So... I have now closed my bank account and have not opened a new account yet, and have not signed on with Langhorne either.
Here are the questions...
1. Should I use a service like Langhorne?
2. Should I open a standard checking account or a debt account (one that uses a debt card)?
3. And should I continue the Direct Deposit?
Any direction would be helpful; if I were smart (Finically literate) I would not be in such a mess?
I look to the wish sages of this site for direction
Thanks
David

Cannr,
This is the latest from DMS Marketing and B&L Marketing:
Mr. ???,
You sought us out for a loan. Funny, no where in this email does it indicate DMS Marketing and you knew exactly what this was about. Who is in the wrong here? You went on line, searched for us, applied for the loan, received the money and are a first payment default. Be sure to let whomever it is you contact in regards to this that you signed a contract when you borrowed the money stating you would pay it back. I could see your complaint if you had paid a few extension fees but you have not paid ONE. Do not waste my time with your internet knowledge of payday loan legal terminology. Contact me today by phone to make arrangement on your account.
DSM Marketing
Ms. Jimel Hogan
According to our records you signed and verbally agreed to payback $390. If there is a problem we would be more than happy to work with you. The threats are not necessary. The last debit on --, if it is not returned, shows you paying a total of $360 which leaves a balance of $30. We will be willing to settle your account this way although it is not even one of the agreed upon payment options. I find it hard to understand why you would not just contact us and lets work something out if you were having problems. As we said before we are always willing to work with our customers. Its also sort of strange that 60 days after you received the advance it all of a sudden becomes illegal for you to get the money when all we did was give it to you when you needed it? I hope you did not get in any trouble spending the illegal money. We don't want anything but for you to pay back what you agreed to from the start. As we said we are willing top settle the account for the $30 providing that the last debit is not returned. Please contact us to let us know how to proceed. We await your reply.
B&L Marketing Services Inc.
So, My question is do I now contact then by phone to make arrangements or continue to hold them off with the emails?
I had told B&L that I would be forwarding their letter to the BBB, FTC and NJ AG's office for review.
Todate, I have not heard from United and ameriloan.
r
david, you have GOT to be kidding me! I read that email TWICE to actually believe they put that in writing to you! OMG! Okay, as I sit here in total disbelief, I'm just going to give you my opinion. #1. They are illegal & admitted it in the email. #2. They were smart-assed in their email. #3. You only "owe" them $30.00? Which means you actually have overpaid. So, my opinion? You've already filed a complaint with the BBB, the FTC, and your state AG. Drop it. Now, this is just me personally. You received an outrageous email from these guys (KEEP IT!!!), you've overpaid these guys, and they are illegal. DO NOT CALL THEM! david, can you image what they would say to you over the telephone if this is what they sent in a stupid email? Good God, they would probably really go off in that phone since there is no documentation. These guys have big *alls! DO NOT CALL THEM, david! Okay? Just let it go. If they continue to email, just keep them. Save everything. Let your state AG send them a letter. Please don't call them. I can only image the verbal threats and abuse they would throw at you. It's not worth the stress dealing with complete idiots. Let me know what's going on, okay? But do not call these idiots back.

Cannr,
AND the fun continues:
Mr. Green,
I am contacting you because you have one or more payday loans that have been referred to our collection department as a result of return payments by your bank.
We have made numerous attempts to get in touch with you regarding repayment of your account. Since you have demonstrated an unwillingness to voluntarily settle the debt, you have been referred to Check Recovery. This automated system is actively looking to locate any valid bank account associated with your name and social security number. If such an account is found, Check Recovery will move to recover the entire balance due at once.
If you would like to have control over how and when your obligation is repaid, you need to contact me to put a firm payment plan in place. If I do not hear from you by close of business November 28, 2007, I will assume you would rather have my company take back what you owe, rather than paying it back on your own terms. You may contact me by phone or email.
Jimel Hogan
THIS is interesting since we have been communicating via email and they have answered every reply I have sent
Also:
Mr. Green,
As indicated in the response, your account was zeroed by the lender. The terms of the loan that you agreed to are not under New Jersey laws. The representative that approved your loan, covered the terms of the loan with you. This is a contract that you agreed to, never requested a paydown or payoff for and now are expecting a refund. Would you like a copy of your loan packet emailed to you?
I will resubmit your request and see if the lender would be willing to compromise any further.

