I received a call from academy collections today. They have been trying to contact me and I did not get my mail becuase of my divorce situation. They gave me until 5:00 tomorrow to come up with 1100.00 or they sill send my case to the next level. The guy said the next step is legal. He told me to call my car company and my mortgage company and ask for extensions that they have to give it to me. Even if I do that, I do not get paid until 10/8. I told him that and they said just to get the extensions first and then he would see what they could do. I asked for time and he told me he already sent letters and there was no time left. They have to close out the quarter. The 1100.00 is a settlement of 40% of the debt. I have no family to help pay this there is just me and my kid. If I can not pay and have to set up payments they are going to be around 200.00 a month. I can not do this either. I am on my own with a house, car, ec and no support. I do not know what to do. No matter what I told him I could do he said they could not do it. I want to make arrangements but I just do not know what to do.

Roxy until they produce I would not worry about payment. If in fact they produce you can set up a payment arrangement thru a arbitrator or court going by your income and they would be required to accept it.Now going this route it would behoove you not to agree to anything that is not affordable as most of what I said in this arrangement is a written contract with court backing.

I'm not sure what these people are up to. I just relocated and am living with my children. My husband lost his right leg 2 years ago to severe diabetes and a rare, genetic vascular disease along with high blood pressure and complications of not being able to quit smoking. I, myself, suffer hip pain from a car accident. I have no bank accounts, no credit cards and these people won't leave me alone. They call at all hours, are very rude and always a different person or phone number comes up. My youngest son is visiting from the Army and this is ridiculous to be harrassed and woken up each morning between 6 AM and usually 8 AM and they keep calling all day long! I'm sick of this! I owe nothing and have no credit. I have told them that they have the wrong person and they keep calling. My husband is in very poor health and this extra stress is not good for him at all as he is at great risk for losing his other leg as well. I have early stage glaucoma and am somewhat disabled myself. Saw someone post about writing a cease and deceast letter. How do I do that? I am on the do not call list and my number unlisted, yet the calls keep coming. Can someone help please?? Thank you.

Here is a good template for a do not contact letter:
http://www.debtconsolidationcare.com/letters/sample9.html

Also they are not allowed to call you before 8am, anything earlier is a violation of the Fair Debt Collection Practices Act and you can sue them for $1,000 per call prior to 8am. Also You can get them for $1,000 in statutory damages for excessive calling, and verbal abuse.

Send the letter certified mail, return receipt requested. Once you get the signature card back from where they received/signed for it keep it, that is your proof that they got it. Also once they have received it you can sue them for $1,000 for every time they call you afterwards.
