2 Judgements For One Debt
Date: Wed, 08/01/2007 - 10:52
My husband has 2 judgements on his credit report for the same debt. The most recent one for the debt, he was served, went to mediation, made arrangements and paid the debt. The earlier one is listed from 2003 and was done at a court in NJ. We moved out of NJ to FL in 2002.
I am sure it will be wishful thinking but is there anything I can do to have the judgement in NJ removed since he was never served and did not live there at the time?

You should not have to pay on the same debt twice. Contact whomever filed the judgement in New Jersey; send proof that the other judgement was settled and paid, and hopefully the NJ judgement will be cleared.

Write to the credit reporting agency and dispute the entry. They will remove it and contact whoever made the erroneous report. If they do not respond with the proper information within thirty days it will be deleted permanantly. Chances are the after five years they won't have the time or the person to find your file in storage.

Jurisdiction
If the company was in NJ that obtained the judgment then no there's nothing you can do. It's within their jurisdiction if that was where the debt was incurred. You can request that the judgment be removed. It never hurts to ask. I am under the assumption you have to be served a summons to be sued. Even if you move, the summons would have been transferred to the appropriate sheriff's office or police dept.
