Is DVing always the right choice?

Hi,
I'm new here and confused. I had perfect credit for years & then a year ago my fiance was killed I had to leave my job because I could no longer travel(no one to watch my daughter) & had to move b/c I could not afford our condo in CA on my own. I moved to AZ & was unable to find a job for 8 months. My son helped me & I was waiting for a settlement that when it came was much less than anticipated & not enough to pay off my debt, cc's & a 2k loan, just enough to pay my son back & eat regularly & pay my bills before the shut off notices come. My income barley covers the basics. I was naive & thought they would take minimal payments until I got back on my feet, I'm trying to start my own home based business. I have only talked to one ( and won't do that again), Mann Bracken, & I dv'd them about 3 weeks ago. My problem is I am going to file bankruptcy but have to wait til next May. I have 4 dunning letters I need to figure out what to do with. 2 are for medical, I had a very expensive ER visit when I was uninsured, that if I'm going to DV I need to do by Mon.
I screwed up by doing nothing for so long. I used to cry when the collection calls would come in b/c I wanted to pay but we were barely eating. I can't believe I am in this situation.I got 2 other letters this week from new collectors for cc's. I have talked to 3 lawyers(free consults) & they all said to DV.
I've made no payments since nov 06, I have no assets, our condo foreclosed.
What do other people do when they don't have the money to pay and the collectors won't work with you? I was severely depressed and suicidal for months and I am fighting to bounce back. I am tried of living in fear. I want to do the right thing but I no longer no what that is because they don't fight fair.
So should I keep DVing?

If they have reasponded satisfactorly to your quest when sent the DV letter then it doesn't help to continue to send the letter.

I remeber being in debt and getting those scary calls. Some collectors can be very nasty. What you need to sit down and decide if you even have the means to pay anything back that doesn't leave you struggling to pay your current bills and live a decent life.

debt counseling may be for you. It is where they work out an agreement to allow you to send in a reduced monthly payment.

debt settlement could be for you. It is where they negotiate with your bills and work out a settled agreement which is usualy a one time payment often cutting the debt in half.

Bankrupcy may be choice. If you debt outweighs what you make in a year you may want to read up on your chapter 7 or 13 bankrupcy laws.

Make sure you do research on anything you do decide to do to make sure it is right for you and that whatever you do it is with a reputable company.

First pull your credit reports at www.annualcreditreport.com to see what is being reported. Next if possible contact the original creditors for a status of the account.You will want to know the date of first delinquency for each account to figure out your sol. After this data is collected,then you must draw up a list of your debts and what extra money you have to come up with a plan of action.FYI has given you good advice too. Talk to a credit counselor.

I forgot to mention I did debt counseling & they wanted $700 & $600 a month but I don't have the income to support that so they couldn't help, it was CCCS or something like that.

I haven't had a response from Mann Bracken yet & they are the only ones I have DV'd. I don't have the money to pay them back right now so I guess it's just wait and see what they do next.

Don't give up! There is help and hope! I,too, lived in fear and didn't see any way out-then found this site.

FYI and Cajun are right on with the suggestions. years ago I had a collection agency try to collect on a debt for my son that we had paid off some 10+ years before. Not knowing any better, I almost decided to make payments to them because they were threatening. Luckily, I got a very kind collection agent on the phone one day- explained that this had been paid off, but did no longer have the receipts. She told me in a whisper to write a letter to them and tell them to cease and desist from contacting me, the debt was paid, the SOL past, etc.-and I never heard from them again.

You stated you were going to have to wait until next May to file Bankruptcy, can you tell us why you have to wait?

You will find help and support here, I did. I, now, am down to one debt from an evil collection agency- the others are paid off- We are here to help and support you, just ask!!..KAren :D
