I have abnout 7 payday loans, i'm trapped paying them off, they suck my entire pay every month and dotn leave anything over for rent and car payments. Isnt there some way to consolidate them into one? sureely someone can help. I'm drowing - i got one to help with my car breaking down and then had to take another and another and another. Its terrible, and the worst part is i'm not evening touching the principle amount its all finance fee's. Its surely my fault for doing it in the first place, but i really do need help. the fee's are 30 dollars per every 100 taken out. and those are taken out every two weeks, so i'm paying twice a month.

I had been told that King/ fox had bought my account from apollo - should i just add apollo into my letter to be safe?

Also, i have had a point blank refusal by usapayday loans to give me an address, any thoughts?

I'm not finding anything on Fox or King. Shoot. :x The only information I can come up with is the Appollo information. I'd go with that. It's something anyway! Now, USAPayDayLoans won't give you an address? Do you have a phone number for them?

Hmmmm.... that phone number doesn't come up with anything "real" on the BBB. You probably already found that out. So I went to the site. Nothing to really go on except one thing. That they say they "offer" loans and are governed by New Mexico laws. I just thought I'd post what it said. Maybe someone knows of a REAL address for these people!

I've found the following statement, or something like it in all the loan documents i have for these pdl's, is it going to affect the validity of what i'm trying to do??

Governing Law: By obtaining this loan and or renewal of this loan thereafter, both parties agree that this Note and your account shall be governed by all applicable federal laws and all laws of the jurisdiction in which the Lender is located, regardless of which state you may reside, and you consent to the exclusive exercise of regulatory and adjudicatory authority by the jurisdiction in which the Lender is located over all matters related to this Note and your account, forsaking any other jurisdiction which either party may claim by virtue of residency.

nm, whew! I thought I was going crazy for a second! :lol: Do not worry about that paragraph in the loan documents. They all have them. They are all a bunch of hooey. You are not governed by the laws of their state. They are doing business with a resident of Maryland. They are debiting a bank account in Maryland. Maryland, Maryland, Maryland. You did not fly to these pdl states and apply for a loan. They are doing business in Maryland. You follow your state laws. Believe me, we've all gotten the "you follow the laws of our state" speech from the pdls. Hooey. Do not give it a second thought. Maryland prohibits pdls. Period.

nm, oh, it may take them a bit to "catch on" to the fact that they are not getting their debits. Some take longer than others. However, enjoy the peace while you have it, my friend! Once they start trying to contact you, please try anything you can to NOT take phone calls. Do everything via email or USPS. You want documentation of everything. Keep us informed as to how it's going. If you need help with anything, we're here! :wink:

My pdl calls started today, i've had two calls from OneStepCash, which i ignored this mornig so they've jumped to threatening emails, telling me that i'm now in a position to have my wages garnished and something called a charge off, dont know what that is. I wasnt sure how to reply, so i sent them a copy of the letter i had mailed. any thoughts?

i got another email from onestepcash, which i've pasted below - any thoughts on how i should reply to it?
I understand your concern about the amount you've paid, but if you look in your contract, it clearly states that if you do not call in to pay the account off in full, it will continue to refinance. Meaning you are only paying the amount of the finance fee each time a payment is made. On October 11 your account went into "pay down mode", meaning for every amount of the finance fee that was taken out, you paid an additional $50 that is applied to the principal balance. Right now the balance is $305, I am very willing to work with you on this though.

nm, my advice? Just keep sending the letter to them as a "reply" to their email. I'm telling you, I did this FOREVER. I would send that same damn letter over and over thinking "Are they ever going to get this through their head?" Lord! But, do not take their calls. You don't want to speak to them. You want everything in writing. Stand strong against the phone calls. And every time they call you, send them an email (God, I love email!) telling them to not contact you via telephone, but only via email or USPS. Eventually they will catch on. It might take awhile, but they will. But keep on just sending that letter to them as a "response" to their emails. Oh sure they're "willing to work with you". Keep us posted. :wink:

I've been ignorning the phone calls, but the vm's are getting stressful, emerald wants to speak with my lawyer and all the emails are telling me that they are going to proceed with legal action and take my paychecks and that they're all in collections. thats kinda fast though i would think i mean they went from please call us to your going to court in the space of a few hrs. I have been replying to the emails with copies of the letter. i hate to sound panicky i'mjsut stressed, i dont want this to affect my job - sorry sorry

nm, do not be sorry! And of course you're stressing out! This is why we always say to not take the phone calls. Can you imagine what they would be telling you if they actually spoke to you? They are trying to scare the money out of you, nm. And an illegal company is certainly not going to take you to court. They're not going to show their sorry illegal butt anywhere near a court room. And do not believe them anyway. Like you stated (you're very level headed throughout this!), of course you're not "going to court" within a matter of hours or a day! My Lord! Like I said, they are using their nice illegal scare tactics to try to scare the crap out of you and get you to call them so they can say worse things and scare you all the more. They want to talk to your lawyer? Wouldn't they just crap all over themselves if you did have a lawyer call them back???? :lol:

more weirdness from fox/king/apollo- they had told me that my account had been bought by fox/king but my collections letters are from apollo so i think they lied about that and were trying to pull something

nm, not the first time I have heard of this. I recall another member being told that their account was "sold" and even given a name of the company it was "sold" to. However, found out later this was not even true. Apparently it was a scare tactic or an attempt to confuse this member. Whichever. It just goes to show you that these illegal idiots are so full of it and will say anything to scare people. And, I would LOVE the "job" of calling the illegal pld's and posing as your "lawyer"! LOL!

mycashnow, is sending me emails from the following email addressing and asking that i not reply to the email but call isntead : CPDCustomerService(at)CreditProtectionDepot.com

also they are saying that i should pay them 140 to take my account off legal hold or the account will be sent to a firm for legal action.

i'm hoping this is just a continuing effort to scare me on there part. Does anyone have another email for them, maybe it would help of i sent my letter to more than just this email address?

