First thing, could you tell us who you have your loans through, how much you have paid and how much you borrowed. It will be a start for us to help you get through this. Then start checking out the do it yourself section, it will show you letters you can send to these companies.
Then you need to contact the storefront lenders first, because they are licensed in your state and they can take you to court. So call them and tell them your situation and try and make payment arrangements with them. I would leave the internet ones to pay for last because 99% of them are not licensed. But you need to close your checking account so you will have money for your rent and car payment, because if you don't pay those you won't have a place to live or any way of getting to work. Check you laws on closing your checking account though before you do.

Close your bank account and open a new one at a different bank today otherwise you will lose all of your next pay check. Always pay your important bills first which include rent, utilities, car payment, food and any other secured debt you have. Pay unsecured credit cards next and pay the PDLs last. They will start harassing you over the phone but this is the only way to break the cycle. Worst case scenario they might eventually sue but if they ever do it will reset your interest rate back to a normal rate that is set by your state (usually around 10%)and it will not be 782.14%. Do not be afraid of any threats they make over the phone. You can not go to jail over this. Basically you are uncollectable and they know it so they will try to threaten you or scare you into paying them. Do not apply for new PDLs or new credit to cover this because it only makes the debt larger. Just let this stuff bounce and rot until you save up enough money to settle it.

Please listen to these people. Close your bank account BEFORE the next round of debits hit. There goes your entire paycheck again and you won't be able to pay your bills you need to live on. As dollars stated, pay your bills first, pay your secured debt second, the pdl's can sit on the back burner. You can post and tell us what pdl's you have and we can better help you. But your store front ones are more important than the internet ones. Store fronts are licensed and legal. You need to contact them ASAP and make payment arrangements so that you won't get into trouble. Don't try to hide from them, as they can take action against you since they're legal. The internet ones are more than likely not legal. Don't worry about them just yet. Please close that bank account before they hit it again. You need to pay your bills. That's the most important thing. Get your life back under control. Please post what pdl's you're dealing with and what you borrowed (principle only) and what you've paid them so far. We are all here to help you, so please feel free to post any questions!

Thanks for having such a great place to find a wealth of information from people who have been there and who are also going through the same thing. Just after reading some posts and the information given all over this place, I felt better & perhaps there is a way out of this mess I am in.
#1 - the info rec'd from the new info on state laws are a BIG help. However, after reading about Colorado's payday loan laws, it seems that
it would be hard to close the bank account due to this information included in the laws:
Lender can charge fees maximum $25 + Court Fees + reasonable Attorney????????s Fees (shall not cross total loan amount).
No criminal charges can be brought against the customer unless check returns due to account closure before the scheduled date of negotiation.
So I am confused about how & when to close the account at the bank, if the above should happen. I haven't been to the bank yet so find out their opinion. I bank at JP Morgan Chase.

Ok, what you are going to have to do is contact your storefronts, tell them your situation. You will probably have to have these checks go back NSF before they will work with you. But let them know this first. Then they can make payment arrangements with you. But I will tell you that most of them will want at least $100 or more per month. You may have a problem with Mister Money (unless they have changed) I had defaulted on one of their loans a couple of years ago, they wouldn't take payments, they wanted it all at once. So I told them that I needed to save up for it. Then they told me to bring in something to pawn, I told them to go to hell and either take my payments or I will set them aside and come in and pay you when I have it all saved up but now remember I am many states away and this was a couple of years ago, so they may have changed.
But call the storefronts asap. The sooner you inform them about this the better they will work with you. I wouldn't worry about the internet ones. Pay them last. But make sure you get caught up on your regular bills first. That is a MUST.
I would open up another checking account at a different bank NOW. If your checks are direct deposit then have it switched there. Then you won't have to worry about closing your account until all the storefronts put their checks through. Yes you will have extra fees for this. But then you can pay the bank the nsf fees and close the account. But it is better to do this than have no money after the payday loans taking out.
Please keep asking questions until you feel comfortable with what you are doing. I had 10 storefront loans and 10 internet loans out at the same time. And if it wasn't for this forum I would still be paying them. I have made arrangements with the store fronts and have most of them paid off now. Still working on some of the internet ones. Yes it does take time. But it also took you time to get into the situation you are in. So take your time and get informed and we will be here to support you all the way to being payday loan free :)

