Cash Call Lawsuit: Suit to stop illegal lending practices by Cash Call

What is the information to get in the this California Class Action law suit..........I have been paying them since 2006, My loan was for 5K. I still owe the same amount I did then, and because I pay on the 15th, like I have for four years..I am harassed monthly by these jerks! They are horrible!

I have CC loan and after I fell behind in payments because I could no longer afford their outrageous payment and interests they started harrassing me. I tried calling them to workout a payment plan but they refused. I tried Consumer Counseling but they won't work any of those companies. I finally faxed them a C & D letter which and closed out my checking accounts to stop them from debiting and racking up insufficient fees on my account. This was back in March of 2008. I have not heard from them in a while and thought they finally got the hint. Well yesterday I got a lawsuit filed by some Richard Murphey guy in Newport Beach, CA on behalf of CC. I want in on this CA lawsuit against CC. Can someone email me the contact info for this Arthur attorney I'm reading about on here? Hope he can help me! These people are making my life a nightmare and just when I thought I'm getting back on my feet this bomb dropped on me. I am not making any excuses for the predicament I am in and it is money owed but the interest they got me in is making it impossible for me to get out of this financial hell hole. Have you considered exercising your right to have this matter heard in private, mandatory binding arbitration? Don't let arbitration scare you; there's a new world order when it comes to arbitration and I believe CC has mandatory, binding arbitration in their contracts. For more detailed info and why this might be an option, check on other debt help boards. Can I put what the other board is here? Don't want to violate any rules.

Does anyone know if there if going to be a Federal class action law suit against CashCall

I have a cash call loan and they call me every hour.....they use blocked numbers, they don't identify themselves when they call...they even told that there is no way my debt would be settled thought a chapter 7

I had a loan with Cash Call a few years ago and yes I did get behind but the people who were calling me were calling my house & place of employment asking for favors & tickets ( I work in the entertainment industry). All of a sudden the phone calls & letters stopped but they put it on my credit report for more than the loan was worth. Do you know the status on this CA lawsuit? Could you please forward me the Attorney's info once you receive it. I also have a similar case, it seems like I will never pay off the loan with the 99% interest rate, but today I was told they dropped it to 47%.

These "so-called" people are scum. I've had them call 5:30 A.M. on a Sunday morning, and as late as 11:45 P.M.. I paid every on time every month for four years. When I requested a lo an payment record, to see how my repayment was going, I discovered that I owed $1.42 more than I had originally borrowed. I am turning everything over to my attorney and letting them deal with the problem. When I call Cash Call, all I get is threats and fowl language.

I just received a call re this / told me there was a civil suit against "us" she did not identify herself clearly at all / then the caller gave me a telephone # to call back, goes to a residence / If any one knows the correct phone # to reach these people / and or their correct title pls respond

I have took a loan in 2008 but got into financial difficulties got harrassed and was told that its unacceptable that I dont pay by the next day at 9am since I told them I can pay by nxt month because even though I would like to pay them there's no money to pay. The person was irritated and I know that they are recording me and said that I should use payday loan, ask people to borrow money, or pawn something. I told them that I have done that in the past thats why I got drowned from payday loan to pay them off and they were rude and raised their voices and said that she's beeng talking to me for 10 mins and still I am not going to pay them which I replied I dont have the money so I wont be able to pay and like I told over and over again that I can be able to pay by nxt month. She (Lorena Welsh of CashCall- supposedly a supervisor) said, thats unacceptable, you have to pay by tomorrow 9. Pls let me know how I can get in contact with the class action. I have been paying them regularly since July 2008 and have missed once in Dec 2009 and again this month.

Does anyone know how to contact the class action suit against Cash Call ? My scenerio is like every one else's on this posting, but I put that account with a Debt Settlement company based in Ca. Cash Call wouldn't even talk to them about a settlement. Now 3 years later a company called Sound Credit Services is calling for Cash Call to collect the money. They haven't threatened me yet, but are strongly demanding payment. I'm laid off at this time and have told them repeatedly, but they insist on me calling friends, family, etc. to get between $ 1000.00 to $ 1500.00 to pay to Cash Call. I told them that I am on unemployment and have other bills to pay like rent, utilities, food and car payments. The guy from the credit service told me that since I find the money to pay for the things previously mentioned, then why can't I pay Cash Call. I told him repeatedly that there's no money left to pay extra bills and besides why did Cash Call wait 3 years to contact me and wouldn't talk to the settlement company that I had hired ? I took a loan out with Western Sky Cash for $700 the loan fee was $300 i recieved $400. This loan was sold to Cash Call. Are they a legal lender in Ohio?

