harrassing phone call
I got a harrassing phone call from a law firm claiming they are representing an account I had with a company by the name of CACH LLC. I have filed complaints with my state's attorney generals office, ftc, and the state of texas. I got another collection letter, Portfolio Recovery Associations, LLC in the mail yesterday representing HCBC and am sending out a dv ltr and a cease and desist letter just in case they are thinking about contacting me too. So far they haven't called but am sure they will start.

Furthermore, the Commissioner has determined that Diego shall be required to pay a penalty of $35,000 ($2,500 per citation) to the Department. The Cash Center's main office is in the city of Reseda in Los Angeles County. The violations occurred at the Reseda location and were discovered by a Department of Corporations examiner. As defined by state law, a deferred deposit transaction is a written transaction whereby one person gives funds to another person upon receipt of a personal check and it is agreed that the personal check shall not be deposited until a later date. These loans are sometimes referred to as "payday advances" or "payday loans." The Department of Corporations (DOC) is California's investment and financing authority and is responsible for the regulation, enforcement, and licensing of securities, franchises, off-exchange commodities, investment and financial services, independent escrows, consumer and commercial finance lending, residential mortgage lending, payday lenders, check sellers, bill payers, and debt reduction services. Consumers should contact the department to check on the status of the companies, investments or other services they are considering and the licensing status of the person. Anthony is right, almost all "law firm" collectors are just CAs by another name. They are just phone banks using an attorneys name on the letterhead. A real attorney would almost never call you. Collectors use this concept as a scare tactic, for as one Federal judge said, it would make it seem to the consumer that the stakes have been raised. --when in fact they have not.

If he really is a law firm then he should know the laws. He told me they didn't have to abide by fdcpa as they are not a collection agency. Yea right, I really believe him. He was very verbally abusive, telling me by looking at my credit he wouldn't loan me any money. Well that is just fine since I wasn't asking for a loan. Well I am on social security disability income so screw him my benefits are exempt from garnishment. Perhaps if he was more professional I would be more than willing to work something out with him, but since he isn't let them sue me is how I feel. I know bad attitude but these collectors are

ladybug, if this truly is a law firm, report the attorney to the Texas Bar. You were talking to one of their collectors, who obviously is ignorant of the law. Sometimes collection agencies name themselves in order to appear to possibly be a law firm, such as Bass and Associates, or Bass Prelitigation, etc. when in fact, the only attorneys they have are on retainer to try to save the owners from jail.

I have been getting calls from NCA (national credit adjusters) They for one just love to call me around 7:45am which I know they can't do that. But the last time they called (it was in the afternoon) they told me they were going to start litigation. They are collecting on a defaulted storefront payday loan. Then I told her about my situation and I needed a little time and then I could make some type of arrangement with them and she was fine and asked how much time I needed, I asked for a couple of weeks. So she said she would call me back in about 3 weeks. So how can they change their tune that quick, from litigation to ok i'll wait 3 weeks to set up payment arrangements? I have read that these people were terrible to work with so I am a little scared on this one. But I still have the voice mails telling what time they called so I have a little ammo if they start getting snotty with me. Yes they have sent me something in the mail telling me who the original debt was from and how much I owe and all that other stuff, but it hasn't even been 30 days since I got that letter and they are talking litigation? WTH!!!!

I will agree with you Puddlejumper, save any voice mails that show violation of the collection laws. Such as calling before 8 a.m. and you are right, to threaten litigation and then change the tune of the conversation is weird. I would be sure to document all that was said to you, in regards to having 3 more weeks to get your funds in order. That way, if in the slim chance litigation is underway, you can show good faith and that they lied to you. Save those violating voice mails, and you may even advise this company that you have the incriminating recordings, if it ever calls for it. They would rather mark your account as paid in full than pay thousands of dollars in fines and penalties, and risk losing their license.

You did the right thing by saving the voice mails. What do these CAs think of us? Are we that na????ve or what? In my opinion saving such harassing voicemail messages from a debt collector can be an efficient means that will help us in protecting our rights.

Hey thanks you guys. I just got another call from someone else tonight, but I was at work and couldn't take it. SO I guess I will be calling her back and letting her know that I am working with someone else. I will let you know how it goes :? I have a bad feeling about this lady that called though.

I explained my situation and what the other one was doing. She said she didn't know if they could do that. Then I told her about the calls I got and the voice mails at illegal times then she changed her tune and is working with me on monthly payments sent by mail. lol. I also told her that I want a monthly statement and that I was going to keep those voice mails until I get a PIF letter from them. She said no problem lol. Just like what was stated earlier in this post, it's just business not blackmail :wink:
Thanks for all your support!!! If it wasn't for you I would not have know to save those and that it was against the law to call that early. :D So I get to pay them on MY terms not theirs.

National Enterprise Systems has been calling my sister at home up to 10 times a day for the past few months. She has answered a few of their calls, only to be met with threats of legal action if she doesn't pay the account in full. They will not make payment arrangements and refuse to send a letter of validation when she has requested one verbally.
Since I have discussed the valued information found at this site with her, she has stopped taking their calls, and is sending them a letter demanding validation of the debt and that they stop harrassing her with phone calls and communicate in writing only. We'll see where it goes from here.
The last phone call she took from them, the caller stated the following..."forget paying it now, it's too late - we'll see you in court". That was over a month ago, and no court papers have materialized...but they keep calling.