I'm no expert, but you can try contacting the store fronts BEFORE the due dates of your loans. I know the laws vary from state to state. However, if you explain your situation (you don't have to go into full detail) that you can not pay the loan amount off and need to work out payment arrangements, they may tell you that they have to turn the check in once and have it returned before they can make payment arrangements. If that's the case, you can try to "play the game" and suck all your money out of your account so that there's nothing there and the check will be returned. But then you run the risk of having the internet pdl's hit and cause your account to get ugly. If you can not close your account, you can put a hard debit block on it. A hard debit block will prevent any debits from hitting the account - ACH debits, paper checks, electronic checks, etc. However, your account will not be closed. It will still be an active open account, so the store fronts can't claim your account is closed. It would not be. But it would have a block on it. You can explain their check will not clear. If they press as to why (besides just saying you don't have the funds in the bank - you're broke)you can tell them the bank put a block on it because of fraudulent charges against your account (the pdl debits). If you feel more comfortable, just call your bank and ask them. If they can put a hard debit block on it due to unauthorized debits, go for it. The account is not considered closed. Like I said, I am no expert, but I am trying to keep you out of trouble. If your law states you could get into trouble if your account is CLOSED before your due date, then don't close it, but put a block on it. The check will be returned, if that's how they need to handle it. Some store fronts have to turn it in once and have it returned in order to make payment arrangements while other store fronts will go ahead and just make payment arrangement with you if you tell them you're unable to pay the loan. Like I said, if you feel more comfortable, contact your bank. But I personally feel calling the managers at the store fronts and explaining BEFORE your due date that the check will not clear and try setting up a payment plan with them would be a step in the right direction. They will tell you if they have to turn it in once and get it returned or they will tell you that you can go ahead and make payment arrangments without them turning it in. Best advice, communicate with the store fronts before the due date. They want their money back - period. So they may just work with you. Please post as to what's going on. And let me say again, I'm no expert! But I'm all for contacting the store fronts and seeing if they'll just work with you. You might find out that some of them are willing to do that.

It's got some other ideas for different holds your bank can do for your account to stop the pdl's. Since you do have storefronts it may be best to not close the account, at least wait until the checks have come back to the storefronts NSF.
The good news is that once you default you will be able to make arrangements with the storefronts to pay off your balance. You won't be paying the rollover fees every payday!
Changing banks doesn't affect your credit rating at all. Some banks pull credit reports to verify new accounts, but it is usually a soft pull, so it won't affect your score.
I would start sending the letters to the internet loans companies you have asap. You need to get the ones revoking authorization to debit your account and the wage assignments ones out immediatly.
Yeah, you are getting screwed with those apr's, but legally screwed. Colorado allows apr's up to 520%.
Also, I recommend you do a search for the companies you are dealing with on this site. That will give you a pretty good idea of what to expect once you default.

So, let me get this right. I don't close the bank account but ask to put account into deposit only status. Is this correct? Then wait for storefronts to get NSF back and try to negotiate with them for payment arrangements? Right? Will that consitute fraud in Colorado. Reading some of the laws is somewhat confusing to me.

Yes, you want your account to be on deposit only, or a hard hold or some other freeze. The important thing is that NO debits at all can go through the account. An ach block wont work because it will only stop the internet companies. The storefronts have checks.
Open an account at another bank, and get your direct deposit switched to the new bank.
Let them go nsf.
I would send the letters now, and call the storefronts on the day you are due and let them know you will be nsf. Keep up communication with the storefronts, that is key.
There is a template letter for the internet companies at Polly's blog here, but there aren't really sample letters of the revokation stuff. But you just need to inculde the following:
I herby revoke any and all authorization I gave Company X to debit in any way any account I may be a signer on.
I herby revoke any and all wage assignments I may have signed with Company X.

Take goudah's advice. She is very knowledgeable. Reseach on this site the companies you're dealing with. And get those letters out to the pdl's ASAP. That way you're covered. Also, make sure you file complaints against the illegal internet companies. But first, get your bank account in order and those store fronts taken care of. Anything legal comes first.

sandi, the one you stated you did over the phone - you said is B.I.B. Are you sure it's not BIG? And this was a "verbal agreement" for $200, correct? No loan documentation? I'm thinking it's BIG, but a new pdl by the name of B.I.B. could pop up and I wouldn't be surprised. Do you have any contact information on the one you did over the telephone?