I had a loan with cashcall some years ago, I was late on a payment and they got funky with me on the phone. I do not scare easily, and becasue of the way I was spoken to decided to tell them to shove the loan up thier a@@. They proceeded with the nasty calls and I proceeded to search out a lawyer, I then started the first class action against them, I won....paid me 10k in damages and loan forgivness of 5k, 10 of us settled out of court. They aint scary. it was a joke to be honest at how easy it was to get them to screw themselves by the way they acted over the phone, I must say though, I had one thing on them that most people didn't, however that part is private.

i recieved a loan from western sky they sold the loan to cash call. they told me that my interest rate was one thing, but after my first payment i called them to ask ,how long was this loan? they said 38 mths.they are charging me 11,400 for a 2,600 loan. I complained to them that they lied and it should be illegal . I have been recieving nasty calls from them up to 12 times a day. They talk about my family and call my landlord and friends telling them that im a dead beat.

I'm not sure what state most of you all are in, however, I'm in North Carolina. When I filed a Complaint with the AG office, I was able to speak to a rep that represents these types of cases almost immedately.

They sent a C and D letter along with the law here in North Carolina. Basically, the terms that NC has set - it doesnt matter which state THEY are in, it matters the state YOU are in. So, because I live in NC, and they are issuing loans to residents of NC, they need to abide by NC law. it was almost a 3 page letter.

They keep contacting me after the C&D letter, which is illegal and has a 1K pentalty for every attempt to contact after the C&D letter is sent.

To answer the person's question about credit reporting - I am not sure about YOUR state, but I specifically asked this to the AG office. It's an illegal loan - therefore, reporting to the credit agencies on illegal activity??? STUPID. She told me to pull my credit reports and if it's listed they would personally handle it.

Further, for collections - they have to prove you intended to *walk away* from your loan, or obligation. If you contact them, which I had the AG office do for me, and tell them I was more then happy to pay - as long as the terms are set within the legal limits of the law - proves I'm not walking away. It really helps if you actually talk with someone at the AG office when you do something, ask questions - "what is the law around this?" and they will bluntly tell you.

My loan didn't originate with CC, however, CC agents were there every step of the way.... the originating loan company is under Federal Ingestigation for Fraud - and the owner has done time for mail and loan fraud to my understanding. So most of this doesn't look well. Neither were upfront on the fees - when I was told 50 for fees, CC's agent made it seem like it was 50 dollars. No, it was 50% of the loan....

I understand contracts were signed, but if they are illegal to start with - well... at least that's how the person in the AG's office explained it to me.

I also love when CC tries to call me, I accept the call, so I have records of them contacting me after a C&D letter, and they hang up on ME.... unreal. Don't lose your cool, don't cuse and don't be nasty. It will come full circle.

I was in a situation that I needed to borrow 2500.00 and did this through Western Sky, that was on 9/26/12 on 10/17/12 I called for a payoff and was told it would be 2717.00. Today I called as I want to pay this off before the first payment 11/15/12 and was told I now owe 2902.25! This is ludicrous I had no idea what their practices was when I did this! I would certainly join the Class Action Suit against them!

I was in extreme financial distress and out of desperation did a loan with CC. Was not until I got the pamphlet from them that I saw my interest rate. It is insane. I have had to take more loans to pay that loan and am barely able to pay rent. I need help, I missed a payment this month and have been receiving threatening phone call at 7:50 in the morning all day! I finally had it and sent them an email demanding they stop. How do I get out of this without bankruptcy. It seems so wrong that this is allowed.

Is your loan through Cash Call or Western Sky? If Western Sky, they are illegal. What state are you from? Names of other lenders (storefront or internet)? How much was originally borrowed and how much have you paid back so far?

very true!! Western Sky is not Cash Call! They changed their name (for ad purposes) to try and get around the system. If you received a loan from Western Sky and your contract says Cash Call, the contract is null and void.