NOW this is the one that I have paid $810.00 (9 payments of $90.00 each) with noting coming off the principle, so he is nuts :?
But wait the fun continues with B& L Marketing, they sent me another email today saying the same thing they said in the last email.
Geneva-Roth called today since their payment was returned, I will send them the email again and see what happens with them.
The joke of the day UntiedCASHLOANS sent me an email offering to loan me more money :?:
I am having too much fun with this stuff (lol)
FYI, I signed on with Federated Financial for debt consolidation today, I found them on this site, so I hope they are honest: wink:
r
Oh, david! Good God! I swear, they're all swooping down at once! They did the same thing to me! I was hit by them all within a few days & about lost it! So who is the one saying that Check Recovery is "searching" for your information? Oh, isn't that nice? But OSL marked your account as zero but won't give you a refund??? How nice of them. Jerks. I'd send them a email every day asking about my damn refund. B&L is "playing the game" sending you the same emails. Fun. Send them the same one again as a reply to them. Send Geneva Roth the same email again stating what you already have. Send it 10 times if you have to. And United Cash Loans (sharks!) want to give you a loan??? Sure they do! They want some bank information from you! Did you check with the BBB regarding Federated Financial? I check with the BBB on every company to see what kind of rating they have. david, keep emailing these idiots the same thing over and over. Eventually, with much luck, you might get some refunds from someone! I'm saying "with luck". These illegal ones are horrible. As you are now seeing. At least you STILL have your sense of humor! It is kind of like playing a game with them all. Sad, but true. Let me know about Federated Financial. And also if you hear any more from your illegal friends via email. Good Lord!
Check Recovery
Cannr,
That was Westbury Ventures aka DSM Marketing etc., I would love to see this happen.
I checked Federated out with BBB and they have an A- rating. Not too bad, we will see what happens. I need some help getting control of my debt load and getting the collection agencies at bay for a little .
I feel better already, just knowing I am not alone in this hell hole of debt and dispair, Thank again for your support.
David
David, good luck!! Please keep us posted on your progress. Rox
David, good luck!! Please keep us posted on your progress. Roxy

david, good for you! If you need debt assistance, by all means, go for it! It always helps! I wasn't aware that it was Westbury threatening you with the Check Recovery and finding your new bank account information. Lord, they are horrible. Just keep an eyeball on your bank account. Make sure these snakes don't somehow "find" it. Can not trust them worth a squat! You know you've got support here, david! Any more emails or crap from these idiots, just let us know!
Geneva-Roth
Cannr,
I got this from Geneva-Roth today:
So, what do you thank?
before I send it I would like some input from the community
r
david, yes! You are offering to pay them the principle amount only. And they are damn lucky to get that. As for the email you received, it's really, really funny because this is a "form" letter that I've received from several pdls. Word for word. And they accuse US of using "form" letters. Please! Now, in your reply to them offering to pay only the principle amount, also include your state pdl law AGAIN. You know they're thick. But you are doing exactly what you should do. If they don't take the offer, they are more insane that I thought they were. Send it. I'm anxiously awaiting their response! You are doing an awesome job! :D
Counter Offers on the table
Cannr,
I sent both LoanPoint and Loan Shop(DSM) emails stating I was willing to settle with them for the priciple amount and that I would only send it via certified mail to a verifiable U.S. address, so we will see how they react to that
r
Good for you, david! You are doing to great! You're to the point, offering to pay them back, etc. What the hell would their problem be? I can't wait to hear the response! If they throw the "we only take money gram or western union as payment", I do believe I will scream!
A quick but useful aside.... Why is moneygram and western union
A quick but useful aside.... Why is moneygram and western union bad? Is it because of the fees, is it because some how they can still get your account information (like if you pay it with your debit card), because you can pay cash for those things right and reduce that chance?
But back on topic here, it is dumb to refuse payment of any kind. I mean, hey they are getting their money right?
What the H........
Cannr,
This is a surprise!!!!!!
So, I sent a reply accepting the refund offer but they must send it to me via USPS, I will not give them ACH information on my new account.
B& L also accepted my settlement for $30.00, and gave me an address to send the money certified mail.
United sent me an ad saying since I have a PIF account I quilify for more money, still more fun with not a word about my refund request.
Geneva-Roth and Loanshop are still playing hardball but I know they will accept the repayment offer of priciple only.
Wher is ameriloan??? they have not contacted me to date, I know United has informed them, I will just keep sending them the letter and settlement offer also.
some people have football I have PDL's for fun.

DAVID!!!!!!!!!!! I am doing a MAJOR happy dance here bright and early in the morning! WAY TO GO! :D Oh my God! You are doing so good so fast! You are awesome! I'm so glad you decided to stick with us and get through this! It is just a little "fun", isn't it? Now, as for ameriloan, they may not respond. Some pdls just flat out don't respond. Nice, huh? Shows how wonderfully legal they are! LOL! Just hang on! They will eventually and then claim you owe them $1,000. God love them! This is great! david, you are outstanding!!!
So Cannr, I see that somethings never change:  Mr. Gree
So Cannr,
I see that somethings never change:
Mr. Green,
I will be emailing the document to you as an attachment today. The lender prefers to transfer the refund via ACH to the account on file.
Please advise at your earliest convenience.

Here we go again, I sent them an email saying I don't have a bank account and that I will only accept a check or money order.
Let's see how that goes today :sun:

david, of course the lender "prefers" to send the refund via ACH credit. Give me a break! Why don't they just send a huge sign that says "BANK ACCOUNT INFORMATION PLEASE". Sneaky little things, aren't they? Let me know what their response is to you not having a bank account.

