Someone on here said they took on each pdl 1 at a time ...I'm thinking that may be a good idea. That and filing complaints with the AG's in the states the pdl originated from?? I hate sitting here and not doing anything. I guess I feel as long as I am doing something...anything...then eventually 1 things that I try might be the right thing???

Any opinions?? Or suggestions??

Although i don't have any pdl's i know EXACTLY what u mean about sitting here doing nothing! It drives me mad!! I just want this over and put behind me! But my atty keeps telling me to hang tight so i do, month after month until CACH shows up again, and they ALWAYS do!!!
I've finally told my husband about this mess since he was served with a summons, that i signed for, on Friday to try and garnish his wages! He's freaked out now!!!! As we spoke of all this mess i've gotten into yesterday he wanted to just call CACH on Monday and pay them the WHOLE amount which is now triple what the original debt was! I told him to hang on and let teh atty do the work!! I am sending him, (hubby) this site so u guys may get to meet him also! ha ha A family affair going on now!
But i DO know how u feel about being reactive instead of pro-active!
Please know that i wish u nothing but the best in ur fight!

Thanks Ang...and I am glad you told your husband finaly. I know how hard that was...I have 2 adult children and it was very very hard for me to admit to them how bad I screwed up...I thank God every day that they have a good grip on their won finances and they certainly didn't learn that form me. What is your attorney doing?? Are you filing chapter 7??

No, morning NO chapter 7 for us! Thank goodness! He's just trying to help us with settling this judgment and also, the original suit was CACH VS ME, now they want to garnish "HIS" wages. He is going to look into it and see if they want to do this, they may have to re open the case and then we start all over agian. Almost an advantage to me if they DO re-open the case since they're SO sloppy!!
BUt I chalk it up as a life lesson learned!

I chose to fight one at a time after I sent all of my PDL's letters and stopped getting a response. Last Thursday I chose to work on xxxxxx PDL and sebt them my letter immediately I got a PIF from them. Not that this will happen with all of them but I find that if I take all of this stuff out and try to figure it out I get overwhelmed. I have individual folders now and a list and I am going down one by one to get rid of them.

Louisiana must be CP. From what I remember from training at work there are only like 9 such states right now, and most of them were in the south.

Ang, most states have a 90-day max garnishment, then the writ must be re-filed, giving the debtor a chance to make an arrangement or prove insolvency. There are a handful of states that don't do that, though..Do you know if La is one of them?

It sure is a community property state! GRRRRRRRR! But the paralegal said then that means he is only liable for HALF the debt!! We'll see and there is NO way we'll let them garnish his wages! If it comes to that we'll just pay the %&$^$^#! lol

I don't feel that way fins! Since i've gotten this atty i feel like i'm just being reactive and i'm SO not that sorta person!! I usually AM pro-active but they keep telling me to hang tight! I'm tired of hanging tight!
But ur right fins, it will all work out, always does in life!!

morningstarr, it was me and bflow that gave the advice of working on your pdl's one at a time. In the beginning, I was throwing my whole BODY at them and it was consuming! Now it's one a day. And I believe bflow is doing it in the same order as I am. I've started with the ones that were "easier" and working towards the "ugly" ones. At least, when you get a response in the POSITIVE, it gives you the incentive to move on to the next one. After sending out all the initial letters, filing all the initial complaints, anyone that responded to me, I responded to them. Got some good results. Then the ones who didn't respond at all, I worked on them - still waiting for responses, but I'll hound them! And the ones who are down right dirty nasty, I'll work on them. But one at a time. I was trying to do them all together and just get it all resolved. Won't happen. If you concentrate on one at a time, you'll get results. If you don't, move on to the next one. Then come back to the ones with no response. But, don't just let them sit. Let these people know that you are still on to them and standing by your laws!

I listened to Cannr and Bflow too and it's working for me - I think I may have worked another PIF today with GECC. I've got all the hard ones left (all MTE in one way or another) but I'm just going to do one until I get some kind of answer-good thing I have access to a fax - email, fax, AG complaint NY and PDL origin and anywhere else I can!