And if you got a loan from Western Sky and that is what your paperwork states, and then it was transferred to Cash Call to service. Still illegal since Western Sky is Tribal.. And as we all research more - not so sure that they are not the same company....

When I was trying to get the western sky loan, I dealt with a guy who's email was @cashcall.

from them yet (because I'm nowhere near the principal balance yet), but I did have to change bank accounts. I paid with my new checking account by phone and told them I would send in my new account information when I felt it necessary to do so. They called me multiple times a day to get my new ACH information (and I hadn't even advised them of the illegality of the loan yet or revoked my wage assignment or anything like that - i literally just had to switch checking accounts......!!!). They are psychotic. They also called my cousin who I put down as a reference. As soon as I get the principal balance paid, I'm telling them to go screw themselves. Frankly, I'm annoyed enough (and had several loans with them prior) that I'm about ready to tell them to consider everything done and paid. I could really care less what they report to the credit bureau. My credit is already in the tanker. If it wasn't I wouldn't have ever had to come to these bottom feeders in the first place.

Does the lawsuit deal with only CC initiated loans or will it include the Western Sky loans that end up with CashCall. I've been round and round with them since August as I have over paid more than $1,100 on this loan and am getting nowhere. Who is the loan through? It makes a difference if Western Sky or Cash Call.

i have a loan with them now, and i too have been going abck and forth with them and they are on my credit report. should i still wait it out or talk to this attorney?

I been a victim of cash/call I barrow $2,000.00 about a year and 1/2 ago monthly payment $294.00 a month I paid this people over $4,000.00 the agreement of the loan was before they loan me the money. What can I do? This is like dealing with Gangters.

Let me tell you a story about Western Sky and Cash Call: I applied for a loan from Western Sky in August of 2012 for 1500.00. I was very relieved when I was approved for the loan. When the money was deposited into my account it was only 1000.00 so I called Western Sky and told them the amount of the loan and the amount that was deposited was not the same. I was informed the 500.00 went to them for the origination fee. I was not happy about that and was told there was nothing that can be done about it since the money has already been deposited. When I login to my account it came up Cash call, I called Western Sky and Cash call answered was informed that Cash Call will handle my loan. Well after logging in and looking at my account the 1500.00 dollar loan I took out; 500.00 went to Western Sky for origination fee. My loan is for 25 months and not the 12months I was told. The interest fee is 149.00% I have been paying 198.19 per month Since October 2012 and I am not behind on my payments and my next payment is due May 1, 2013. My first payment was for 74.50 on Sept. 2012. My current payoff balance is 1449.70. So far I have paid 1461.83 to this company for a 1500.00 loan of which I only recieved 1000.00. In late September 2012 after I got the loan vantage funding and your loan funding gained access to my account and started deducting money. I had never heard of these 2 companies before. I closed my account immeadiately and called Cash Call to an alternative way to make my payments. After that phone call I started receiving 4-6 phone calls at home and at work a day from cash call about having my payment debited from my account. I also received emails and letters from Cash Call about having my payments debited from my account. I had to send them a long very unhappy letter about how they were harrassing me about a loan I had just recieved from them a few weeks earlier. I told them to stop calling me and to stop emailing me unless I miss a payment. I have not missed a payment. This loan was the worst mistake of my life. I thought taking this loan would help me pay off a few bills that was nickle and diming me to death, well the only thing this loan has done is keep me in debt. I was not able to pay off all of the loan I wanted to because I did not receive all the money I asked for. Again 500.00 of it went to Western Sky for a fee. In hindsight I would have been better off defaulting on those loans and taking longer to pay them off. I would have been finish paying 4 months ago, now I am in more finanical debt. STUPID STUPID STUPID ME. Now my goal is to get this loan pain off in the next 3-4 months. I have signed up for a bunch of overtime to pay it off. I would never refer anyone to these 2 companies Western Sky and Cash Call. Also I see commercials for Cash Call mortagage loans, I tell everyone I know especially my co-workers who are looking to buy a home to stay far far away from this company. I tell them my experience with Cash Call and I show them my account so they can see the interest rate. To everyone out there Please beware of these companies
