Close your bank account as soon as possible. If you open another make sure it is at a different bank. make sure that ACH debits won't force open your account.
After you close your account, you will need to call the legal ones and set up payment arrangements with them before they default. Cashnet Usa is legal. They operate as a CSO in Florida. They will try to tell you that they can only do ACH debits for payment, but hold your ground. They do accept other payments.
ameriloan is illegal. Legally you do not have to pay them back anything but most of us pay them back at least what we borrowed because we did use the money. Going on that you would owe $140.
I am not sure on the others whether they are legal or not, but someone else will be by that can answer that. Always concentrate on the legal ones before the illegal ones.

Sorry you will also need to send ACH revocation letters and Wage assignment revocation letters to all of them after your account is closed. I am going to pm someone who has a good letter that you can use and have them pm it to you.

From what I understand, the pdl would have to be licensed for Florida residents. Correct me someone if I am wrong. CashNetUSA, as pyb pointed out, will be licensed/legal. United Cash Loans and ameriloan are d/b/a's of MTE Financial, they will not be licensed/legal. Cash Transfer Centers is WAY illegal. They are overseas. Hang on and we'll get into that more. I'm not positive about Nationwide or Zipcash. So, anyone who knows if Nationwide or Zipcash would be licensed/legal for mrobinsdon, please post. You want to close your account and prevent these pdls from hitting by the 31st? I honestly doubt you can get it closed totally by the 31st. You're cutting it way too close. However, you can go to your bank - go to the branch where you opened the account - speak to the branch manager only. No one else. See if they can get it closed for you. They will have to assure you that your account will not be "forced open" due to pending pdl debits. Because these guys are going to be ready and waiting to hit your account. It might force the account back open. If they can not assure you (and if they do, get it in writing) that it will not be forced back open, you will need to do a hard debit block on it. Tell them NOTHING is to go through. This means no checks from you, your ATM card, nothing. It'll be blocked. You need them to do SOMETHING so that the pdl debits do not go through. Now, Cash Transfer Centers, you need to do a fast letter revoking any wage assignment you have signed. Do it NOW. All you have to do is type up a very short to the point letter stating: "I (state your name) hereby revoke any and all wage assignments I may have signed with your company, your partners, or any affiliates." Type your name. Your done. Put their information at the top, of course. Do this NOW. They will send a wage assignment to your employer. Email it/fax it/mail it certified. NOW. You must revoke it before they send anything to your employer. You are going to have to contact CashNetUSA, as they are licensed/legal, so you have to pay them. As pyb posted, they apparently will take other forms of payment besides ACH debits. Be firm with them. You need to get your bank account straightened out FIRST. This is the very first step. You need to make sure your money is taken care of, the pdls can't hit your account any more. Then we can start sending out letters. You do not want your pdls to know you are even THINKING of closing/blocking your account. If they catch wind, they will be all over your bank account like vultures. Do not breath a word to the pdls yet until the bank account is taken care of. Now, go to your bank ASAP in the morning and get this done. Like I said, you're cutting it awfully darn close. Either get it closed with assure in writing that it will not be forced back open or a hard debit block on it. Once you do that, we do have a letter for you to send to your pdls. But you need to do this first. Go to the bank, type the revoke letter to Cash Transfer Centers, come back and post what's going on with the bank. Then I can pm you a letter to send. However, you don't need the letter yet. You don't want to send it too soon. Please go to the bank first and post what's going on. Then we'll go ahead and proceed further. Also, do NOT forget to do that letter revoking wage assignment to Cash Transfer Centers now.

Some members have different views then me. I would not pay back any money to an illegal company. You legally do not have to pay them anything. It comes down to your choice.

I searched the Florida licensee database for both and di d not find either one. I used 'Zip' and 'Nationwide' and did a full search to find any business with these in their name and did not see them in the results. Can anyone verify that these two are not licensed in Florida or should I feel confident they aren't since I did not find them.
reply
This is where I was thrown off one time, mrobinson. I was looking for ZipCash once and couldn't find a thing. Do this... when looking at the Florida licensee database, just put in the first letter "Z" and see what comes up. Everything starting with a "Z" will come up. Then do the same for "N". See what comes up. If Zipcash doesn't appear under any of the "Z" listings, they're not licensed in Florida. If Nationwide doesn't come up under any of the "N" listings, they are not licensed in Florida. Sometimes they have a space in the name, sometimes they don't, etc. So try just putting the first letter only in and scroll through the names. Just to be on the safe side.

Yeah, searching for companies can be kinda tricky sometimes! It's always best to search as Cannr suggested, because spaces and spelling can be a factor, and many times people will not see a license when there is one.
Zip Cash is licensed in New Mexico, but I don't think it's licensed in any other state.

