I had a great conversation with Attorney Arthur Levy, who is working on the cashcall lawsuit in California. I also invited him to visit the forums, which I certainly hope he does and welcome him.
Here is what I can say on the lawsuit in a nutshell from Arthur: it is being filed in Los Angeles County and concerns CC's lending practices, specifically interest rates, fees and CC's practice of debiting on days that weren't agreed on by the consumer. Also they are looking at CC's charging bounced check fees that are higher than California state law allows. And more importantly, they are working to see that Cashcall doesn't engage in harassing activities.
Arthur agreed to let me give his contact information, but wants it in a PM to individuals, due to the volume of calls he could get.
He said that he would be willing to help if someone is facing an extreme situation with CC right now.
I told him that I am ready to sign on in the battle and know that many other members of the community would too!


HUMMMMM, Cash Call is still very much in business and answers everytime I've called. They have a website, Cash Call dot com. You can view your loan payments, balance etc right from there. They are legal.

I'm not trying to be ugly here however I have to say this: As I been reading this post now for months, I see everyone complaining about their rates, the rates are awful, however a person knows the rate before they sign, the contract even tells you to maybe consider another type of loan before loaning with them since the rate is so high. I have a loan with them, do I like it NO, but I signed on the dotted line now I have to pay the price....Being on this board has taught me many valuable lessons, once I pay off cash call I will never make such a dumb decision again:) I should have gotten a second job or sold some household items first! Is there one going on. I have been paying on a $10,000 loan for over three years and still owe the $9,429, was told my interest rate was 39%. Can I send an attachment of my payments and where it says 39%. Please give me any info you have regarding any lawsuits and who I can contact to make complaints of their practices

I think there is a class action suit in California, concerning improper monitoring/recording of calls.

I had a loan w/CC. Borrowed $2600 May 2006, and paid it off May 2008. I paid $216.55 per month for 2 years and after paying $5180 I found that it would take over $2,000 to pay it off. I paid them in full May 7, 2008.

There were a couple of months that I couldn't afford the payment because of car repairs. But when I tried to get a payment deferred they told me that I'd have to send them a copy of the receipt showing the amount I paid to get my car fixed, along w/all of my household expenses (utility bills) and then THEYwould decide if I was really able to make the payment AND it would if approved it would have to be deferred the FOLLOWING month!

No one forced us to take the loan but there should be a cap on how much these companies can charge (and not a 100% cap).

I hope that people who need loans read this and reconsider this type of loan because in the long-run it isn't worth it - unless you can pay it off within 90 days..

I used to work at Cashcall. I was with them for about a year. Here is what I know. They charge a ridiculously high interest rate, BUT.. they are mandated to put that interest rate on the loan doc that they email/fax to their customers. Whether you read that or not, is not Cashcall's problem. Just like if you bought a car, or got a credit card, you should read the contract. It's at the top in BOLD.
Your payment goes to interest first. All of these stories about people who have been paying for months and then find out they still owe as much or more than they borrowed.. well again, that's the same as ANY loan. Read first, sign after.
If you are not on their automatic payment system, they will call you on the first of the month, and every day thereafter, until your payment is made. According to the fdcpa (Fair Debt Collection Practices Act) they are allowed to contact you up to once a day... "contact", the company takes that to mean they can call you 15-20 times a day until they make contact. My suggestion is... learn your rights, read the FDCPA, especially sections 804-808 and 811. Some state regulations are stricter than the FDCPA, and so Cashcall has to abide by those.
In the end, the law is really with Cashcall. The contract is legal, their collection efforts are pretty extreme, but typically within the legal parameters. Suck it up, and pay off your loan as quickly as you can.

What about them actually sending someone to my place of residence to collect on my debt? Is that legal to do? I had to slam my door in the guys face when he wouldn't leave. When I told him I had no money to give him he said "Well I can wait here all day."
There was also an incident one day when my daughter (who is 12 yrs old) answered one of their harrassing phone calls. She was told that she had a VERY s_xy voice by the man. And he continued to solicit her after being told her age.
What's up with that??

I hated trying to deal with them. As a few of us did, I defaulted on my loan, to them, as well. Just couldn't keep up with everything. They FINALLY stopped calling, and then I found out they 'sold' my account to a CA. At least all of that high % stopped. I could give ya some 'stories' on them!!LOL

I took a loan out from cash call bacause my house burned to the groun and my ex was trying to put me in jail for being 90 days late on child support so between replacing everythin and getting a lawer i was desperate which is who these f---- sticks pray on i borrowed 2600 they charged me a $300 processing fee then paid over 3 years at 218 went to pay it off sat nov 29 2008 the balance on the loan was 2100 but to pay it off was $2,311 to make a long story short i should have just gone to jail

I live in Colorado and I have a Loan with CashCall. The were calling me for months every hour on the hour from 8:01 am to 8:59 pm. They called me at work and started calling my supervisor at work also. It was hell. They E-mailed me 1 to 2 times a day threatening me.

I live in Colorado also and they are major pains.. I finally changed my bank account and refuse to let them auto debit the payments. I send them the money and they keep harrassing me. If anyone knows how to deal with them let me know also.

