I am disputing an inaccurate item on my credit report from a creditor that states I was 60 days late. I have sent them two letters and I have received only one. The one states that the information is correct the other I have not received a response. I have sent copies of my credit report to Transunion. The first one shows the accurate info, and the other (two years later) shows the 60 days late. Without filing a complaint with the BBB or FTC, can I sue them for defamation. I may be turned down for a gov't job because of this. When I called Transunion, I told them I am ordering copies of my checks from two years ago that shows all payments were made on time. They said it would make no difference to them because that as well as copies of my credit report are insufficient evidence for them to change the inaccuracy. Help

Hi rochetag

Did you pull your credit report from the other two bureaus also? You need to compare it thoroughly before you move ahead. You have to send letters of dispute along with the proof of your payment made to the bureau reporting the error. If they are not willing to remove the information or are not verifying the account with your information providers, you can send them a follow-up letter.

If the credit bureau refuses to correct the information after being provided proof, it is defamation, willful injury under FCRA Section 623. The extent of damages will be incurred by the wronged party, as deemed by the courts.

You have the legal rights to take actions against your creditors also if they are reporting the information in your credit report negatively. You can use the following letter to correspond with your creditors. You can make modifications tailoring to your needs.

YOUR NAME
ADDRESS
CITY, STATE, ZIP CODE
SOCIAL SECURITY #
ACCT #

CREDITOR NAME
ADDRESS
CITY, STATE, ZIP CODE

Date:

To Whom It May Concern:

My credit rating was negatively affected by your entry to the that showed a past due status of my account with you. I have since satisfied this debt. Therefore, I request that you submit a statement to that reflects the fact that the debt has been paid in full.

Thank you for your attention to this request.

Sincerely,

Your Name

They do not report to the other two bureaus only Transunion. I asked them to report but they said no.
The letter that I recently sent them contains the credit reports from Transunion that shows even after 5 months after it was pulled that the account was in good standing. I also have three other reports from Transunion at different times that shows the correct information. Only after the gov't pulled my Transunion report did it show up. So the onlt information I have is the credit reports, but I am having my old bank pull all the checks made out to them as additinal proof. Even then the credit bureau will not change the negative mark, they say it is insufficient eveidence. Only the creditor can. I checked with the BBB and they have nine other names or businesses that they operate from and they have received numerous consumer complaints, but they are not a member. I have contacted an attorney, but don't know what they will say.