Your balance is 255.00 and will not be zeroed out you should have read your contract. As far as what state you live in that makes no difference what so ever. You state you will pursue legal action and that????????s fine in fact please get your attorney to contact me personally I look forward to speaking with him or her.

Okay, so MyCashNow is stating they are going to send you to "legal action" for an illegal debt. Okey-dokey then! And USPayDayLoan "doesn't care" what state you live in??? And they "look forward" to speaking with a lawyer??? Okey-dokey then! Are they insane??? First of all, do not let them scare you, which is exactly what they are trying to do. Pdls are prohibited in your state. Now, they are stating they are putting accounts in "legal status" (legal to them is what? THEY are illegal.) And they "want to speak with your lawyer". Please....... give me a break. If you had a lawyer call them, 10 bucks says they would never even answer the telephone. nm, do not worry about all this bull. I'm grateful that you're not speaking to them and getting all this in writing. Awesome. This will be wonderful to file any follow up complaints or if you ever need to dispute anything with any "collection agencies" they may send you to. Just keep it all. Don't even respond to their stupidity. They are nuts. Legal action? From an illegal company conducting business illegally in your state? Come on!

I've only had one email this morning and that was from apollo saying theyd sent my account from one collections agency to another and i just responded with my letter again, which stated my payment terms. i havnt replied to usa paydayloan though, i didnt know what to say to his let me talk to your lawyer speech.

also, today i've rec'd several calls to my cell and my work phone telling me that i had contracted a loan thru a company called "ach loans" - well they said thru there website and that i needed to make an immediate payment. I've never heard of a website or company called ACH LOans, has anyone here?? I told them not to call my place of business and that i had not contacted a loan thru them and they were most emphatic that i had - but when i called them back from my cell number the man who answered would not identify the company he was with, when i asked who had called me from that number. which is 646-224-7020

Huh. I can't find anything on ACH Loans. Maybe SOMEONE can. But I can't. Also, I did a search on the phone number you posted and it's an "unlisted" land line out of New York. Lord only knows. What does all this spell? Illegal to me. But that's just my opinion. nm, don't take any calls.

i was trying not to, but i have to answer my work phone and they got me that way - i told them they cant call me at work and he called 4 more times after i'd hung up. makes you want to just curl up in a little ball somewhere. i called my payroll dept and told them i was experiencing some fraud and to call me if someone tries to say i've given them voluntary garnishement permission, just in case they try. do i include the phonecalls in my complaint to the state since they came after i'd submitted the letter telling them not to call me? sorry i'm way stressed, having them call my work, i cant afford to lose my job and i work in a place that frowns on this sort of thing big time.

nm, I am so sorry. I know that sometimes you get "trapped" on the phone with them. Drives me nuts! Good job telling your payroll department about the "fraud". Now they'll give you a heads-up if someone tries to pull something stupid on you. And, yes, you can include the harrassing phone calls in your complaints. By all means, put everything in your complaints! I did!

tmbla - the only email address i have for them is this one:CPDCustomerService@CreditProtectionDepot.com and thats the one i'm having problems with, i'm guessing they got my first email and the other two that i sent were in response to automatic messages from them telling me i needed to call them. I sent another this morning, we'll see if that goes through.

Info on ACH Loans:
The Loan Agreement, to which we have adhered to by funding the loan, detailed that your loan was subject to the Arbitration Laws of Ireland, a fact by which you confirmed your understanding and acceptance of via the online signature you made. Please note, we are not a US company, have never prescribed to be a US company and have no US presence, as such are not subject to the US laws you detail. Please refer to your copy of the Loan Agreement. Under the terms of the Agreement you consented to make payments via ACH until the loan was satisfied in full. Your loan account is currently in default as your first payment was returned unpaid. We will continue to make all reasonable attempts to make contact and to attempt collection of all funds due and payable to enable the loan agreement to be satisfied, as per the original provisions. thank you kash - i'm not sure if they're ireland based or not, they didnt sounded american on the phone, but that dosnt mean much. I dotn know the company and dont have any loans thru them, i think it was USA PayDayLoan, trying to be clever about getting money out of me.

Roxy, i was definitly getting the calls, still am getting some. but it has dropped off, maybe for the holiday lol i'll be on my gaurd for them to start back up with renewed vigor soon. lol

I have encountered that as well that is why I thought I would call and my work comes up as private so I know they will not get my number. If they want to be paid eventually they will leave you a message. My theory was they must not have wanted my $$ that badly of they would not tell me who they were.
