Payday Loan Panic

I have 6 outstanding payday loans. I recently had to take out another payday loan just to pay the fees on these payday loans. I don't make enough money to pay all these fees (or the principal) and live. I don't know what to do.

I wish I had found this site yesterday so that I could have closed my bank account to debits before today. I have fees on all 6 of these loans being debited at midnight tonight. I pulled all but $100 from my bank account to pay our house note and utilities. I know that by the time I get to the bank in the morning I will be hundreds negative. I don't know what to do.

I am in Texas.

I have CASH NET USA $500. Haven't paid on yet
Paid in full CASH NET USA loan of $350 that I paid $528.84 on
National Opprotunities $300.00 Paid $325.00
GFS $200.00 Paid $225.00
Payday Yes $500.00 Paid $475.00
Cash Transfer Centers $300.00- Haven't paid on yet
(All these were internet loans)

Northway Credit $200.00. Haven't paid on yet. THese people called me on the phone and said that they were going to send me information to sign via email. I never recieved anything yet the money magically appeared in my account several days later. I don't have any information on this company???

What should I do first? I use Capital One bank... Will they let me close my account since I still have 1 or 2 outstanding charges for gas? Also, what should I do about my direct deposits?

Please help!!! I need direction.


First you need to stop your direct deposits asap. Just go back to paper check until you get a new account open. But I would go to a different bank for your new account. You need to find out from your current bank if after you close your account if it can be forced open when a new ach tries to go through.

Someone will be along to let you know about your states payday loans laws. But if I remember right ( don't count on that lol) I believe in TX rollovers are not allowed. Like I said IF I remembered right. I do know that there are some people in here that have dealt with PDL's in TX. so sit tight and check back for more info.

I quit my job so I don't have to worry about my direct deposit but my husbands company also direct deposits into my account... so I let him know that he needs to contact his payroll first thing in the morning so that we can make sure to have income next payday.

If I get insufficient funds can the bank press charges??? I don't want to get in trouble and end up in jail.

Well... woke up this morning and I'm $680 overdrawn. I spoke to customer service at corporate at my bank and they said that I could return all ACH's that came in last night... but that I actually had to put ACH stops on each name. I guess that is setting me up be overdrawn by the many names that I have heard these companies use. Is there a list of names each company uses that I can access so that I can put ACH refusals on them at the bank.
Luckily my bank will not force the account to reopen if additional ACH's are run through... but until everything that I know I have has cleared I can't close the account. SCARY!
I am going to send out letters to these companies today. Is there a list of email and physical addresses for these company somewhere.

You need to probably write some letters stating that you revoke your authorization to debit your account. State in there that you will send them money via money orders and that they need to provide you with a mailing address. You can send these letters via email or USPS certified return receipt. Do take a copy of the letters to your bank so they can have them on file. Personally I would say it looks like you may have paid a couple of these in full already. I am also not real familiar with the law in TX as far as what they allow in fees. You also may want to check to see whether or not these payday lenders are licensed to lend in your state. In the search box above, look for the Texas state law on payday loans, which will give you a little more information. It is possible that some of these companies may not be licensed to lend in your state and possible that some are not suppose to lend you any money due to you haveing over the maximum loans out by law.

You're in a tough situation with the bank account. If you can't close it due to other transactions that haven't cleared, I would have suggested putting a total HARD DEBIT BLOCK on the account. That way nothing will go through. Only credits. No debits will be taken out. However, if you have things you know of that you're waiting to clear, you're kind of stuck. There is NO WAY to put blocks on these pdl's just by their one name you know of. Take it from me. They use soooo many different names, it's pathetic. One pdl alone that I know of uses 17 d/b/a's. Yes, 17. So they can put through debits using a different name if you blocked one. It sucks. My account was $972.00 overdrawn and I about died! Luckily we worked together and got the pdl debits credited back on, but I had to put a HARD DEBIT BLOCK on the account. NOTHING could go through. In the meantime, I went to a totally different bank and opened a new account. The bank DID put outrageous fees on there, which freaked me out even more! After writing the corporate office and emailing the branch manager, I got the fees credited back on, too. But - in my case - the saving grace was the HARD DEBIT BLOCK. I don't know about you though. If you've got legitimate charges that need to come through, you can't do that. But, like I said, it's impossible to block the pdl's by the name you know. They will go a different route and use a different name. Shady, sneaky, and totally ruthless.
