Stopping Payroll Granishment
Date: Wed, 06/20/2007 - 20:11
Problem is that they wont offer me any doable repayment options. With all the options they provide I will have to take another payday loan to survive. I want to pay it back, but there doesn't seem to be anything acceptable.
I dont want to take another PDL and I cant afford to have them garnish my payroll either.
Help.

One they would have to take you to court to get a judgement against you which they probably will not due seeing as how they operate illegally. What you need to do is send a letter to them(and a copy of it to your payroll dept) revoking any voluntary wage assignment you may have signed. What they are going to do is send your employer a copy of a wage assignment that you supposedly signed and take your entire check. Notify your payroll that this has been revoked!

Steve,
Welcome! Relax--they can't garnish without a court judgement--but you do need to renounce the voluntary wage garnishment that you signed with them ASAP in writing and get that to your payroll dept tomorrow. If you fax it, get the name and extension of the person you confirmed receipt with.

Cash Transfer Centers sent a wage assignment to my boss. He called them and said he was under no obligation to honor it. They tried once or twice to bully me into paying. When the weren't getting anywhere they sent me a settlement for 40 percent. I paid it and now they are gone. They are an illegal foreign operation and can't set foot in a court in this country. All they can do is be annoying.

Unfortunately, once it has been thru court process and they have a judgment, it is very hard to stop a garnishment.
Really the only way to stop a garnishment after-the-fact is if you have some sort of a valid defense. A valid defense may be that you were never informed of the lawsuit (improper service) and thus could not properly defend yourself. Another defense can be if you lack sufficient earnings or if your income is exempt by law from garnishment.
Since these processes can be very complicated and hard to reverse, you would be best to consult an attorney if you believe you have a valid defense against the garnishment.
