:45 ( 1 hour away) or the judge in san bernardino county will process prceeding aganist. She gave me the western union information also. after to third call I told I couldn't pay Ineeded to do a payment plan. She didn't want to work with me. After reading your comments I'm glasd I didn't. I am going to still try and work with easy loan. And if Sharon Jackson calls me again i'll have some ambuminiton for her. My state is California.Any other tips will be much appreciated

this lady is not for real i had received the same call yesterday and she stated she was from the sheriffs dept i called them and they stated she was not. she is a collection agency and that i can press charges on her for fraud for saying she works with the sheriffs dept. do not give this lady any money.
