My advice would be to try and settle the account. Interest can still be gained on a credit card even after it has charged off. It's a lower rate than the defaulted rate and completely legal.

If she was not served,motion court to vacate judgment due to improper service. They will refile and during that time you can get them to validate debt to ensure they are the proper party to collect on the debt.
This is crazy
I just learned that we had this settled and paid, through our lawyer. These guys are trying to double dip. Do they have any way of knowing the original creditor has been paid, and thier "junk dept" is now worthless?

Some people on this sight insist that if you pay and keep records of payment all is well in credit and collection land--fact is--pay and keep paying years later--just my opinion! contact your lawyer? why?you already paid for them to follow the law why shouldn't debt collectors' have to do the same?
