CA getting ready to start garnishment

I have some issues and need someone who know's what there talking about to help, first of all I have a collection agency who is getting ready to start garnishing me, I've sent them a payment and they told me that they will sending it back as I didn't send enough money and they stated that they olny accept payment on a payment plan they are requesting that I fax over my pay check stubs which I do not feel comfortable doing, I have been garnished before by a different collection agency because I would not send them the same info does anyone know if I have any other options? If so please help me.
My second issue is that I was just contacted by a company that is tring to collect on a debt that is 6-7 years old and they want me to send a payment and I need to know with the debt being so old if I make a payment does it allow them to reset the date on my credit report so that it stay's on there for another 7-10 years? Thank You to anyone that can help.


Well srm, i'm definately NOT an atty by any means but in order to garnish ur check they must have a court order, a judgement against u! U should NOT send them ur check stub or any of ur personal information. Have they sent u the money back or cashed it? That's something u need to look into for starters...
On the second question, if u make a payment on this acct it will indeed start the SOL over again. What state are u in? With that information i can get u ur SOL.

srmr- Ang is right, you have to be really careful about what you send them. They have no business with your check stubs, bank info, etc.

CA will threaten anything, and some do sue-but,like Ang said, they can't just garnish without a court order.

If you are sure this is your debt, you owe it, and these people have the legal right to collect, you can set up payments. Have you sent a debt validation letter, to make sure this is your debt? I'm not sure that this would work, since you have sent a payment.

Keep all correspondence with them, if you have to go to court, you will need a paper trail.

If this is a federal thing, such as student loans, you will need to fax the info as soap lady said, they work differently that CC. Good luck..karen
