I dont know where to begin but I need HELP!! I am in NJ and I know PDL's are ILLEGAL here....I have numerous loans in which they debited ridiculous amounts of money in which it turns out Ive paid over double of the cost of the original loan. Arrowhead sold me to Icollect who contracted me out to BASS who threatened me to the point I was crying......OK so now I know Im not going to jail as they stated BUT they are calling my work and telling my co workers that I am in "HUGE LEGAL TROUBLE" so not only do I feel like a loser but now my coworkers KNOW im a loser!!!!!!! They told me I crossed state borders, violated FDIC laws and am th head perpertrator on an ongoing scheme???? They demanded $720.20 in an hour and a half......which obviously im not doing. Ic alled arrowhead who gave me the Icollect number and am waiting for a response from them on how to PROERLY pay or havent I paid enough already??????? Either way they ILLEGALLY gave me the PDL to begin with.....I really dont know where to start...I had to close my bank account so now I have no clue how much ive already paid what original amount was, etc. I do remember that the way it would come out on my statements was NEVER written so you knew WHO THE F you were paying!!HELP

Step back and take a deep breath. These people are criminals and are the subject of an investigation by the Attorney General in Florida. They can do nothing to you. Record their calls if you can and give the recording to the investigators. Bass is denying doing what they are doing to you.
Get all the statements from your bank and list for us who the loans were with, how much was each one and how much you paid. Do not pay anyone just to make them go away. You may not only not owe them anything but they may owe you money. You have to play hardball with these people. They prey on the weak. We will help you. Wait til you see the response you get just for mentioning Bass.

Send them a cease and desist letter along with the validation letter. If they call just tell them you have filed a complaint with the Florida Attorney General and hang up. Do you have caller ID?. If you do don't answer them until you get a return receipt from your letter. Then if they call read them the riot act. Like I said, all they can do is make noise. That is it! They have also filed for bankruptcy protection from their own creditors. Feed them that! I forgot to tell you to go to the link on my last post which was originally posted by Anthony Lemons one of our biggest advocates. Look what those Bassholes say towards the end of the story.

Just wanted to tell you to hang in there! Many people here have and are going through what you are, so you are not alone. There are a lot of people here that can give you some good advice on how to deal with these people and point you in the right direction. I have not had any dealings with these people, but many others have. Don't give up hope....there is light at the end of the tunnel.

Hebba..you are not going to go to jail. I too fell into the payday loan mess and some of the agencies I dealt with were horrible. I closed one bank account over it because one kept debiting. That company constantly called me at home, on my cell and at work. One day, CRS called me at work and asked what my hours were because they were sending the sheriff to arrest me. I said I'd be there until 5. The woman was very abusive on the phone calling me trash and a thief. I hung up on her and she called my direct supervisor who basically went up one side of her and down the other pointing out fdcpa violations and advising her our institution tapes all phonecalls...at which point the collector hung up.

I contacted my state AG and the AG in the collector's state. In less than a month I received notice from the CA that my account was considered paid in full apologizing for the actions of the representative. I would contact your AG and if you know which state the CA is in, contact their AG as well.

When I was having troubles with CAs, I asked a family friend who is a county police officer if a person can truly be arrested for debt. He said not just for debt...there has to be a warrant and in order for a warrant to be issued, there has to be proof of a crime on your part. I took advantage of the Employee Assistance Program through work and a counselor from there told me the only way a person can go to jail for debt is if the company files a lawsuit and you fail to show in court, a warrant could be issued. A CA cannot send police to arrest you.

I know it is scary, but don't let your fears take over and know your rights. If you do owe them, try to work with them, but if they are abusive or unwilling to work with you, forget it and file a complaint.

Good advice waterbug. Just want to clarify on the warrant issued. If you don't show up for a lawsuit regarding a debt a default judgment will be entered, they will not issue a warrant for contempt for that. However after a judgment is issued you will be asked to fill out a financial statement and if you do not fill it out then a contempt of court order can be signed and a warrant issued and in that case they will come get you and take you before the judge. However even in that circumstance I doubt they would actually put someone in jail.

Here is a copy of the cease and desist letter you need to send them, return reciept don't forget this part! It's VERY important to have return reciept! Send this while u collect all ur information to go to the next step.
Quote:

Send the letter via certified mail with a return receipt request. Obtain PS Forms #PS3800 & PS3811 from your local Post Office. Keep a copy of the letter for your files. Send out the letter within thirty days of the first contact by the collection agency/ 1. The law applies to both the agency and to attorneys who collect two or more debts per year. They are allowed (under law) to contact you one time, after receipt of the letter, to notify you or their intent. Debt buyers (scavengers) are subject to the law in spite of their assertions that since they bought the debt, they are not the collector. WRONG!!! They ARE a debt collector, subject to the law.

Send the letter, it's legal and it works!

Dear Debt Collector /Debt Collector Attorney:

This will serve as your legal notice under provisions of federal law, the Fair Debt Collection Practices Act (fdcpa), to cease all communication with me in regard to the debt referenced above.

If you fail to heed this notice, I will file a formal complaint against you with the Federal Trade Commission who is responsible for enforcement, the States Attorney General office and/or the American Collectors Association or local State Bar Association.
I/We have decided that we do not desire to work with a collection agency under any circumstances. I/We will contact the original creditor to resolve this matter directly, as circumstances warrant.

You are also notified that should any adverse information be placed against my/our

this very important matter the attention it deserves.

Good luck but u've come to the right place for help!

kscornell,I am trying to remind people of that fact here. The Ag office, consumer protection,& Collector licensing agencies are all seperate. We must file multiple complaints with this licensing agency so they can take notice and do their licensing investigation. Here is the link for their office.
