last night purpose loans who is actually another company called and said i was in default and fraudantly refused to pay the debt. they then yelled at me until i agreed to pay the debt next week. i know the money wont be there because i dont have any money. i was told to not pay my car payment or rent until this was taken care of. that the bank and my landlord would understand. but i dont want to do that. what should i do? i sent an email to my attorney general as i saw you were instructing others to do.

You need to take care of yourself first before you take care of scumbag collectors! Your landlord and carnote most-likely will NOT understand, and if you get to be too far behind with them, they are are the ones that have leverage against you and can sstart eviction/repo.

On the other hand, Purpose Loans really can't do anything to you. They can't arrest you or charge you with fraud. Don't risk losing your home or car to pay these scum. The only thing they can do is call you up and yell on the phone. Most likely, they are not legal in your state and so they are the ones breaking the law.

that is what i said to the collector. she went and got her manager to pusuade me to not pay my payments. i didnt know what to do, i told them no and they simply stated they were going to attempt to take the money out of my account anyway. i spoke to my bank yesterday, they have tried several times to take money that isnt there and the account just keeps going further in the negative.

Ok- someone PLEASE tell me this about purpose loans....I know it is backed by a bank and I know they are legal- BUT, dont they have to follow YOUR state laws? Also, I am in default with mine- They are wanting me to pay back in payments with ONLY my checking account- I just dont want to give them my account info......I called last week and the woman told me I was day 19 "default"- how many days does it go before it is turned over to a CA.....will it also report to teletrack? Thanks.

Hi. It sounds like First Bank of Delaware is horrible. I have a friend who is about to start dealing with them, as she defaulted on her checkngo installment loan (actually, she blocked them from her bank account so that she wouldn't go into the negative), but they told her the same thing...that she can't make payments unless they are taken from her checking account. They must be out of their minds to tell you not to pay your car note and rent. Don't listen to them. Make sure your necessities are paid first. They can wait.

Doesn't this help? Isn't this saying that a company can't MAKE you pay via ACH debits through your bank account? Please read this and see if I am understanding it correctly.

Quote:

???? 913. Compulsory use of electronic fund transfers

No person may--
(1) condition the extension of credit to a consumer on such consumer's repayment by means of preauthorized electronic fund transfers; or
(2) require a consumer to establish an account for receipt of electronic fund transfers with a particular financial institution as a condition of employment or receipt of a government benefit.

The way I understood what you posted cannr is that the federal government cannot force you to have an account to receive government funds, i.e. social security benefits and the like.

I could be totally wrong, (like that has never happened before. Let me know anyone if that is right or wrong.

ladybug, I was referring to #1 on there. Where it says you can't extend credit based upon paying only via ACH debits. I knew the #2 had something to do with government. As kash posted, you can always revoke ACH authorization. Thanks, kash! :D