Thanks spanisheyes. I tried searching the database using just z and n and it didn't work. It was kind of late last night so I was going to try it again in case their site was updating or something. I just want to thank everyone on here for all the good useful information. I did go to the bank today and was very successful. I actually work in the operations area for the bank that my account is held. I contacted the Exceptions Manager and she guided me on exactly what we needed to do. My account is being closed tonight and they set me up with a new account that I can have my payroll posted into tomorrow night without worrying about all of it being taken away. The Exceptions Manager and I will go through the contracts tomorrow to see exactly what we can do. I did find out that there is a return code on ACH transactions when they are submitted and some of the illegal companies submitted their debit to my account with a 60 day return code meaning that my bank has 60 days to return the debit for any reason. I thought that was very interesting. Anyway, we are going to be going through all the details tomorrow and seeing what debits can be returned to them unpaid. I will keep you updated. What is my next step as soon as I make sure everything is ok with my account being closed?
I need help in Florida
Zip Cash, United, Nationwide, ameriloan are not licensed in Florida. Zip cash refunded me money and they only were worry that I made sure I notified the AG's office that they had settle and given me a refund. From your list of pdls the only one that is license is Cashnet USA! Go to your bank and close the account and open a new one. I did and it has worked.!
I need help in Florida
Also, make sure you send them a letter notifying them you ave revoked their ach, figure out how much you have overpay and ask for a refund. Also, make sure you file a complaint with attorney general's office, (believe me they are going after all these pdl companies! The only one that you might get a refund will be from Zip Cash ( I did) from the other ones don't expect anything but harrassment. You will have to settle with Cashnet USA as they are the only one license in Florida. Good luck! Keep us posted.

Cash Net USA is actually a CSO in Florida, so they aren't licensed. They are registered with the Sec of State, and are a Credit Services Organization. But they are still 100% legal.

OK, I have closed my account and all debits from all pdl on 10/31 have been returned to them 'closed account' by my bank. I have e-mailed all the illegal ones. What is my next step?

mrobinson, since your only LEGAL pdl is CashNetUSA, did you contact them to get an alternative payment method? You need to keep straight with them since they are legal. You've emailed all your illegal ones, correct? Did you revoke everything under the sun? I do see that you had already revoked your wage assignment with Cash Transfer Centers. They'll throw one at you so fast. In your letter to the illegal ones, did you cover everything? I saw where you responded to anthony that the illegal ones will not be paid. Your decision. No problem. Just make sure that you have documentation of what you have sent them. You want everything documents for your complaints. You will need to file complaints with the BBB, the FTC, and your state AG regarding these illegal ones. So, first, contact CashNetUSA and make alternative payment arrangments with them. Let me know what kind of letter you sent to the illegal ones. I just want to make sure you've covered your butt. Then you can file complaints against these guys with the agencies. You did the hard part already! Taking care of your bank account! Great job! Post if you have any questions at all.

I'm still straight with CashNetUSA. I have contacted them. I got a letter from someone and it covered everything. Funny thing is Cash Transfer Centers sent me an e-mail saying they are going to go after my wages, after I sent them an e-mail revoking all wage assignments. I replied to their letter with the same wage revocation letter just a few minutes ago. They have also been calling and leaving threatening voicemail's for me on my work number after I asked them in the e-mail to do not call me at any of my numbers. They sure are threatening. I have just printed out all my documentation and e-mail read confirmations for all of them so I have a hard copy of everything.

Cash Transfer Centers are the worst!! Make sure you give a copy of that wage assignment revocation letter to your payroll dept pronto if you haven't already!
reply
mrobinson, please do as fins says regarding giving a copy to your HR/Payroll department. Cash Transfer Centers WILL send them a wage assignment. Make sure your employer has the copy of your letter BEFORE Cash Transfer Centers has the opportunity to send it to them. And, you're doing great keeping hard copies of everything. Just make a copy for the HR/Payroll department also.

Ok...It's going to be ok. First of all, I'm going to assume that your HR dept doesn't know what a wage assignment is at this point...Or maybe they are confused. Hang on, I'm getting something for you..

In 1984, the FTC, which mandates assignments, passed a rule saying that you must be able to revoke any voluntary wage assignment. Because of this, every wage assignment MUST state in it that they can be revoked by you, the debtor. If it doesn't say this, it is not valid and cannot be honored!!!
Also..Assuming it does state this and is valid, a wage assignment MUST be a seperate piece of paper and not part of a contract. It must have the words WAGE ASSIGNMENT in bold type at the top of the letter. You MUST be at least 40 days in default. And it must have your account number, ssn, name of company, amount of debt, date signed, rate of interest and amount of interest. This MUST be in the first 3 paragraphs. Any deviation of this and the assignment is NOT VALID.
I think when your HR gets this it won't be an issue. There would be a helluva fine if they disregarded your revocation.

Thank you, fins! mrobinson, please print out what fins posted for you. Fins, the Cash Transfer Centers wage assignment does NOT follow your guidelines in the least. Actually, it doesn't even state on it the debt amount, the rate of interest, or amount of interest. There is no account number on it at all. It also states (in regards to being in default) 7 DAYS, not 40 days. Also, here is something interesting regarding the fact that it is supposed to state that you, the debtor, can revoke it. This is what is stated "I acknowledge this instrument as an absolute, irrevocable, and unconditional assignment and sale of the said amount of my wages." Down at the very bottom - typewritten - it states "I, (your name), (your SS#), hereby consent to the foregoing assignment." Then it says digital signature and your name is in HUGE BOLD PRINT. Hmmmmmmmmmm.................

hmmm..I believe also that you are supposed to be notified by the company 20 days prior to their intent to serve your payroll..But that may just be Michigan.