I woul;d like info on the cash call law suit, I called and asked for the interest to be lower and of course they said no, I asked about pay off on the loan and they said they can't talk to me till my next payment is made, I am upset and just want to get rid of these people, what they are doing is wrong. I sent them a cease and desist letter and the calls stopped. I live in New Jersey and I went on line. Apparently they can issue money to certain states other than New York, Massachusetts, New Jersey, Iowa, West Virginia and they issued money to me anyway. I have paid over $3,500 so far and they said that was just for the interest! Normally a financial company incorporates the interest into the total monthly payment, which Cash Call didn't do. Wouldn't this be considered some type of fraudulent practice? They keep sending me settlement letter for almost $3,000, 1/2 of what they say I still owe them. Even at 30% I would only have paid $3,500 in interest. Is there an attorney out there who has fought with the company and won? I don't see any commercials for them anymore. Any help anyone can give to me would be apprciated.

I have a loan with cc and they take it out of my bank account and I don't have any problems yet and I hope I don't but the interest rate is 99.96% I think that is to much. The loan is for 3 yrs but it will take me 3 1/2 yrs to pay it off. I live in WV and now they don't give loans in the state of WV (wonder why), does anyone know any good lawyers in WV?

I live in FL i got a 2600 dollar loan cause i lost my job but in week i got another but i got a loan out. I been paying my loan since nov. 2006 and i still have till june 2010 to pay, i been payin 216.55 a month for this. In total i have payed 5630.30 and now i have to pay them till june which will be 3248.25. I too have a loan with CC that started june of 2006 for $5000
I was just laid off in Jan and had to move back to CA. Ive never been Late on a payment til this Month, so i called to inform them. they let me know that they could put off my next payment til August! so when they sent the paper work for me to sign? i hit the ceiling!!! Ive been paying $251 a mos since June of 2006 My payoff is $5016
they are changing the maturity Date from June 2016 to August 2016 awfully nice of them!!! at that rate I pay them $25000 for the original $5000

I would also LOVE to be involved in a class action lawsuit for this horrible company. I took out a $5000 loan to help my daughter avoid homelessness over 3 years ago. I've had to put off other bills because Cash Call's payment is deducted each month automatically, incurred lots of $33 overdraft charges and really had a nightmare. Finally I got my tax refund, and called them to pay off the entire balance. The payoff was $5104!! MORE THAN THE ORIGINAL balance after over 3 years of never being late. To add insult to injury, the little snippy girl on the phone, talked DOWN to me and acted as though this situation was entirely my own fault. They don't know ANYTHING about any of us and all I could say to her is "how do you sleep at night?"
PLEASE post how to join this lawsuit. I am in California also.

Ok, here's how to deal with the automatics...tell your bank you want to put an ACH stop payments on ANYTHING coming in from this company. They will charge you the typical stop payment fee, but this will insure that for at least a year they cannot touch your bank account with out a court order. Which they cannot get a court order without actually suing you and gaining a judgment in their favor. Stop making the payments and tell them to take you to court. NO judge in their right mind is going to allow them to steal 5000 plus dollars for a loan that was only 2600 to begin with. If they do sue you and win some money...this puts a cap on what they can get and then you can petition the court for a slow pay. No more interest can be charged on this amount. In effect making payments just as you were before, but this time it is being monitored and they can no longer be greedy little piggies.

Actually that is not completely guarenteed. A judge can??award the loan, applicable interest and late fees to this company. They are 100% Legal and recgonized in many states.

Cash Call is an installment loan, therefore they are allowed to charge the 99.24%??APR on their contracts. That is the major part that sucks about it. Many have borrowed $2500 and end up paying $9,000 by the time the loan was paid off. The only way to escape their cluthes is a lumpsum payment if possible.??This way they cannot stretch that interest rate out over your payback period. Unfortunatelly most of use who have borrowed from them cannot afford to do so, this is where they screw us over. I agree it is outright ludicrous, but until we win this lawsuit they are still getting away with loan sharking

[size=3][/size] I also took out a loan through CC in July of 2007, and I have paid over 4300 and the balance keeps going up. Once I have paid them off, I will have paid them over 9300.00. Its taking a toll on my budget. I have never been late on a payment, but I can't deal with this anymore. I live in the state of Ohio.

i have had a loan for 2600 with cashcall now for about 4 years about a year ago i was really fed up and i wanted to find out who owned cashcall and how i could let him know that i wasnt happy about a 99% interest loan and how unfair i thought it was so i found a number on the web for Paul J Reddam (949) 752-4601 i called it thinking that it wouldnt work. low and behold i was able to leave a message with him and told him how hard it was making the payments and explained that i had paid over 7000 on a 2600 loan and have never been late, the i explained that i wouldnt be paying anymore and that he would have to sue me for the rest of the money i also explained that if he did sue me i would file bankruptcy after cashcall had spent as much money as i could get them to spend suing me. I hadnt really planned on doing it but in the heat of the moment it just kind of came out. The next day i had the customer service manager calling me and wanting to work things out it boiled down to that they were going to lower the interest rate to 10% the y still have taken more from me then i think is fair but live and learn i guess....... call the number leave a message see what happens for you at this point it really cant hurt you and you dont have to follow through just plant the seed.

Does Arthur know of anyone in Idaho? I complained to the Attorney General they turned it over to the Finance Division who in turn said there is no law in Idaho as to the amount of finance charge, it is whatever the 2 parties agree upon

They call me constantly at work, even though I have asked them numerous times not to do so, they call my friends and family, I'm so fed up with them, it seems like I'm never going to finish paying them and it was only $2500 I took out! Help!!