sand, you were surprised that BIG is illegal? LOL! I'm sorry! But almost 100% of these internet pdl's are illegal! God love them all! Anyway, if you try to contact any of your internet pdl's, if you've overpaid them, I would state that. If you haven't paid the principle amount yet, I would state that. However, I personally wouldn't try to contact them via telephone. Just me personally. You can chose however you like to deal with them. I like everything in writing. You're sending out your pdl letters, so I would do just that. Not call and send out the letters. But, that's just me. Because if you SPEAK with these people, they will argue, lie, and go on and on and you have no documentation of this. Also, make sure you go to the bank and get that hold put on your account ASAP, as your pdl's will be "pending" soon. So get that taken care of. Also, contact your store fronts yourself. Call them and let them know what's going on. Since the store fronts are legal and licensed, you want to stay on the "right" side of them. Don't just send them a letter or something. Let them know you are not "hiding" from you debt with them. Call them, explain your situation (say whatever you want), and ask what the next steps are to be able to make payment arrangements. Please post with any other questions. And, if anyone disagrees with anything I said or has more opinion from experience, please post for sand. I don't want to misinform anyone!

Today I talked to bank (Chase) and they said they do not do a hard hold or anything like that, only if there was proof of an account that was erroneously debiting my account. (Which by the way happened to me just recently, which didn't have anything to do with payday loans; it was another ripoff company that was charging me for a product that I purchased months ago!!)
Anyway, there was nothing the bank could do for me.
So I had stopped by direct deposit and I don't really have any other outstanding items, so basically there won't be enough money for any of the pdls to get any money. And, they made me feel, I was doing something illegal, as I explained the situation to them. But I figured I'd be covered by stopping the direct deposit.
However, the thought occurred to me, and I think mentioned by one of the members that this was okay to do; so my thought is, I know I have to contact the storefronts, which I am doing in a few minutes, so if they don't send in my check, then there is no fee; BUT if they do and it may take a week for them to come back, however, won't there be a large amount that I will be charged with for all the nsfs?? I have the 3 storefonts, Cash Net, 500fastcash & the illegal one, B.I.G.
Please answer soon on the above.

When I send out letters, 500FastCash & do I send the letter to B.I.G at the Reno addresss?
I want to type these up tonite and mail tomorrow.

Okay. I think I have it now. You listed your 3 store fronts first. Then you have CashNet, which is internet, however legal. Okay. Right? You need to contact the store fronts and CashNet. Your due date is the 31st. Okay. Right? Contact them BEFORE your due date. Tell them the account is screwed up, there is no money in there, and their checks are not going to clear. Ask them is there a way to set up payment arrangements. Some store fronts will tell you they have to send the check through the bank once to get it returned in order to make payment arrangements. Some store fronts will hold your check and you can make payments until it's paid. CashNet - I have no clue what they'll tell you. But you need to contact them BEFORE the due date. Hell, call on Monday. It's a day before. Call Friday the 27th, if you want. But just be up front with them since they're legal. See how the store fronts handle it. Whether it be them having it turn it in once or if they just hold it for you. Whichever, you can make payment arrangments with them. But be up front with them so you don't get into any trouble. And CashNet, too, since they're licensed. Check your state pdl law. It should say on there if they can only charge one NSF fee or whatever. I think my state says one NSF fee. So they'll tack that on what you owe. Your main concern is letting them know that so that they won't keep submitting your check to your bank and racking up NSF fees. But check your state law to see if it actually says on there how many times they can present the check. As for the 500FastCash and BIG, they can be put on hold - as long as they do NOT have access to your bank account and can NOT debit. Let me know if I'm correct on all this. I get confused! Your legal ones are the ones you need to worry about, not the illegal ones at this time. Your deadline is coming up, so contact them first, before they contact you.

I would be persistent about this or you are going to have serious problems with your bank account. Ask to speak to a manager because they fed you a line of crap. Other than that, it really souns like you are moving in the right direction. cannr has given great advice-take care of the storefronts and Cashnet first. 500fastcash and BIG are on the backburner. I didn't go through and read every post in this thread but did you already open another account at a different bank? Good luck and let us know what happens!!

I have been trying to contact bank magr. and talked to another person in finance and that is what she told me. I will, however, try & call mgr. tomorrow...he's out alot!! I even left a message and he did not return my call.

I feel that because of the laws of Colorado, I cannot close the account, so I stopped my Direct Deposit , have $25 in the account, they go NSF, after after they all hit, then I just close the account.
When I get paid on my due dates, I pick up my check from work, and open another checking account at the Credit Union this time, rather than a bank.
Ok, now for ONE PIECE OF GOOD NEWS, without ANY problems. Out of the 3 storefronts, I was only able to talk to one of them; the other 2 will be in tomorrow and I will call them.
I called Mister Money, explained to them my financial hardship and my payment will be due on 7/31, and I wanted to pay what I owed, and would like to set up payment arrangements.
The very nice young lady, was very helpful in doing this, without anything negative whatsoever. She said they would have to submit it one time & when it returns, they would not try again. My schedule is 3 monthly payments at $146.25. I owed them $423.75, but they added on a $25 NSF fee.
So one out of the way! I CAN & WILL pay this without a problem.
QUESTIONS: Do I send ALL of the internet pdls the wage & debit letters???? Plus, the Do not call me at work letter??? Even B.I.G. and 500Fast Cash and CashNet (legal), who I will be calling tonite? or not them??

