If you've already paid this company off according to your state law, keep bombarding them with the letters & faxes. When they call, take their call and tell them to stop calling you, and refer them to your state law, and cite the law code reference.
You MUST be more persistent than they are in order to get them to stop. Many of these companies do not know the meaning of NO, STOP, CEASE & DESIST. You almost literally have to pound it home with the force of a sledgehammer to get them to understand that you are not paying them a penny more.

CTC will send a wage assignment to your employer with out a doubt. You MUST send a letter revoking that to CTC immediately by certified mail and give a copy to your HR person. They will do it everytime without exception. If you can stop that wage assignment you have beaten them. They are illegal and operating from outside the US. They have no legal means to collect. Please do not wait until your HR person gets the assignment. There is no legal requirement for them to honor it but from what I have read, ignorance runs rampant with human resource and payroll people. The next step is CTC will send you a settlement offer. If you have overpaid the tell them to take it and flush it after they use it. As Michael Douglas put it in War of the Roses they are "lower than the layer of prehistoric frog sh_t on the bottom of a New Jersey scum swamp."

Thanks frog! As a matter of fact, I sent a cover letter explaning to HR what the deal was and a copy of the letter I sent to CTC to my HR dept on Tuesday.
In the letters to CTC ( and all the pdl's) I indicated ( and underlined) that I am revoking the Wage Assignment to CTC and all affiliates and partners. I used cannr's awesome letter!
My employer is a top-5 bank in the US and they rarely let anything slip by...but yea, to be on the safe side I sent the letter to the payroll dept of HR. (specifically to the "garnishment documentation dept.")

Good job!!! Whew! I was a little nervous after what happened to another member. She lost her whole paycheck even though she showed the letter to her HR person. The HR person would not accept it and even though wage assignments are illegal in her State of Florida she could find nobody to help her. Not even the Department of Labor due to their know it all attitudes. Good for you!

Hello, I am new to this forum. I have actually been reading quite a few threads throughout the past month or so. This site has helped me quite a bit with the several payday loans I have. I am still having issues with Cash Transfer Center and was hoping someone had some more insight on what I can do. I have sent numberous e-mails to the customer care e-mail and they finally replied saying I needed to call the payment services department. I have sent an fax saying they cannot do a wage assignment against me and to also please communicate via e-mail with me. They keep calling and leaving messages. I want to get anything in writing that I come to terms with them with (this helped me with another PDL, they stated one thing as a settlement then later said something else and I had a copy of it to show them and I was ok). I do owe them money, I am not trying to skip out on what I owe them - right now my finance are way over the roof and I'm trying to get a handle on everything. I'd appreciate any/all advise you guys have. Oh, as a side note - I e-mailed the Florida office of financial regulation and she e-mailed me back to call her. I called her and she actually gave me this site to look up stuff on (which I already had been) so I think think that's pretty neat that the government is also recommending this.

Yes, I actually spoke to someone last week (at CTC)trying to get them to settle something with me. It's (Pardon my language) like a pissing match with them. I explained to them I DON'T have the money right now and would like to work something out, but they said I had to pay right then or else. Well, I told them I would just to shut them up (probably not the smartest thing). Anyways, I have since then sent e-mails and fax asking them to please put in writing my options and they just keep calling me saying it's very important for me to call them. Should I just bite the bullet and go ahead and call them? I guess I could always ask them to put in writing whatever we agree to, right? But I don't know (sorry, thinking as I type), what do I do if they won't make payment arrangements with me? I can't pay it all at once - I owe them $439. They sent me a letter yesterday via e-mail (which states "do not reply to this e-mail") telling me to call immediately and that I need to pay X amount of money and gave me the info to pay it. The funny thing is (and I'm sorry, I've got to laugh at the situation or I'll cry) it mentioned several times that I could get a new loan all I had to do was pay this one. So on and so forth. I know I've got one loan with PaydayOne and they've refused to make payment arrangements with me. They just told me that my account will remain in collections until it's paid in full. I realize I've screwed myself up with this stuff and it's totally my fault for getting in the mess that I have, but I just can't believe how narrowminded these companies are with not willing to work with us at all to get them their money. The sad thing is the two PDL's that I have aren't even legit that I've overpaid are the only ones that have worked out a payment plan and/or settlement amount with me.

They called my house and my mother in law constantly. Then I would email them and tell them not to call me, and they would then leave a message on my phone telling me they didn't have access to email or USPS and had to talk to me on the phone! I flat out refused to deal with them on the phone. Once they found out they couldn't get my wages, they pretty much left me alone. Several months later, they wrote my balance off after they were contacted by my state's attorney general. I am sorry you are mixed up with them. They are a nasty bunch.

Did you legally owe them money? I don't want them to send me to collections or anything that affects my credit worse then it already is. So far they've just tried calling me here at work (I've got caller ID, which rocks) and my cell phone. I just don't know what all they can do or will do regardless if it's legal or not.