Cannr, And here id their reply:
Mr. Green,
The lender has contacted me regarding your request for your refund being sent by mail. They only use ACH transfers and do not mail checks. Please provide an account the funds can be transferred to as there is no other means to transfer this refund. Perhaps you could use the account of a family member or friend for this one time transfer. Please advise at your earliest convenience. We would need a copy of the voided check to insure we have accurate account information. When we receive this information, we will send an updated form for your signature in regards to this transfer. Please do not sign the first form sent to you today.
Thank you.

So, I guess I don't get the refund!, I noticed that she never states who the lender is ??, Just a vague referrence to "The Lender"
I was born at night, just not "Last Night"
David
r
david, these guys are so transparent, I can't even stand it! Oh, send us YOUR bank information and your FAMILY and FRIEND's bank information! Holy crap! Sure... let me send you my family members bank account information. My God! Okay, now this is just me because I personally would want that friggin refund. And, like I said, this is just me, you do whatever you want. But my ass would be at a bank (whatever!) and open a new account (go to a completely different bank than you are now with). Give these stupid illegal morons that account information and tell them to deposit the money there. Once the money is deposited, withdraw every single penny, and then close the account that day. Sounds like a big hassle; however, like I said, I personally would want that refund. Just close the damn thing the same day you withdraw the funds.

Cannr,
like I told you in thePM, I sent them am email back saying that they could send payment to my PayPal account which would give them comfimation that it was paid. Let's see how they react to that idea! :!:
A small victory
cannr,
this is a small victory for the little guy :D
"Mr. .....,
I advised the lender of the situation and they agreed to send your refund via US Postal Mail. You can then sign and return the original form I sent you. If you need it resent, please let me know. Also, when you respond, please include your full address to verify we have the correct one on file. "
So, I will comply and send back the notorized statement and see what happens.
David

Yes, read everything very carefully. Glad you are having fun messing with them, it is nice someone can really stick it to them every once in a while!
r
david, way to go! You stood your ground and got them to agree to MAIL your check! I don't believe verifying your address for them will "hurt" anything. Hell, anyone can find out your address. But it may just be another one of those "Mutual Agreements" that pdls have people sign, which they won't ask for anything personal. However, if it's not, like they posted above, read it 20 friggin times before you send it back! If all they want you to do is say you won't "come after them" or whatever and they're not asking for info., you should be fine. You know what you're doing. Why am I even telling you this? Love the way you got them to cooperate with you! I can't believe how great you're doing in such a short time!

More fun!!!!
Just an update:
I received a refund from CMG today in the amount of 420.00 paid by USPS money order :o
The address on the return was in Nevis; I read on this site that it was a drop box for taxes.
I also got a reply from United Cash Loan on my BBB compliant; they refused to refund anything on the PIF loan and said I would have to send them something in writing to the "legal" department if I wanted to look further into the matter. So BBB closed out the compliant :? Saying it was over.
My question is where to go from here: this loan was PIF in October and GECC was also PIF both are refusing refunds :(
I still have not heard from Amierloan who I owe a balance of 210.00 and LoanShop is asking for a PIF of 390.00 by the 19th of this month and Geneva-Roth has said that they are in the Holiday sprite and will take a check by phone for half of the fee and then collect the balance of the principle in three installments plus the fees :P
They bumped their heads, if they think I will give them my bank account information again.
So, guy which way do I go now?
David

David, Congratulations on the refund check! I am really happy for you. Do not feel bad about united cash loans....I paid them for months...overpaid the $300.00 I borrowed, and they claimed in my BBB complaint, they have no record of me in their system. Go figure. And I can not understand why you would not give them your new account information...it isn't like they would debit your account for the whole amount or anything
I am sure your mentor will be along soon to guide you in the right direction
r
roxy, quite cracking me up! I am glad you received your CMG refund. Happy dance for you! I'm surprised they PRINTED OUT their actual Nevis address! Lord! They revealed their true address to someone! United Cash Loans (a$$es) - they are refusing a refund through your BBB complaint? Okay, did they at least send you something (or did you get something) in writing stating it is at least considered PIF? The BBB already closed it? I hate it when they do that. Good God. Now, I'm a hound. I would re-file with the BBB (yes, I know....) and this time your complaint being that you overpaid and demand a refund. Just start a whole new complaint again against them. Also, email the crap out of them demanding a refund. Now, like roxy said, it's hard to get a refund out of these people. But if you've already received a PIF (in writing) from them, my personal mission now would be to hound them to death regarding a refund. And their "legal" department is THEM. Lord........ "Legal Department". It's the dude sitting over in the NEXT cubicle in the friggin call center. GECC also owes you a refund. Have you been turned down by them through your complaint with the BBB? Or no? Did they send you something in writing stating you are PIF? Whichever, treat them the same way as United Cash Loans. Hound the living hell out of them as well. If the BBB closed your complaint with GECC also, open a new one. ameriloan scares me that you haven't heard from them. They're up to something. Keep your guard up; however, enjoy it while you can. One day out of the blue they'll most likely hit you with "You owe us $5,000." Don't be surprised. Loan Shop can "bite you" and Geneva Roth can "bite you". They are INSANE. Glad to hear they are in the holiday spirit though!