I actually couldn't close my account because it was negative due to the pdls and it got charged off now I owe the bank which was ok with me, because I got my check deposited to another account too. I just hate to see you get all these NSF fees because the bank won't do a hard hold but hopefully you can get that taken care of. Great job on the storefront! I hope the other two are as cooperative!
I would go ahead and send those letters out. I have a fax number for 500fastcash I can give you tomorrow if nobody else posts it tonight. I personally sent mine through fax and email both and they all received them and responded. I didn't deal with B.I.G. though so I don't know if they respond but 500fastcash and Cashnet did. Don't apologize for asking questions. That is what we are here for :)

I think she was afraid that they would keep charging you NSF fees and put you in the negative and then you wouldn't be able to close your account. But, apparently, you have the "hold" on your account so no bank fees will be assessed. Cool. You're on the right road! Sass has dealt with 500FastCash. She can get you the contact info. on them. I haven't dealt with them. As far as BIG is concerned, use the Reno NV address I gave you. It won't matter, but use it. They are overseas. It's just a "front" for a US address. If you need the info. again, let me know. I've got it. And they will call you. Hang up on them. I'm not joking. Tell them not to call you anymore and hang up. They will get tired of it after awhile. Send the letters, all of them, or one big one including everything, to 500FastCash and BIG. They are the illegal ones. Revoke everything with them. CashNet is legal, so don't threaten them with anything. But you can send them something stating for them not to contact you via telephone at your place of employment or your home and to only contact you via email or USPS. That shouldn't be a problem. Just don't push the line with the legal ones. I'm glad you had a good experience with Mister Money. One less worry off your mind. The other two store fronts might also be willing to work with you. Don't be surprised if they also have to turn the check in once and have it returned. It kind of works in your favor. They don't get the money, so they work out a repayment plan. Like I said, if you need the Reno, NV info. again, let me know. And please do not be afraid to post any more questions. You're doing good. You're getting your stuff taken care of before the due dates. Just remember, you can put 500FastCash and BIG off for a bit. Just send them the letters. They'll ignore them, but send them anyway. No Holds at the bank....they said they couldn't do it unless there was illegal debits being taken out of my account. HOWEVER, it wasn't the Bank Mgr. who said that, he was out, so a lady who was also in the same dept. said they were not able to do any hard holds, deposits only....anyway, I decided once the nsfs go through and I pay them the fee, I am closing my bank account with them after 7 years. I am going to join a Credit Union.
And I have the address you gave me from the other posts for the BIG Ltd. one. Yeah, they BIG all right...BIG PHONEYS!! So I will just wait for their call and will happy to say, "don't call me anymore, please refer to my letter I have sent your company"! and hang up!!
This is all really very exciting! I can have my life back and have some money in my pocket! but can spread out the payments!!! I think I would have ended up insane the other day, if I didn't just happen onto this site!!!!!!!!!

sandi, I'm glad you're sounding so positive! That's the way to be! I'm really sorry your bank is being stupid though. I am just in awe over some of these banks. I'm so glad my bank wasn't like some of these others. They're so full of crap. I just hate that you are going to have to pay NSF fees. They can really add up. Just more money out of your pocket. sandi, personally, I would contact CashNet. Tell them the situation. Tell them your bank account is all screwed up (tell them whatever) and that you need to make payment arrangments. They certainly can't say you didn't contact them! LOL! You'd be calling WAY before the due date! But since they are legal, go ahead and try to work with them. If they agree to a payment plan, close that account out. But talk to them first. Did you tell the store fronts the checks won't clear? As for the internet ones, like I said, BIG is no "big deal". LOL! So illegal, but they will hound you to death by telephone. Just do what we discussed. Hang up. 500FastCash - I don't know. I haven't had to deal with that one. However, they are an illegal pdl. They'll try all sorts of tactics with you. It's not too ugly. They come full force in the beginning, but then they slowly fade into the background. Just expect phone calls. And maybe some threats. Illegal threats. And arguements. But you'll be right. But they'll argue. Lord! Love them all! Contact CashNet and see what you can do about them. Might as well get it over with. You have to do it sometime! See what they say. We just don't want your account to get hit with a bunch of NSF charges and you have to pay them all. That just sucks.