Yeah, I did. I borrowed $250 from them, I think. They never sent me to collections besides their in-house collections. I was more than willing to make payments to them but they wouldn't let me. They wanted their money in full. Unfortunately for them, the AG got involved and they ended up writing my account off. Like I said, the most they ever did was call me or my mother in law, whom was a reference, and sent some emails and tried to use their wage assignment, which I had revoked. Once they couldnt get my wages, they left me alone pretty much and I didn't hear from them again.

well then I might just wait until I've actually got the money to be able to do anything and if they are still calling me then I'll take care of it. They called both my sister and a friend of mine that I had listed as references but I don't think they've called them but the one time. Hopefully with me sending them the letter revoking the wage assignment they won't try to contact my employer. I've just got to figure out something with PaydayOne now. They are the only other PDL that I actually owe money to. They've refused to take any kind of payments either. They told me they couldn't make any payment arrangements with me and until it is paid in full they will make all collection attempts. I guess these people have never had financial problems.....

A quick message is a feature where you can leave a message on someone's home page. :) Everyone that is a member has a home page where they can send and receive these messages. However, they are not private, anyone can see them. If you want to ask someone something privately, hit "PM" under a message they have posted.

Thank you for your info on this stuff. It gets so confusing and I'm really wanting to do what the "right thing" is, but I just do not have the funds right now without putting myself and my family out on the road. I'm doing all I can to just pay the normal bills right now that I screwed myself up with these loans to begin with. I just want to get all this crap done and over with and put behind me so I can get back on track and not have to worry everytime the phone rings. If nothing else, I've learned my lesson to NEVER, EVER take out another PDL again!!!

Yeah, please, please, please contact your hr department right away. CTC won't waste any time at all contacting them. I was really embarassed but it was no big deal. All I did was send my hr dept an email telling them I took a loan and had paid it back but the company was still claiming that I owed them money and I had filed a complaint with the attorney general. I told her they were threatening a wage assignment and that I was revoking their right to do so. HR was very cooperative and told me they would not give anyone information on me unless they had my ok. I followed up with them in writing, btw. And guess what, within the next day or two, HR was contacted!
No problem, we are all here to help. So many of us have been in the same situation. Please keep your chin up and I promise that things will get better!!!! I finally have no pdls and it is such a relief :)

I am sending her an e-mail to see when she is available. One good thing is I've been with this company forever and I have real good relationships with everyone. I'll just have to swallow my pride and embarrassment and let them know what is going on. CTC actually - I think - tried to contact them last week or the week before (I can't remember). They sent me an e-mail that I was copied on and had it addressed to one of the employees in our HR department with a letter attached asking them to verify that I work here. The catch was that the e-mail address they used wasn't a good address, so I don't know if they tried it again or if they left it be. That's when I called them cause it scared me that they were trying to contact anyone here. It was after the fact that I noticed the e-mail address wasn't correct.

I went to my main HR person yesterday and got wonderful results. They will not do any kind of wage garnishment/assignment without court order. Plus I found out that this guy from CTC tried calling HR to verify I worked here and he spoke first to one of the employees and she told him that she could not give out that information that he needed to speak to her supervisor and when she transferred him to her he hung up when she answered. I believe they said he did this at least twice. My HR department said it is company policy that they will not tell ANYONE if an an employee is employed here without written consent from that employee. She told me he should not be calling here that it is illegal and to let her know if he keeps calling. She was very understanding with my situation and told me to come to her if I need anything else. She said it was awful fishy that when I asked them for e-mail and/or fax numbers they told me they didn't have them that I had to call them. So I think I'm just going to bide my time with them and pay them as soon as I can. I've got to figure out what to do with PaydayOne. They sent me an e-mail stating they have been trying to contact me and that they are going to take collections action. I have already e-mailed them twice telling them that I can't make any payments right now, but that I do want to work something out with them and they just tell me that they can't help me - that I have to pay in full and until it's done they will still "hound me" (my words not theirs). What a headache all this crap is. By the way - I keep reading on here where people are mentioning going to a website to see if PDL companies are legal in your state. MWM - I live in Florida. There isn't anything on that site for FL. I did find the laws on another forum, so I know what I am legally supposed to pay. PaydayOne has actually just called me twice in a matter of 2 or 3 minutes for me to call them. I've already e-mailed them to e-mail me any/all payment options they are able to work with me on. And I hate to be a pain, but I've got a question on another payday loan too. It's on USFastcash. I borrowed $250 from them and have paid back $300. If I understand my state laws I should only have to pay back $275. Well they've ended up sending me an e-mail saying if I pay $125 by this Friday (Oct 5) they will consider my account paid in full. I am running extremely tight on funds until probably closer to the end of the month. If I do not accept this offer, can they do anything else to me - besides harass me? I know alot of these people on here have dealt with different things so I'm hoping someone can give me advise on what you guys suggest. I already talked them into pushing this date off from the end of Sept to this week so I'm sure I can't talk them into another week. thanks for any/all help