I don't trust any of them and refused to talk to them over the phone because I wanted anything they said to me to be in writing. 500fastcash never called me. They emailed me and accused of sending them a form letter as many of these places will and they also sent me a letter in the mail. I only owed them $20 in principle. They actually left me alone after a couple letters. I never heard from them again; however, it seems like this particular family of companies, MTE, has been really nasty to people lately. But at least they didn't harass me much.
As far as the letters, I lumped everything together into one. I would be glad to share the letter I sent with you if you need some ideas. It covered everything from revoking wage assignments, do not debit my account, do not call me, and do not call my work or my references, as well as I am reporting your a$$!!!! One letter will be sufficient, you might just have to send it a couple of times to get the point across.
As for B.I.G., I dealt with one of their dba's before coming to this site and I paid them a ton of money. From what I have seen on this forum, it is best to not even talk to them. Ignore them and they will eventually go away because they cannot be reasoned with.
Absolutely file those complaints, yes, even on 500fastcash. They need to be put out of business as well and there is power in numbers. We won't be heard if we don't complain.

The problem is that you are thinking 1 nsf fee each, no a huge deal. The internet companies are going to debit and debit, and then split the debits. They will do 20 $5 debits for a $100 payment. So that is 20 nsf fees. They aren't going to pay any attention to the revokaction letters, that is more so that you can have the bank reverse the mess they cause.
I would do a search on this site for Route 66. They are BIG. You will get an idea of what to expect from them . . . . They are the worst.
But keep your head up, there is light at the end of the tunnel! You will make it though, you've already got one of the storefronts set up, so you are off to a great start! Keep us updated!

I was persistent and FINALLY talked to my Bank Mgr., who knows me from 7 years being a customer; anyway...I explained my situation; he said yes they are familar with PDLs who are wiping people's bank accounts dry!!
He set up an appointment with me for Monday to sign a few forms. My checking account will be frozen to any fraudelent activity I tell them about; I am 100% protected. He said, of course, the legal ones that do come back, of course, I would be responsible to pay for nsf fees. I said...NO PROBLEM!!!!!!!!!!!
So this should be good as far as the bank and not getting slammed by a hundred gazillion dollars in NSF fees!!!

ALL THREE OF MY LOCAL STOREFONTS WILL ACCEPT MONTHLY PAYMENTS. One is over 3 months, another is over 6 months and the third will be discussed when I stop in. I guess because I have given them sooooooooooooo much business and know them so well, that this wasn't a problem!!!

Well, this weekend was productive and I felt somewhat better, until last night and today...."they" are making me feel paranoid again!
I got my bank situation taken care, they froze the account. I will open another later.
However, when I faxed both BIG & 500FastCash last night, the elongated letter with all revocations, etc. and that I will accept email and USPS communications only... and gues what??? BIG called within a couple hours. Now mind you, they aren't due until 8/15!!!
I sent them an email and repeated the request that only communications will be through email or USPS.
BIG left a message to call them so we could settle. Then another message this morning at 6:00AM !!!! And another,at work, left another message at 6:04AM (of course, I wasn't there!!)...then two messages today at home. Then tonite so far, 3 times within 10 minutes.
I added caller id, so at least I know who is calling.
It was an 800#. I didn't write it down, but I will next time, but did record the times.
Now, here is the question. Because, the letter stated to them, that they do NOT have a license to lend in Colorado nor in the US, etc., etc., SHOULD I PAY THEM ANYTHING?? or just the $200, which I don't have, because I am broke because of the mess I got into. I did receive $200 from them and they want $280. I know you guys told me time and time again, they are not legal and are overseas. So, give me some ideas as what to do with them. Oh yeah, I also sent via USPS the same letter I faxed to them.
Secondly, I sent the same letter to the other illegal 500FastCash and had no response YET! The got me the day before pay day and got the $75 which made my small amount go nsf, but the bank said they wouldn't charge me. But on their loan, which totaled, $325, and I rolled it and they took $75 three times including the one today, so I technically owe them $100.
And because they are illegal, do I pay them anything more??
By everything I've read from other people regarding these two companies, they eventually go away, but I don't want to cause myself any further stress about money, as that what I keep doing everyday. And they are illegal and stealing people hardworking money and getting away with it. Their time will come when they will get caught.
However, in a way, I feel like I should maybe arrange to pay them perhaps what they gave me.
So please give me some feedback.