If you have paid more than the principal amount and these people are not licsensed to do business in your state than, NO they cannot do anything to you. Have you reported them to any agencies? All they will do is call you repeatedly. I would email them and tell them that you have overpaid your loans and state your state laws and request a paid in full and a refund. You won't get a refund but maybe a paid in full. Maybe Canner will be here in a bit to better tell you how to handle these people I am still somewhat of a newbie. If you don't have the money to give them, then don't give them anything until you can. You must take care of yourself and your families needs first. Don't skip the mortgage payment to pay these guys. They can wait. Try not to take the calls either if you can. Just let it go to voice mail or unplug the phone like I do. (A little hard to do when at work). Everything will work out in the end and we all will chalk this up to a hard lesson learned. All these people can do is offer idle threats that lead no where.

Just skimming the threads here...You need a letter ASAP to revoke the wage assignment and tell the pdl's that you have overpaid....and for them to stop calling. Did you PM me by chance? I got a PM request for a letter but wasnt sure if it was you?

Well I sent USFastcash a copy of the State laws a couple of weeks ago and told them I felt I was paid in full. That is when they sent me the letter saying I could "settle" with them. I was mainly going to do it so they'd leave me alone (at least that would be one less phone call I'd have to avoid), but I have to a roof over my head and a vehicle to go back and forth to work to where I can at least make some money to try to get out of this hole I've dug myself into. I have already sent CTC a letter to revoke wage assignment. I will go ahead and send it to the rest of the places. The good thing is my company won't fall for this type of stuff. Plus they are aware that I'm having some problems so they are keeping an eye out for stuff regarding me and they said they'd let me know if anything happens.

Yes this stuff is a pain. I wish the collectors had a moral compass like we all have. At least we are trying to pay back what we legally owe. But in actuallity, we don't even have to do that. Sometimes I wish I was ruthless and didn't care that I owed these people money and I could just tell them to stuff it up there a@@. I am glad your employer is keeping an eye out and won't let anything garnish your check. That is great. Another thing you could do is ask for a debt validation from these places esp the ones you have overpaid. :D

The laws that are posted apply to the storefront PDLs in Florida and not to the Internet ones. The FLDFS is using the Florida Consumer Finance Act to apply to them. It puts an 18 percent cap on small loans and requires licensing by all lenders regardless of there physical location. If they are not licensed the loans are non collectible. Some companies are getting around these laws by setting them selves up as Credit Service Organizations which are basically loan brokers. There is little regulation against them except for the fact that they must offer a lower rate than is readily available on the street. They do not.
As a resident of Florida myself I strongly urge all residents who come here to write to the CFO Alex Sink to enforce current laws regarding them and the PDLs and to amend the current laws to restrict this loophole. Tricia please write too! We need your help!

Yes, I would so like to tell them "look do you not understand when I freaking tell you I no money at all, do you not comprehend this at all? I am going to get you paid, but I can't do it right now, so please quit hounding me like I'm going to skip the country or something". Oh, well, one day this will all be over with and I'll look back on it as a learing experience to never get a payday loan again and the main thing - to keep a better handle on my finances. I looked up the website volleyball gave me and if I did it correctly only 2 out of my 6 internet loans are legal. Well, now let me change that. I just tried it again but I had done "fictitious name" and the two came up as active, but when I did it as "entity" they were inactive. man, this crap is confusing. And as I mentioned in my previous post, I'm a little confused on how to figure out exactly if these companies are legit or not. Here, let me give you my list of who I have (all are internet):
Paydayone - borrowed $500 - have not paid back
cashnetusa - borrowed $350 - paid $352.97
usfastcash - borrowed $250 paid $300
geneva roth - borrowed $300 paid $360
eastside lenders - borrowed $450 paid $337.50
cashtransfercenters - borrowed $300 - have not paid yet
I want to pay these people what I legally owe them - I did borrow the money so I feel I should at least pay them back that much.

Federal law says that fees charged by these companies cannot be considered interest. Therefore what they are charging you is 100% legal. It sucks, but that's how it is.
The other ones are not legal, and are operating without a license from any state.

Ok, I had read in other threads that the Cash Net USA was a CSO - they offered me three payments on an every other week schedule to have them paid in full. Yes, I will end up paying double what I borrowed, but everything I read there really wasn't anything else I could do. I didn't realize Payday One was a CSO - but both of them were the ones I found on the Florida website saying they were legal. Payday One isn't wanting to work with me on a payment plan as of right now. I'm trying to get everything in order and I figure they will be the first ones I pay off. I just have to get myself back on track and stay on track.
